I situate my human rights complaint in the larger socio-political context of Canada becoming \u201ctoo Asian.\u201d Download the\u00a0article from <a href=\"http:\/\/ices.library.ubc.ca\/index.php\/workplace\/article\/view\/186179\/185382\"><em>Workplace: A Journal for Academic Labor<\/em><\/a>.<\/p>\n<p>For the background, chronology, and case records, see our\u00a0<a href=\"https:\/\/blogs.ubc.ca\/workplace\/category\/chan-case\/\">coverage in the <em>Workplace<\/em> blog<\/a>.\u00a0Briefly:<\/p>\n<p style=\"padding-left: 30px;\">BCHRT\u2019s\u00a0<a href=\"http:\/\/www.bchrt.gov.bc.ca\/decisions\/2012\/pdf\/jan\/12_corrected_chan_v_ubc_and_others_no_2_2012_bchrt_12.pdf\" target=\"_blank\">decision on 24 January 2012<\/a>\u00a0to hear the\u00a0Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case\u00a0(<a href=\"http:\/\/www.bchrt.gov.bc.ca\/decisions\/2010\/pdf\/dec\/350_chan_v_ubc_and_others_2010_bchrt_350.pdf\" target=\"_blank\">21 December 2010 HRT decision<\/a>;\u00a0<a href=\"http:\/\/www.bchrt.gov.bc.ca\/decisions\/2012\/pdf\/jan\/12_corrected_chan_v_ubc_and_others_no_2_2012_bchrt_12.pdf\" target=\"_blank\">24 January 2012 HRT decision<\/a>) was moved to the Supreme Court for a judicial review (see <em>The<\/em>\u00a0<em>Ubyssey\u2019s\u00a0<\/em>[UBC student newspaper]\u00a0<a href=\"http:\/\/ubyssey.ca\/features\/does-ubc-have-an-equity-gap692\/\" target=\"_blank\">feature article<\/a>\u00a0for the backstory to the case). The Supreme Court then ordered the BCHRT to review its initial decision (<a href=\"http:\/\/www.courts.gov.bc.ca\/jdb-txt\/SC\/13\/09\/2013BCSC0942.htm\" target=\"_blank\">29 May 2013\u00a0BC Supreme Court judgment<\/a>).\u00a0The <a href=\"https:\/\/blogs.ubc.ca\/workplace\/files\/2014\/01\/BCHRTdecision20131219.pdf\">BCHRT\u00a0turned and dismissed the case on 19 December 2013<\/a>.<\/p>\n<ul>\n<li>December 2009 Complaint filed to University<\/li>\n<li><a href=\"http:\/\/www.bchrt.gov.bc.ca\/decisions\/2010\/pdf\/dec\/350_chan_v_ubc_and_others_2010_bchrt_350.pdf\" target=\"_blank\">21 December 2010 BC HRT decision<\/a><\/li>\n<li><a href=\"http:\/\/www.bchrt.gov.bc.ca\/decisions\/2012\/pdf\/jan\/12_corrected_chan_v_ubc_and_others_no_2_2012_bchrt_12.pdf\" target=\"_blank\">24 January 2012 BC HRT decision<\/a><\/li>\n<li><a href=\"http:\/\/www.courts.gov.bc.ca\/jdb-txt\/SC\/13\/09\/2013BCSC0942.htm\" target=\"_blank\">29 May 2013\u00a0BC Supreme Court judgment<\/a><\/li>\n<li><a href=\"https:\/\/blogs.ubc.ca\/workplace\/files\/2014\/01\/BCHRTdecision20131219.pdf\" target=\"_blank\">19 December 2013 BC HRT dismissal<\/a><\/li>\n<li>1 March 2015 Dean announces Review of Chair (no Report was produced)<\/li>\n<li>1 April 2016 Dean announces <a href=\"http:\/\/ogpr-educ.sites.olt.ubc.ca\/files\/2013\/04\/Ad-David-Lam_Posted-2016-04-22.pdf\">search for David Lam Chair <\/a>(Associate Dean\u00a0Haverkamp appointed Chair of Search Committee again). Announcement\u00a0that Chair was &#8220;recalibrated.&#8221;*<\/li>\n<\/ul>\n<p>*Note:\u00a0Exactly what\u00a0was &#8220;recalibrated&#8221; through the\u00a0&#8220;Review&#8221; is unclear. Comparatively, when advertised in 2005 and 2009, the Name of the Chair was the &#8220;David Lam Chair in Multicultural Education.&#8221; <a href=\"http:\/\/ogpr-educ.sites.olt.ubc.ca\/files\/2013\/04\/Ad-David-Lam_Posted-2016-04-22.pdf\">The April 2016 Ad or CFA still indicates the same<\/a>.\u00a0So the Chair title was not recalibrated.\u00a0In 2005 and 2009, the search sought scholars who contributed to multicultural education and now in 2016 the search seeks\u00a0scholars who contributed to multicultural education and &#8220;social justice studies&#8221; so that was not recalibrated.
