{"id":10292,"date":"2015-09-03T12:33:42","date_gmt":"2015-09-03T20:33:42","guid":{"rendered":"https:\/\/blogs.ubc.ca\/workplace\/?p=10292"},"modified":"2015-09-03T15:35:13","modified_gmt":"2015-09-03T23:35:13","slug":"battle-wages-over-best-interests-of-ubc-ubcnews-caut-bced-highered","status":"publish","type":"post","link":"https:\/\/blogs.ubc.ca\/workplace\/2015\/09\/battle-wages-over-best-interests-of-ubc-ubcnews-caut-bced-highered\/","title":{"rendered":"Battle wages over best interests of #UBC #ubcnews #caut #bced #highered"},"content":{"rendered":"<p>By law, defined in the <em>University Act<\/em>, <a href=\"http:\/\/www.bclaws.ca\/EPLibraries\/bclaws_new\/document\/ID\/freeside\/00_96468_01#part6\" target=\"_blank\">members of a Board of Governors at a BC university\u00a0&#8220;must act in the best interests of the university.&#8221;<\/a>\u00a0The <a href=\"http:\/\/www.facultyassociation.ubc.ca\/docs\/1September2015lettertoBoardofGovernors.pdf\" target=\"_blank\">Faculty Association of UBC<\/a> and <a href=\"http:\/\/www.cupe2950.ca\/wp-content\/uploads\/2015\/08\/Scanned-from-a-Xerox-multifunction-device.pdf\" target=\"_blank\">CUPE<\/a>\u00a0are now questioning whether individual members of the UBC BoG are acting &#8220;in the best interests of the University.&#8221;<\/p>\n<p style=\"padding-left: 30px;\">\u201cGiven the \u2026 incessant stream of rumour and innuendo that continues to swirl around the University, we do not believe that the maintenance of a mutually agreed to non-disclosure agreement around Professor Gupta\u2019s resignation is in the best interests of the University, of Professor Gupta, or of the public,\u201d the <a href=\"http:\/\/www.facultyassociation.ubc.ca\/docs\/1September2015lettertoBoardofGovernors.pdf\" target=\"_blank\">FAUBC\u00a0presses<\/a>.<\/p>\n<p>In addition to acting in the best interests of the University, BoG members must be honest with the members (e.g., students)\u00a0and\u00a0employees (e.g., faculty, staff, students) of the University. The FAUBC is suggesting that the BoG&#8217;s members are failing on both counts, being neither honest with faculty members nor acting in the best interests of the University. That&#8217;s a problem, one of the law, to be sure.<\/p>\n<p>Questions of honesty are being raised as questions of manipulation, breaking a social contract and\u00a0deceit are raised. The <a href=\"http:\/\/bog.ubc.ca\/?page_id=2937\" target=\"_blank\">BoG Code of Conduct<\/a> specifies that its members must act on the up and up.<\/p>\n<p>One member, the\u00a0<a href=\"http:\/\/bog3.sites.olt.ubc.ca\/files\/2015\/08\/fact-finding.pdf\" target=\"_blank\">Chair\u00a0of the BoG John Montalbano, is already under investigation<\/a> for allegations of\u00a0taking steps to interfere with academic freedom.
