My Faculty Association and Me: A Case Study in Sweetheart Unionism and Academic Mobbing

This paper recounts recent experiences of mine with the University of British Columbia (UBC) Faculty Association (UBCFA). I am a tenured Associate Professor at UBC, Okanagan campus (UBCO) and I began my FA role as 1st Vice-Chair of the Okanagan Faculty Committee (OFC), an executive position on this standing committee of the FA, in July 2017. The paper is couched in terms of the relatively recent concept of academic mobbing, defined as “an insidious, non-violent and sophisticated kind of psychological bullying that predominantly takes place in college and university campuses.”1 It also employs the concept of “sweetheart unionism” defined as a deal between an employer and union officials that benefits both at the expense of employees; in this case, a deal between UBCO and UBCFA that benefits UBCO management and FA Executive Director and staff in Vancouver at the expense of UBCO faculty members.

As we count down to and roll through graduation, can we please remove the mace from convocation and governance at the University of British Columbia? The mace had its day in the first 100 years of this esteemed University but that day has gone.

Dalhousie University is currently embroiled in controversy over its mace, decorated as it is to demonstrate racial supremacy (“the rose, thistle, fieur-de-lys, and shamrock, depicting the major racial groups of our country”). Indigenous peoples and advocates have said enough already.

Some traditions just aren’t worth maintaining…

At the Nexo Knights’ Graduation Day,

Jestro grabbed a sword, a mace, and a spear and began to juggle them… The unimpressed crowd started to boo… Sweat broke out on his forehead…. He let go of the mace, and it flew across the arena. The crowd gasped and ducked… Then … bam! It hit the power grid on the arena wall. The area lights flickered, then turned off. Soon the power outage surged throughout the city.

Yes, this really did happen in a Lego story! And in England, Bradford College faculty members called the admin’s decision to spend £24,000 on a new mace for graduation ceremonies a “crass bit of judgement.”

At UBC, things were questionable again this past year. With an opportunity to follow faculty and staff members’ and students’ proposal to divest from fossil fuel investments, in mid February UBC chose to continue to be a part of the problem of climate change instead of the solution. Still heavily invested. And after chalking up a $22m budget surplus, in April & May UBC jumped the line at Wholefoods to draw $7,230 in grocery bag donations. On 24 April an Open Letter signed by 110 faculty members was submitted to the UBC Chancellor Reappointment Committee questioning the process.

The days of the mace in Convocation and governance are of the past and that part of the past is no longer worth reenacting.

It’s difficult to know where this University now stands or what it stands for.

It is time to retire the mace, symbol of aggression, authority, and war. It’s time to march to graduation ceremonies in late May and November with open and empty hands as symbolic of peace and reconciliation of controversies and roles of the President’s Office.

Queen Elizabeth I granted her royal mace to Oxford in 1589. From military and civil power derives academic authority. The rest is history and it is not all good.

It is time to retire the macebearer, whose importance is inflated every year by the image’s presence on UBC’s graduation pages leading to Convocation. In pragmatic terms, if the mace falls into the hands of the wrong macebearer or manager at this point, someone’s liable to get clocked with it.

Is UBC’s mace still a respectable appendage to Convocation?

Remember, since that fateful November day in 1997, just five months into Martha Piper’s Presidency, when student activists put their bodies and minds on the line at the APEC protest, Tuum Est adorns both the can of mace sprayed in their eyes and the ceremonial mace that the President’s Office is eager to carry across campus every November and May.

Is it not time to retire the mace?

It has been an emotional year for the University of British Columbia. As budgets moved from Central, the Truth and Reconciliation Commission of Canada launched Honouring the Truth, Reconciling for the Future. The residential university and college take on new meaning. As we launched the celebration of our Centennial at UBC 100, our President resigned under a cloak of secrecy. As we began to party, we launched an investigation to discover the lengths to which a Chair of the Board of Governors and administrators might go to suppress academic freedom. Now, as we march to Convocation, students and alumni launch evidence that UBC is failing to properly respond to sexual assaults on campus.

In the meantime, terrorists and terror struck Sharm el-Sheikh, Beirut and Paris while the dogs of war howl for bombers and drones to command from the skies above. Increasingly larger regions of the world live in a state of emergency.

It’s difficult to know where this University now stands or what it stands for.

To take a stand symbolic of peace and reconciliation, please lay down the mace for ceremonies and Convocation. Please put away the coat of arms and lay down the mace. If not for good, then how about for peace?

More bucks than brains: James Ramey and the ruination of the University of Louisville

In the late 1990s, Kentucky’s legislature initiated a program to upgrade and reform the state’s postsecondary education system, it was called “Bucks for Brains.” (The state’s promotional tagline at the time was “Open for Business.”)

I was recruited to the University of Louisville in 2001 and spent two-and-a-half years on the faculty there as a department chair and distinguished university scholar, which gave me an up close and personal experience with a university administration that’s, as they say where my family’s from, sigogglin.

John W. Shumaker, a classics scholar, was UofL president when I arrived and he proved to be an incredible fund raiser, increasing the university’s endowment from under $200 million to $550 million.

Of course, the UofL has long been the recipient of corporate largesse, especially from the Louisville’s corporate giants Brown-Forman (one of America’s largest spirits and wine companies); Brown & Williamson (which chemically enhanced the addictiveness of cigarettes, remember whistleblower Jeffrey Wigand? No? Well I’m sure you remember Russell Crowe playing Wigand the blockbuster movie The Insider); Papa John’s Pizza (UofL football Cardinals play in Papa John’s Cardinal Stadium); and Yum! Brands (“feeding the world” crap food via KFC, Pizza Hut, and, of course, Taco Bell, more on the Mexican connection later).

After Shumaker left to head up the University of Tennessee (where he resigned in disgrace after 3 years), he was replaced by James R. Ramsey, who had been Kentucky’s state budget director under Gov. Paul E. Patton (who became wealthy by exploiting Kentucky’s coal miners).

Patton’s major achievement as governor was overhauling postsecondary education in the Kentucky. But Patton’s political career was de-railed by duelling scandals: (1)  an extramarital affair and a sex-for-favors scandal; and (2) pardoning four of his political advisers who were indicted for violating Kentucky’s campaign finance laws and for allegedly abusing his patronage powers.

All of this is just everyday Kentucky politics, so Patton wasn’t distracted enough to forget he had to find a soft-landing for his budget director, thus Ramsey, with no university administration experience, became the 17th president of the University of Louisville.

Since Ramsey has been in office the UofL, in endowment has continued to grow and is now pushing the $1 billion mark, which is really the only logical explanation for why he hasn’t been bounced because Ramsey’s administration has more ethical lapses than Carter has liver pills, pretty much proving that the UofL has more bucks than brains.

Robert Felner: Former Dean, Convicted Felon

Felner arrived in Louisville with some spiffy credentials: PhD in psychology from Yale; former head of the department of psychology at the University of Illinois; a CV packed with pages upon pages listing his publications in top journals and, most importantly for the UofL administration, a staggering number of grants.

Despite several red flags about Felner’s candidacy for dean of UofL’s College of Education and Human Development, Ramsey and his long time provost, Shirley Willihnganz, couldn’t wait to get Felner on campus.

Ramsey was in such as rush to land Felner he and Willihnganz forgot to tell the interim dean (and other finalist for the position) they hired Felner, so he was left to discover the decision when Felner call his secretary and started giving her instructions. So much for that HR seminar!

Things in CEHD soon started to fall apart.

I resigned from my department chair position two weeks after Felner took over as dean and later moved to UBC.

Within a few years, there had been 30 grievances filed by faculty and students against Felner for a wide range of abusive managerial practices and a faculty vote of no-confidence in Felner’s leadership of the CEHD. Reasons given by faculty for the vote of non-confidence included:

Public humiliation of faculty, work place harassment, retaliation for voicing opinions, little or no governance, decisions that hurt College, unacceptable and unfair hiring practice; rude, offensive, unethical behavior by CEHD representatives; denial of support for research to those who differ in opinion; and extreme inequity of pay. Despite the abominable conditions in CEHD, UofL Provost Willihnganz and Ramsey both supported Felner publicly.

One year after the vote of no-confidence, Felner announced he was leaving the UofL to become president of the University of Wisconsin, Parkside.

The Chronicle of Higher Education described Felner as “riding high” a couple of years into his deanship at UofL, well-paid, and having secured a $700,000 grant from the US Department of Education. However, he “pressed his luck” during his last weeks in Louisville.

Even though only $96,000 remained in the account, he implored Louisville officials to approve a $200,000 subcontract with a nonprofit organization in Illinois that had already received $450,000 from the grant. Perhaps, he suggested, the university could draw on a special fund that had been established by the daughter of a former trustee.

The Illinois group, Mr. Felner said, had been surveying students and teachers in Kentucky. That survey would “let us give the feds something that should make them very happy about the efficiency and joint commitment of the university to doing a good job with an earmark, as I know we will want more from this agency,” he wrote in an e-mail message on June 18.

But on June 20, his last day as Dean of CEHD before he headed off to Wisconsin, those big black SUVs with government plates (like the ones you see on Criminal Minds) rolled into the CEHD parking lot. US Secret Service, US Postal Inspectors, and UofL Police questioned Felner and escorted him off campus, along with his computers and records.

There was a simultaneous raid on UW-Parkside to confiscate material Felner had shipped ahead of his arrival there.

In October 2008, a federal grand jury indicted Felner on nine counts of mail fraud, money laundering, and tax evasion. According to the indictment,

the Illinois nonprofit group, known as the National Center on Public Education and Prevention, was simply a shell that funneled money into the personal bank accounts of Mr. Felner and Thomas Schroeder, a former student of his and the group’s “executive director.” Prosecutors say the two men siphoned away not only the $694,000 earmarked grant, but also $1.7-million in payments from three urban school districts, money that ought to have gone to the legitimate public-education center that Mr. Felner had created in Rhode Island.

In January 2010, Felner pleaded guilty to nine Federal charges, including income tax evasion.

In May 2010, Felner was sentenced to 63 months in US Federal Prison for his role in defrauding defrauding the UofL and the University of Rhode Island, where he had been director of the School of Education, of $2.3 million of US Department of Education funds earmarked for No Child Left Behind Act research.

Felner Footnotes: Indians, John Deasy, Non-Disclosure Agreements & Ramsey as the Frito Bandito

(1) When Felner announced his resignation, UofL president Ramsey wroted to Felner and said he was worried about “letting the Indians get back in control of the reservation.” That’s some serious respect for university faculty and the idea of shared governance, eh?

(2) Los Angeles school superintendent, John Deasy, has had his academic credentials called into question. Deasy was given a PhD by the University of Louisville after he was enrolled for four months and received a total of nine credits.

Deasy’s doctoral advisor was, surprise, Robert Felner! Deasy had previously awarded $375,000 in consulting contracts to Felner, while Deasy was Superintendent of Santa Monica schools.

Ramsey appointed a “blue-ribbon” panel to investigate Deasy’s degree. The panel found that getting a PhD in four months at the UofL was not cause for concern, thus plunging the UofL’s academic reputation down into the neighbourhood of fly-by-night for-profit “higher” education.

Deasy is now working in an unaccredited training program sponsored by educational de-formers the Broad Foundation, which teaches school leaders business methods and supports charter schools and closing public schools.

(3) Ramsey has been making double retirement payouts to UofL administrators for their silence.

Records show that the school paid a full year’s salary to outgoing vice presidents Michael Curtin ($252,350) and Larry Owsley ($248,255) and to assistant to the president Vivian Hibbs ($66,391) to induce them not to “disparage, demean or impugn the university or its senior leadership.”

In March 2014, UofL made a $346,000.00 settlement with university counsel Angela Kosawha:

The University of Louisville is paying another large settlement in connection with the retirement of a high-ranking official — this time, $346,844 to its top lawyer. University counsel Angela Koshewa is on a three-month leave of absence before she officially retires June 1. Documents obtained under the Kentucky Open Records Act show the university is paying Koshewa — who has questioned some expenditures and proposals backed by President James Ramsey and Dr. David Dunn, the executive vice president for Health Affairs — twice her final salary.

It costs a lot for Ramsey to cover up details of his administration’s incompetence and shenanigans, but remember there are lots of bucks at UofL.

(4) Provost Shirley Willihnganz stepped down as UofL provost earlier this year. The Louisville Courier-Journal reported that

Under her watch, however, university employees have stole, misspent or mishandled at least $7.6 million in schemes at the health science campus, the law school, the business school and the athletic department’s ticket office.

Willihnganz also was criticized for approving about $1 million in buyouts for former high-ranking employees, some of which included agreements not to disparage the university or its leaders.

She also was forced to apologize to CEHD faculty in 2008 for failing to take any common-sense action against Felner for his intimidation, harassment, humiliation and retaliation against faculty, staff, students and alumni.

Willihnganz said at the time that she tended to dismiss the early complaints against Felner — including a no-confidence vote by faculty — because he was a “high performer” and because the complaints came from professors and staff “entrenched in their ways and resistant to change.”

She later told faculty at a meeting that she was sorry. “Mostly what I think I want to say is people have been hurt and something very bad happened, and as provost I feel like I am ultimately responsible for that,” she said.

No duh! She actually is directly responsible for the Felner disaster (along with Ramsey), that’s probably why she feels that way. And speaking of resistance to change …

(5) This next item has nothing to do with Felner, except that his former boss and advocate, James Ramsey, is also the long time boss of UofL basketball coach Rick Pitino who admitted to having sex with a women in a swanky Italian restaurant in Louisville. Apparently that’s not a problem with Ramsey and the UofL because Pitino said it wasn’t rape.

And, now Pitino is using hookers and strippers to recruit high school basketball players to come to the UofL. See Dave Zirin’s pieces on the latest Ramsey supervised scandal:

(6) And I almost forgot. Remember the Taco Bell/Mexican connection. This week Ramsey had a little halloween party at the UofL. Ramsey goes racist (again). Yes, he dressed up like the Frito Bandito.

Ever futile is Capilano University’s game of whac-a-mole turn whac-a-sculpture, as yet one more caricature of President Kris Bulcroft has surfaced. When Blathering On in Krisendom surfaced Capilano University whacked it to pieces in May.

Now in October, where life imitates art as whac-a-sculpture, another has surfaced at the hands of sculptor George Rammell. Margaux and the Monarch is indeed a thing of beauty, mace, pen and pooch! What grand preparation for the graduation ceremony!

As Capilano’s Convocation guide indicates, “The mace depicts the authority vested in the University to…” well, fill in the blanks. “In keeping with this longstanding tradition” of a raw and visible demonstration of power, the Convocation guide indicates, “our ceremonial mace will be carried by Capilano University’s director of Buildings and Grounds.”

It is unlikely the Director of Building and Grounds will carry the entire sculpture. Just the mace. Margaux and the Monarch!

PS. Just looked outside and swear the garden gnome is now a  $^@&% ‘n mini-Margaux and the Monarch statue.

Dark Days for Our Universities

[Recent events at Capilano University and University of Saskatchewan have raised serious concerns about the health of the academic culture of post-secondary institutions in Canada. Crawford Kilian, who taught at Capilano College from its founding in 1968 until it became a university in 2008, wrote the following analysis of Canadian academic culture for The Tyee, where he is a contributing editor. On May 13 I attended a meeting of the Board of Governors of Capilano University, which has had a very bad year.

Last spring the board agreed to cut several programs altogether. This caused considerable anger and bitterness, especially since the recommendations for the cuts had been made by a handful of administrators without consulting the university senate.

Recently, the B.C. Supreme Court ruled that the board’s failure to consult with the senate was a breach of the University Act. This upset the board members, who may yet appeal the decision.

Adding to the angst was the disappearance of a satirical sculpture of Cap’s president, Kris Bulcroft, which had been created and displayed on campus by George Rammell, an instructor in the now-dead studio arts program. Thanks to media coverage, the sculpture has now been seen across the country, and by far more people.

Board Chair Jane Shackell (who was my student back in 1979) stated at the meeting that she had personally ordered the removal of the sculpture because it was a form of harassment of a university employee, the president. Rather than follow the university’s policy on harassment complaints (and Bulcroft had apparently not complained), Shackell seemed to see herself as a one-person HR committee concerned with the president alone.

At the end of the meeting another retired instructor made an angry protest about the board’s actions. Like the judge in a Hollywood court drama, my former student tried to gavel him down.

I didn’t feel angry at her; I felt pity. It was painfully clear that she and her board and administration are running on fumes.

The mounting crisis

I look at this incident not as a unique outrage, but as just another example of the intellectual and moral crisis gripping Canadian post-secondary education. The old scientific principle of mediocrity applies here: very few things are unique. If it’s happening in North Vancouver, it’s probably happening everywhere.

And it certainly seems to be. On the strength of one short video clip, Tom Flanagan last year became an unperson to the University of Calgary, where he’d taught honourably for decades. He was already scheduled to retire, but the president issued a news release that made it look as if he was getting the bum’s rush.

More recently, Dr. Robert Buckingham publicly criticized a restructuring plan at the University of Saskatchewan, where he was dean of the School of Public Health.

In a 30-second interview with the university provost, he was fired and escorted off campus.

A day later the university president admitted firing him had been a “blunder” and offered to reinstate him as a tenured professor, but not as a dean. It remains to be seen whether he’ll accept.

The problem runs deeper than the occasional noisy prof or thin-skinned administrator. It’s systemic, developed over decades. As the Canadian Centre for Policy Alternatives noted last November, the University of Manitoba faculty very nearly went on strike until the president’s office agreed to a collective agreement ensuring professors’ right to speak freely, even if it meant criticizing the university.

Universities ‘open for business’

At about the same time, the Canadian Association of University Teachers published a report, Open for Business. CAUT warned about corporate and government deals with universities that would ditch basic research for more immediately convenient purposes.

“Unfortunately,” the report said, “attempts by industry and government to direct scholarly inquiry and teaching have multiplied in the past two decades…. For industry, there is a diminished willingness to undertake fundamental research at its own expense and in its own labs — preferring to tap the talent within the university at a fraction of the cost.

“For politicians, there is a desire to please industry, an often inadequate understanding of how knowledge is advanced, and a short time horizon (the next election). The result is a propensity to direct universities ‘to get on with’ producing the knowledge that benefits industry and therefore, ostensibly, the economy.”

This is not a sudden development. The expansion of North America’s post-secondary system began soon after the Second World War and really got going after Sputnik, when the Soviets seemed to be producing more and better graduates than the West was. That expansion helped to fuel decades of economic growth (and helped put the Soviets in history’s ashcan).

Throughout that period, academic freedom was in constant peril. In the Cold War, U. S. professors were expected to sign loyalty oaths. In 1969-70 Simon Fraser University went through a political upheaval in which eight faculty members were dismissed and SFU’s first president resigned.

A Faustian bargain

What is different now is that Canadian post-secondary must depend more and more on less and less government support. Postwar expansion has become a Faustian bargain for administrators: to create and maintain their bureaucracies and programs, post-secondary schools must do as they’re paid to do. If public money dwindles, it must be found in higher student fees, in corporate funding, in recruiting foreign kids desperate for a Canadian degree.

So it’s no surprise that Dr. Buckingham was sacked for criticizing a budget-cutting plan to rescue an ailing School of Medicine by putting it into Buckingham’s thriving School of Public Health.

And it’s no surprise that Capilano University had shortfalls right from its announcement in 2008. It had to become a university to attract more foreign students than it could as a mere college, but at the last minute the Gordon Campbell Liberals reneged on their promise to give it university-level funding.

For six years, then, Cap’s board and administration have known they were running on fumes. They are in the same predicament as B.C. school boards, who must do the government’s dirty work and take the blame for program and teacher cuts.

In 40 years of teaching at Cap, I rarely attended board meetings, and never did a board member visit my classes. I don’t know the members of this current board, apart from a couple of faculty representatives, but I’ve served as a North Vancouver school trustee. As an education journalist I’ve talked to a lot of university and college administrators, not to mention school trustees. I know how they think.

Managing the decline

For any school or university board, underfunding creates a terrible predicament: protest too loudly and you’ll be replaced by a provincial hireling who’ll cut without regard for the school’s long-term survival. If you have any love for the institution, you can only try to do damage control. But when your teachers or professors protest, as they have every right to, that annoys and embarrasses the government. It will punish you for not imposing the “silence of the deans” on them.

University presidents and senior administrators make six-figure salaries and enjoy high prestige. They are supposed to be both scholars and managers. Their boards are supposed to be notable achievers as well, though their achievements have often been in the service of the governing party. Their education has served them well, and now they can serve education.

But a Darwinian selection process has made them servants of politics instead, detached from the true principles of education. When they realize that their job is not to serve education but to make the government look good, they panic. Everything they learned in school about critical thinking and reasoned argument vanishes.

In reward for previous achievements and political support, the B.C. government appointed Cap’s board members to run the school without giving them the money to run it well, or even adequately. And whatever their previous achievements, they have lacked the imagination and creativity — the education — to do anything but make matters worse. Faced with an angry faculty and a humiliating court judgment, they have drawn ridicule upon themselves and the university.

They can’t extricate themselves and they have no arguments left to offer — only the frantic banging of a gavel that can’t drown out the voice of an angry retired prof exercising his right to speak freely. [Tyee]

No disrespect, but… Politic for politic, as faculty and student activism over the last decade was generated in response to administrative measures taken to devalue academic budget lines and increase debt loads, administrators formed policies that shored up their powers to police campus speech and launch investigations. Following an introduction of a Respectful Environment policy in 2008, in anticipation of an upcoming political protest on campus in March 2009, the President of UBC circulated a “Respectful Debate” memo warning students and faculty to “pay special attention to the rules that govern our conduct” for speech. Legislation of respect entangles or snares the left and right in the same finely meshed dragnet attenuating civil liberties. This also recalibrates a network of surveillance media and technologies, challenging nearly all protections in the workplace. Some self-identified centrists or voices of reason welcome the new measures, adopting roles of third persons while reporting to administrators that loose lips sink scholar-ships.

In Canada and the US, these new respectful workplace policies, which anticipate or respond to workplace legislation and court decisions, mean that academic freedom and charter or constitutional rights noticeably contract at the campus gates. Watching postsecondary institution by institution adopt similar respectful workplace policies, the Executive Director of the Canadian Association of University Teachers (CAUT), issued a memorandum in late March 2009 advising vigilance: “the test of ‘disrespect’ identified in these policies is for the most part experiential and subjective – notions like ‘feelings of shame’ or ‘embarrassment’ crop up repeatedly.” He subsequently asserted, “a major problem in Canadian universities is not that too many people are asserting their academic freedom, but that too few are.”

Similar policies in the US are compounded by the Supreme Court’s 2006 Garcetti v. Ceballos opinion that “when public employees make statements pursuant to their official duties, the employees are not speaking as citizens for First Amendment purposes, and the Constitution does not insulate their communications from employer discipline,” reinforcing managerial discretion and prerogative. Although academic freedom remains a special concern of free speech rights and was deferred by the Court in Garcetti, legal analysts such as Harvey Gilmore concur that “Garcetti has now become the definitive statement on a public employer’s discretion in managing office operations, and that discretion includes controlling an employee’s speech made in the scope of the employee’s professional capacity.”

Following legislation in four other provinces, on 1 July 2012 new legislation in BC came into effect through an amendment of the mental disorder section of the Workers Compensation Act. The new amendment in Section 5.1 provides for potential compensation if the disorder

(i) is a reaction to one or more traumatic events arising out of and in the course of the worker’s employment, or
(ii) is predominantly caused by a significant work-related stressor, including bullying or harassment, or a cumulative series of significant work-related stressors, arising out of and in the course of the worker’s employment.

For legal preparation for this legislation now common across Canada, universities such as UBC folded a large scope of potential infractions into their respectful workplace policies. What stands as protection for disability or “mental disorder” and against “bullying or harassment” under the law is extended in higher education policy to common modes of academic speech—commentary and criticism—that might be articulated in the wrong tone.

Offices of Human Resources introducing or monitoring respectful workplace policies oversimplify speech by stressing, “it is not what you say but how you say it that counts.” Repeated in HR across higher education and curiously by some administrators, this folksy maxim come respectful workplace policy draws on centuries of etiquette texts. “Rather than seeing public talk occasions as needing politeness or civility, a better norm” Karen Tracy proposes, “is reasonable hostility.” She effectively hashes out parameters for democratic communicative practice and flips this “aphorism on its head, it is not merely how something is said, but what a person says that matters.”

Only certain types of face-attack are legitimate and desirable in local governance situations. ‘Reasonable hostility’ is the name for acts that are. Reasonable hostility involves person-directed attack; it is remarks that imply disrespectful, undesirable things about others. Targets of reasonable hostility will judge speakers uttering those remarks to be rude, disrespectful, unfair, and so on…. A speaker might be cognizant that his or her remarks may have this effect, but their purpose is to express outrage about a wrong.  The speaker sees self’s central aim as witnessing a truth or expressing righteous indignation.

Faculty and students are bookended by a reformalization of academic speech on one side and a normalization of administrative equivocation, deception included, on the other. Can voices of critique and voices of liberty speak together, with reasonable hostility, as a voice of truth? Can the left and right speak (together)?

Call this and this research, call it evaluative opinion, call the facts, facts. Perhaps cheer-fully, perhaps not, UBC campus waits for accountability over the Sauder rape cheer.

Thus far, President Toope’s Measures fail to effect any form of accountability at the top. For example, the last measure, “[Dean] Helsley announced that the Sauder School of Business will no longer support the CUS FROSH events,” is meaningless, if according to a.nony.mouse in the Ubyssey comments section, “the CUS is its own entity and operates separately from the administration, something that has also been made clear in all investigative documents to date.”

I guess it is plausible that former Dean Muzyka micro-managed the students for over a decade and once he left, the repressed returned and they went wild, so to speak. But I don’t buy this narrative.

Instead, I stand with Nathan in the Ubyssey comments, “there is some fault on the part of the administration.” There may be, as Harbinder says, a “culture of shallowness” and as I say a “culture of entitlement.” For the record, I’ve worked with excellent students and faculty from Sauder, but evidently something (or someone) is failing at the top.

The facts speak: In the fact-finding report, curiously, the words “administration” and “administrator” do not appear while “student/s” appears 46 times. There were no facts to find on administrators or administration?

If it is plausible that of the 11 Assistant and Associate Deans + Dean Helsley, none have responsibilities for “students” in their portfolio, then the President’s Office has failed. That’s a fact of administrative bloat: Between 1999 and 2013, this Faculty’s administrators at that level more than doubled. Yes, Sauder has Dean Muzyka to thank. And increasing tuition and fees have that to factor in. Yet none of these 12 now have any responsibilities for students? I don’t buy that. So is the buck or loonie passed back to the Sauder Dean’s Office?

Similarly, someone or something is failing at the top if of the 12 senior administrators none have curriculum in their portfolio. I find it incomprehensible that it has taken this cheer, a fact-finding report, campus outrage, and nearly 2014 for Sauder to finally get around to, announced on 1 November by Dean Helsley, “Implementing changes in the curriculum to enhance themes of social justice, ethics, gender and cultural sensitivity, and their role in corporate social responsibility and the creation of a civil society”?

A top business school finally getting around to this? In this economy and world? There are 12 senior administrators and none have curriculum and courses in their portfolio? What exactly are they doing? Not all can be running around consulting, like Bob Sutton, teaching CEOs how not to be assholes.

Publicly subsidized universities ought to fulfil three missions – teaching, research, and service to the community – as defined by their objectives and their mutual implication.

For signatories of the present manifesto these missions have the following objectives:

  • preserving knowledge as accumulated through history, producing new knowledge and passing on both old and new knowledge to as many students as possible along with the questions they have prompted;
  • training students in research methodologies, in critical analysis of the social consequences of scientific issues, practices and findings, in the development of free thinking, avoiding any form of dogma, with the common good as an objective as well as the acquisition of competence for a responsible professional activity;
  • contributing to the reflection of social systems on themselves, particularly on the kind of model they use for their own development.

Nowadays current modes of governance in universities run against the above definition of what a university ought to be. Their mantras are efficiency, profitability, competitiveness. Universities are invited to become the agents of maximum production in as little time as possible, to turn out scientists and professionals that are competitive, flexible and adapted to market demands – the improvement of humanity is then measured in terms of economic growth and technical breakthroughs, and the progress of universities in terms of ‘critical mass.’

Consequently, universities are subjected to more and more frequent international evaluations and audits that measure their respective productivity and contribute to their positions in various rankings.

Though they do not deny that university practices and their effects have to be assessed, the signatories note that current evaluations are based on narrow criteria, that are often formal and fashioned on standardized practices; that the competition they foster among universities leads to a race to publish, with the number of published papers sometimes prevailing on their interest; that procedures involve cumbersome red tape with recurrent reminders that the logic universities have to comply with is the logic of markets and globalization.

Beyond the minimum endowments granted to universities, the selection of research that can be financed is largely determined by calls for tenders and the size and reputation of the teams that apply. Such a situation distorts the purpose of university research, which ought to be open to projects carried by small, relatively unknown teams. Rather, it favours the submission of well presented projects rather than of projects that could further knowledge.

Subsidies granted to universities often depend on student populations. In the case of a closed envelope, this leads to ‘hunting for students,’ which in turn may entail a lesser quality teaching as well as the risk of doing away with important but small departments.

University teachers are expected to explain what profession-related forms of expertise they are to develop in students. While it is imperative to teach students the skills they will need in their professional activities, highlighting these skills might lead teachers to overly stress utilitarian and saleable knowledge at the expense of basic sciences and of reflexive and critical knowledge.

The involvement of university staff in domestic management and representation is more and more numerous and encroaches on services to society at large.

The above mentioned elements contribute to increase the strain to which university staff are subjected and may possibly destroy the ideals of once passionate teachers and researchers.

To support their vision of the university, the signatories of the present manifesto call for the following measures:

  • making sure that university research is allowed the kind of freedom that is necessary to any finding, the right to waver and the right to fail;
  • reaching a correct balance between critical and operational knowledge and between general and profession-related skills in the various study courses offered by the universities;
  • promoting services to society;
  • reining in the production of red-tape, the rat-race and other stress factors that prevent university staff from carrying out their duties properly;
  • assessing university practices and their consequences in view of the specific objectives of universities and not of market expectations.

To meet these requirements they consider that it is necessary:

  • to assert the objectives of the university as defined above;
  • to provide global subsidies for higher education;
  • to use criteria for awarding public money that promote diversity in research and that preserve the quality and plurality of study courses on offer.

They call upon:

Public authorities and academic bodies to recognize that universities ought to try and achieve objectives that are in tune with their identity and social function, and provide the means thereof;

University staff to oppose measures and practices that go against the positions defined in this manifesto; to promote an in-depth analysis of the growing unease among university staff, of its causes and of possible solutions; to participate in concrete actions – to be decided on depending on contexts – to put forward their positions and proposals wherever necessary; to support movements and actions outside the university that aim at the common good.

Net Zero Workers

There is a long history of wage freezes for workers that amount to wage cuts against rapidly rising costs of living.  There was a time when governments were interested in supporting unions defending wages as a base for fair compensation for the work and a wage increase to maintain a decent standard of living against rising costs.  In bad times, unions and employers could give and in depressions the unemployed ranks grow, families collapse, and businesses fold.  Currently, governments are finessing to have it both ways.  A psychology of governing parties is to assure consumers and investors that the economy is always looking up while convincing workers that the coffers are empty and the economy is recessing.  While Athens burns business analysts comment daily that the markets are gaining lost ground.  ‘Economic growth is on the horizon while we are pressed to freeze wages and put our fiscal house in order.’  Mixed messages for the consumer as worker, now the net zero worker.

“Net zero,” newspeak for wage freeze, was introduced as a mantra in about 2002 and repeated by the Public Sector Employers’ Council (PSEC) in British Columbia from 2008 to this current point.  In 2010 the “net zero mandate” was reinforced in BC government or PSEC policy.  Public sector workers were again net zero workers.  The BCTF rallied hard against this and are standing up again to pool together all unions, as the governing party in BC again designated teachers as net zero workers.  Let them bargain, let them mediate, Minister of Education George Abbott insisted in legislative debate on 12 March, as long as “all of that is within the context of net zero.”

Thirty years ago, top executive salaries were about 15 times that of the average worker’s.  Now, those executive salaries are 75 times that of the worker’s.  It’s increasingly difficult to accept one’s fate as a net zero worker in the face of skyrocketing executive salaries and lawless mismanagement.  Of course, things might change should the net zero worker threaten to become a net zero consumer.  Net zero spending was once called a boycott.

Apart from the patently nonreality-based dissent of its Republican members, the Financial Crisis Inquiry Commission could hardly have expected the report it issued in January to arouse much excitement. After a year and a half of research and the testimony of academics and other economic experts, it came up with no more than the already conventional wisdom that the economic downturn that burst into public view in 2007 might have been avoided, having been caused by a combination of lax governmental regulation and excessive risk-taking by lenders and borrowers, particularly in the housing market. The same conventional wisdom assures us that swift government action prevented the Great Recession from turning into a full-blown depression, and that the downturn has given way to recovery, albeit a “fragile” one. No matter how often it is repeated, however, this wisdom remains unconvincing.

In 2006 the U.S. Supreme Court decided in Garcetti et al. v. Ceballos that public employees’ statements about official responsibilities and administrative policy are not shielded from disciplinary action by employers. District courts have since begun applying that decision to faculty members, hence putting faculty participation in college and university governance at great risk. In November the American Association of University Professors launched its campaign to alert faculty members and administrators to the growing danger that those federal-court decisions are undermining First Amendment protections for public-university faculty members speaking out about campus governance. Our staff members designed a striking campaign logo, set up talking points on our Web site, and added video interviews with AAUP personnel and leaders. The organization had never done anything comparable before. Of course we also distributed the detailed scholarly report by the AAUP’s Committee on Academic Freedom and Tenure (Committee A). But translating that report into an agenda for local campuses required rethinking how we present ourselves.

Almost 150 years ago, in an effort to better serve a growing nation, President Abraham Lincoln signed the Morrill Land Grant Act, which gave struggling states federal land with which they could generate revenue to build colleges. The result of that bold action is a national resource: a structure for higher education that is admired, and copied, around the globe in places such as Japan, Germany and Canada. We are the only country to have both private and public universities of world renown. Sadly, this amalgam of great public and private research and teaching universities is at risk as economically struggling states progressively disinvest in public higher education.
