{"id":9557,"date":"2013-06-05T16:40:03","date_gmt":"2013-06-06T00:40:03","guid":{"rendered":"https:\/\/blogs.ubc.ca\/workplace\/?p=9557"},"modified":"2013-06-05T16:40:03","modified_gmt":"2013-06-06T00:40:03","slug":"chan-v-ubc-discrimination-case-sent-back-to-bc-human-rights-tribunal","status":"publish","type":"post","link":"https:\/\/blogs.ubc.ca\/workplace\/2013\/06\/chan-v-ubc-discrimination-case-sent-back-to-bc-human-rights-tribunal\/","title":{"rendered":"Chan v UBC discrimination case sent back to BC Human Rights Tribunal"},"content":{"rendered":"<p>The University of British Columbia&#8217;s petition to dismiss Dr. Jennifer Chan&#8217;s complaint of racial discrimination must go back to the BC Human Rights Tribunal says a <a href=\"http:\/\/www.courts.gov.bc.ca\/jdb-txt\/SC\/13\/09\/2013BCSC0942.htm\" target=\"_blank\">29 May 2013\u00a0BC Supreme Court&#8217;s judgment<\/a>.\u00a0The\u00a0BCHRT&#8217;s decision on 24 January 2012 to hear the\u00a0<a href=\"http:\/\/www.bchrt.bc.ca\/decisions\/2012\/pdf\/jan\/12_CORRECTED_Chan_v_UBC_and_others_No_2_2012_BCHRT_12.pdf\" target=\"_blank\">Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case<\/a>\u00a0was moved to the Supreme Court for a judicial review.\u00a0In addition to the BCHRT decision and Supreme Court judgment, the\u00a0<em>Ubyssey&#8217;s (<\/em>UBC student newspaper)\u00a0<a href=\"http:\/\/ubyssey.ca\/features\/does-ubc-have-an-equity-gap692\/\" target=\"_blank\">feature article<\/a>\u00a0provides a background to the case.<\/p>\n<p>In the Supreme Court judgment, Madam Justice Loo argues that the BCHRT must assess whether &#8220;the\u00a0complaint has been appropriately dealt with in another proceeding.&#8221; A decision within the BCHRT to hear the case must address UBC&#8217;s argument that\u00a0&#8220;internal university processes [used to hear Chan&#8217;s appeals] qualified under the <i>Code <\/i>as &#8216;proceedings&#8217; that had appropriately addressed the substance of&#8221; Chan&#8217;s complaint.
