FACULTY MEMBERS AT SOUTH ASIAN UNIVERSITY SUSPENDED FOR SUPPORTING STUDENT RIGHTS

Four faculty members at South Asian University (New Delhi, India)  have been suspended pending investigation for asking the university not to call police inside the campus while student protests were going on and to resolve matters amicably.

Faculty also asked administration to withdraw punishment meted to students because due process of rules and regulations were not followed.  Ravi Kumar, one of the suspended professors said, “This is unprecedented in the academic history where four faculty members have been suspended for suggesting measures in a constructive spirit.”

Brief chronology of incidents at South Asian University (SAU), New Delhi

  1. On October 14, 2022, faculty members wrote to the university administration against the act of calling police into the campus to disperse protesting students and to resolve internal issues.
  1. On November 4, 2022, the university administration issued office orders announcing expulsion, rustication or suspension of 5 students. On November 5, 2022, several faculty members wrote an email to the university community expressing their deep concern regarding these arbitrary actions of the university administration that were taken without following any due process and in gross violation of rules, regulations, and bye-laws, and were in contravention of principles of natural justice.
  1. Students began a mass indefinite hunger strike from November 7, 2022. Quite a few students had to be admitted to hospital on emergency basis to revive their physical condition. One of the five students who were expelled/rusticated/suspended, Ammar Ahmad (MA Sociology, Ist semester), collapsed on the night of November 22, 2022 and had to be admitted to the Intensive Care Unit (ICU) of a hospital. Till date Ammar’s speech remains severely affected, he cannot walk on his own, and remains fully dependent on care-givers for his daily functioning.
  1. On December 30, 2022, five faculty members received notices from the university administration asking them to respond to several charges, including: writing letters to the university community regarding certain administrative decisions in relation to the student protests (as noted above in points 1 and 2 above). The faculty members include: Dr. Snehashish Bhattacharya (Faculty of Economics), Dr. Srinivas Burra (Faculty of Legal Studies), Irfanullah Farooqi (Department of Sociology, Faculty of Social Sciences), and Dr. Ravi Kumar (Department of Sociology, Faculty of Social Sciences). These faculty members individually responded to the notice on January 16, 2023.
  1. The four faculty members were called to appear before a Fact Finding Committee (FFC) on Friday, May 19, 2023 for an interaction. During the interaction, the faculty members were asked to provide answers to between 132 and 246 questions in writing by the end of the working day, using pen and paper and sitting in front of the committee members. They were told that their responses might be used as evidence to decide on further proceedings against them. The questions included fresh (though unsubstantiated) allegations and accusations that were not part of the communication from the administration dated December 30, 2022, or the responses submitted on January 16, 2023.
  1. The four faculty members submitted a written request to the committee to send the questions electronically and to provide more time too. They also wrote to the Acting President on May 25, 2023, regarding this issue and seeking appointment. However, they have not heard back from the committee or from the Acting President yet in this regard.
  1. On June 16, 2023, office orders were issued placing the four faculty members under suspension with immediate effect, stating that “there are allegations of misconduct” and violation of the code of conduct of the University, “which need to be investigated.” The faculty members have been directed not to leave station without permission, vacate their offices, return their office computers and identity cards, and register their attendance on all working days in the offices of their respective deans.
  1. The faculty members responded to the Acting President in writing on June 19, 2023, terming the actions patently illegal as they have been taken in contravention of the rules and regulations of the university. They have called upon him to withdraw the orders at the earliest.

Action requested

The suspension of the faculty members should be revoked as it is a violation of the university rules, regulations and byelaws. The faculty members have been only requesting that the university to resolve matters within university and amicably.

JNUTA Statement on arbitrary suspension of four faculty at South Asian University

The JNUTA strongly condemns the arbitrary suspension of four faculty by the South Asian University administration. The JNUTA sees this act as unacceptable, unjust, and an attempt to intimidate and spread fear among the teaching community.

The suspension notice issued to the faculty by the SAU administration on 16.06.2023 came after a spate of humiliation of the four faculty members by the Fact Finding Committee that on May 19, 2023, asked them to provide handwritten answers to over a hundred questions sitting in front of the committee members. The faculty raised objections to this process and wrote to the FFC and the SAU administration, but they received no reply. On the contrary, they were served with suspension orders that justified it by accusing the faculty of ‘inciting and leading students and outsiders’, and ‘anti-social acts’, among other things; without following due process of investigation. This illegal and unacceptable suspension notice has directed them not to leave the station without permission, vacate their offices, return their office computers and identity cards, and register their attendance on all working days in the offices of their respective deans.

The JNUTA strongly condemns this unprecedented harassment, coercion, and intimidation of the SAU faculty by the administration. There are several news reports that the University served notices and expelled/suspended/rusticated several students protesting against the reduction of monthly stipends without following the due process. Several faculty in SAU have also raised their concerns regarding the arbitrary actions of the university administration against the students. These notices of expulsion and rustication have put the students under tremendous stress, both mentally and physically.

The suspension order served to four faculty members by the SAU administration is an attempt to intimidate and silence the faculty and the students who raise their voice against the arbitrary and authoritarian actions of the administration. The JNUTA stands in complete solidarity with the faculty of SAU in defending their rights to speak truth to power. It also stands in support of the students of the SAU who have been protesting against the gross act of injustice of the SAU administration. The JNUTA demands that the suspension orders of SAU faculty and rustication/expulsion order of SAU students be immediately revoked and the administration start a dialogue to discuss the demands for an agreeable resolution at the earliest.

Subject: Suspension of four faculty members at South Asian University, an extension of the continuing attacks on institutions of higher learning.

Janhastakshep unequivocally condemns the suspension of four faculty members – Dr Snehashish Bhattacharya (Faculty of Economics), Dr Srinivas Burra (Faculty of Legal Studies), Dr Irfanullah Farooqi (Department of Sociology) and Dr Ravi Kumar, also of the department of Sociology, at New Delhi’s South Asian University by the university administration and demands unconditional revocation of the suspension orders of all suspended faculty members with immediate effect.

The events leading up to the suspension, the manner of suspension and the subsequent conduct of the ‘Fact Finding Committee’ constituted by the university to conduct a sort of inquiry against the suspended faculty members reek of utterly cavalier attitude calculated to please the powers that be in the political circumstances obtaining in the country as of date.

The present suspension of faculty members is rooted in the events related to the agitation by the university’s students in November last on their legitimate democratic demands impacting on their immediate wellbeing. That agitation was handled with a heavy hand by the university authorities resulting in rustication and expulsion of the students. It led to serious consequences to the health of one student Ammar Ahmad and later to another Phd scholar Apoorva in the Faculty of Legal Studies.

The suspended faculty members were first handed notices on 30 December 2022 on charges such as – writing letters to university community questioning certain administrative decisions in relation to the student protests; instigating students to protest and association with a “Marxist” study circle among other allegations. In levelling these charges against the faculty, those sitting in top administrative positions at the University have exhibited regrettable lack of comprehension of a university’s function, the nature of the learning / teaching process and the responsibilities of the students, teachers and administration at institutions of higher learning towards each other.

No education, let alone new knowledge generation can be transacted if the students are not supported by their teachers and the administration in availing of amenities, including financial support, that facilitate their endeavors in this direction. A teacher and more so the administration shall be failing in their duty if such support and understanding were to be substituted with a ‘coercive disciplinary’ approach which unfortunately has been the dominant trend forced upon all manner of publicly funded institutions of higher learning in the country in last 9 years. It is nothing but a poor parody that the suspended faculty members have been accused of associating / encouraging a ‘Marxist Study Circle’ in a university space that is supposed to lend itself to a free contestation of ideas. This certainly sits at odds with the eulogy of ‘Indian Democracy’ proffered by Prime Minister Narendra Modi in Washington D C.

Even as Janhastakshep calls upon the different bodies of academicians and intellectuals at large to support the faculty and students of SAU in this hour of need, we also appeal that this suspension of faculty members should be seen as part of the larger thrust by the Modi led government to further curb the space for ideas which militate for Democratization of society, challenge authoritarianism, uphold economic and social justice. These suspensions are part of the efforts to terrorize and stultify the intelligentsia into submission.

Apart from revoking the suspension of the faculty members and continuing rustication of the students, the bunch of ‘Actors’ (Acting President, Acting Vice-President and Acting Registrar) complicit in ‘over-acting’, who are presently ruling the roost at SAU should be replaced with academics of repute and integrity capable of steering the university towards achieving its cherished goals.

Here’s a summary of the article: UBC faculty, staff, and students commonly question senior managers’ assertions that “diversity is our strength.” If, counter to the cliche, diversity is not our strength, then what is it? This type of assertion may play well for a political audience but with insider knowledge, the reality is quite different. Insider knowledge is an effective antidote to confusions of audience and duplicitous speech. With this in mind, we analyzed UBC managers’ messaging and optics in matters of anti-Black racism. In conclusion, we don’t buy it and provide dozens of examples of where the rhetoric falls short of reality. We suggest that without action and real results, the optics seem insincere. Hence, senior managers are complicit in anti-Black racism at UBC.

Here’s the argument: What Robyn Maynard (2017) infers from history education practices in Canada sums up the case of UBC: “a discernable lack of awareness surrounding the widespread anti-Blackness that continues to hide in plain sight, obscured behind a nominal commitment to liberalism, multiculturalism and equality” (p. 30). Hence, in this case of UBC, we provide various examples of how the institution functions through racial bias and prejudice but argue that leaving the explanation to structural or systemic racism makes it too easy to deny elite individual and everyday racism, especially racist attitudes and decisions of the managers and their means of employment discrimination (i.e., blocking and undermining racial minorities’ access to career advancement and opportunities).

Here’s the conclusion: Anti-Black racism in higher education requires specific attention to history and action, whether affirmative or equitable. We argued that elite racism and everyday racism experienced by African ethnic and diasporic faculty, staff, and students and made visible through demographic data can no longer be dismissed or overlooked. Through the case of UBC, we demonstrated various ways in which the higher racism of managers works to maintain individual and systemic discrimination. Preferences of managers for image and optics over action— surface over substance— is especially shallow in this era of Black Lives Matter. We also raised questions of the logic of popular shortcuts to intersectionality (e.g., IBPOC) and stand with scholars explaining that therein, equity claims of African ethnic and diasporic faculty, staff, and students are readily deprioritized or marginalized. Code-switching has its limits. At UBC is an established record of defending middle and senior managers’ inequitable, and often enough for concern, racist, practices. Cases introduced by racial equity seeking individuals are routinely deferred, dismissed, or misdirected to external agencies, where again senior managers agitate to request dismissal of the complaints. Finally, we articulated concerns that managers are preferring to isolate and shield themselves from critical conversation and critique. Critics of problematic and racist practices risk disciplinary measures as managers grow increasingly intolerant of commentaries on mismanagement and whistleblowing.

#UBC Dean Search shut down and Advisory Committee dissolved

Responding to a Petition and attached Letter (below) questioning the decision to exclude an extremely competitive African Canadian applicant from the shortlist in the search for a new Dean of Education at UBC, President Ono shut down the search and dissolved the Advisory Committee. The UBC President also indicated that Provost and Committee co-Chair Ananya Mukherjee Reed resigned from the Committee, seemingly in support of the conclusions and questions raised by the Petition and its 150 signatories.

On 9 December 2020, the UBC President wrote to faculty, staff, and students:

Yesterday, I received Prof. Ananya Mukherjee Reed’s resignation as co-chair from the President’s Advisory Committee for the Recruitment of a Dean for the Faculty of Education. This is effective immediately. I met with the PAC Committee yesterday and heard from members regarding the viability of the search moving forward, and they felt that the search could not proceed. After careful consideration and consultation with the Committee, I have decided to end the current search for a new Dean at this time.

Of course, it is extremely rare for a Dean search to be cancelled in response to grass roots efforts. It is certainly a step in the right direction of accountability. A next step is answering the various questions raised about this Advisory Committee: Why did they do what they did? In the midst of Black Lives Matter, why did they exclude a competitive African Canadian applicant?

This Letter and attached Petition are in response to the President’s Advisory Committee for the Selection of the next Dean of the Faculty of Education’s decision to exclude Dr. Samson Nashon from its shortlist. I write on behalf of the 150 faculty, students, staff, alumni, emeriti, and community members who signed this Petition to add Dr. Nashon to the shortlist. The Petition identifies flawed procedures underwriting the President’s Advisory Committee’s decision. For example, the Committee excluded African Canadian faculty, staff, and students

The University of British Columbia’s Strategic Plan, Shaping UBC’s Next Century, emphasizes “our intention to be a leader in diversity and equity” (Strategy 1: Great People, p. 41). Leadership in diversity and equity entails fighting against racism at all levels of administration, research, service, and teaching.

The 150 signatories to this Petition expect action to back up the commitments. We hope that you will address our collective concerns, convey them to the President’s Advisory Committee, and consider what can be done to redress the problem and rectify the injustice. This raises a serious procedural question of how a Committee that excluded Dr. Nashon from the shortlist can now fairly include and consider his candidacy?

The Petition with signatories is attached. On behalf of this groundswell of support for Dr. Nashon’s candidacy, thank you very much for addressing our concerns and request.

The account and evidence of how, when, where, and why Professor Wylie (Peter) was mobbed by UBC administrators are disturbing. It’s a travesty that he had to endure this mobbing. Faculty are tremendously grateful that he brought the facts out for an airing and hearing.

My Campus Administration, Faculty Association, Senate, and Me: A Case Study in Academic Mobbing

This in the author’s view is a clear case of academic mobbing. The case fits perfectly with what is argued that almost all scholars who study academic mobbing agree is its primary characteristics; it is initiated by administrators whose malfeasance was questioned or revealed though the expression of academic free speech; the target tend to be tenured professors who publicly speak out about administrative wrongdoing; it involves manipulation or misrepresentation of the facts regarding the victim’s motivations or behavior; the target’s colleagues are either poisoned against him or her, or choose not to support the victim due indifference, or a lack of conviction, and the target is left personally and professionally injured, while the perpetrator(s) goes unpunished (MacDonald et al., 2018, para. 12). To this the author would add that the kangaroo court investigation procedures of the university are merely an extension of the academic mobbing process. (pp. 206-207)

*Apologies to the medievalists once again. Customized below is our semi-annual appeal to UBC managers to Lay Down the Mace:

As we count down to and roll through graduation, can we please remove the mace from convocation and governance at the University of British Columbia? The mace may have had its day in the first 100 years of this esteemed University but that day has gone.

The “ceremonial mace used at convocation ceremonies is out of step with contemporary values.” Dalhousie University now uses what it designed and calls the New Dawn Staff instead of a mace.

Indigenous peoples and advocates have said plenty about this already but the managers, well…

Currently, for instance, #UBC managers gleefully delight in the gravity and weight of their mace, entirely remiss that in addition to blunt power and violence, UBC’s mace signifies greed– the chainsaw and excavator– real estate development— digging for gold– as the University feverishly exploits its Endowment Lands (esp. Areas A, B, & D). Some traditions just aren’t worth maintaining…

Remember this bedlam in December, when a lawmaker grabbed the mace in Britain’s House of Commons? “When he hoisted it up, a clamor erupted: “Disgrace,” “Expel him,” “No!”

Oh, and at the Nexo Knights’ Graduation Day,

Jestro grabbed a sword, a mace, and a spear and began to juggle them… The unimpressed crowd started to boo… Sweat broke out on his forehead…. He let go of the mace, and it flew across the arena. The crowd gasped and ducked… Then … bam! It hit the power grid on the arena wall. The area lights flickered, then turned off. Soon the power outage surged throughout the city.

Meanwhile again in England, Bradford College faculty members called the admin’s decision to spend £24,000 on a new mace for graduation ceremonies a “crass bit of judgement.”

The days of the mace in Convocation and governance are of the past and that part of the past is no longer worth reenacting.

It’s difficult to know where this University now stands or what it stands for.

It is time to retire the mace, symbol of aggression, authority, and war. It’s time to march to graduation ceremonies in late May and November with open and empty hands as symbolic of peace and reconciliation of controversies and roles of the President’s Office.

UBC’s mace is a relic but a relic of what? The mace is symbolic speech but what is it saying about us now?

From ancient times, this club, this weapon of assault and offence, the mace was gradually adorned until the late twelfth century when it doubled as a symbol of civil office. Queen Elizabeth I granted her royal mace to Oxford in 1589. From military and civil power derives academic authority. The rest is history and it is not all good.

It is time to retire the macebearer, whose importance is inflated every year by the image’s presence on UBC’s graduation pages leading to Convocation. In pragmatic terms, if the mace falls into the hands of the wrong macebearer or manager at this point, someone’s liable to get clocked with it.

Is UBC’s mace still a respectable appendage to Convocation?

Remember, since that fateful November day in 1997, just five months into Martha Piper’s Presidency, when student activists put their bodies and minds on the line at the APEC protest, Tuum Est adorns both the can of mace sprayed in their eyes and the ceremonial mace that the President’s Office is eager to carry across campus every November and May.

The pomp of graduation, a time of calm reflection as students’ rite of passage is conferred under the mesmerizing pronouncements of the convocation speaker. And at UBC, a time to hear administrators chant tuum est, it is yours!

Reality check.

Increasingly, UBC administrators are confidently asserting meum est, it is mine!

The latest sign of meum est is the quickening process to reappoint UBC’s Chancellor Lindsay Gordon despite serious problems and reservations, such as those articulated in the 24 April Open Letter to the UBC Chancellor Reappointment Committee (signed by 110 faculty members).

The phenomenon of meum est across a variety of campuses was detailed in The Fall of the Faculty: The Rise of the All-Administrative University and Why It Matters.

I manage UBC, therefore, meum est, it is mine.

#UBC Committee of Deans making decisions, covering tracks #ubcnews #ubc100 #bced #highered

Since the announcement of University of British Columbia President Arvind Gupta’s resignation on 7 August 2015 and subsequent disclosure and leak of records on 25 January 2016 via Freedom of Information requests, one of the most pressing questions has been the role or seeming conspiracy of Deans. Upon public circulation of the records, on 9 February the Deans quickly circled the wagons in defence, ostensibly a sign of patronage.

The records still in question involve a series of meetings and exchanges between Gupta and the Deans beginning around 1 May and extending through June 2015, e.g.:

Hi John [Montalbano, Chair of the BoG], Things seem to be going well with the Deans now (or at least I think so). Thanks again for coming over today and hope you weren’t too late in [redacted]. Talk soon. (Gupta)

What exactly happened wherein the President hesitates in resolving that “things seem to be going well with the Deans”? What was going on wherein problems escalated and the Deans apparently made an offensive to play a role in seeing through the President’s resignation or ousting him?

Perhaps the meetings and exchanges of the Committee of Deans would provide insight.

At UBC, there are two decanal governing bodies: UBC-V’s Committee of Deans and UBC-O’s Deans’ Council. Concern here is with the Committee of Deans’ records.

A Freedom of Information request was made on 8 February 2016 for disclosure of records of the Committee of Deans, which meets twice per month for 2 hours each meeting.

Lo and behold, it turns out that this decision-making and governing body does not keep any records and claims it has no obligation or intention to do so. Upon a series of requests over the last four months, Access and Privacy in UBC’s Office of the University Counsel shockingly confirmed:

There is no UBC record-keeping mandate for these committees [of Deans]. Therefore the records kept are at the discretion of the Provost offices. In terms of UBCV material – no minutes are taken at the Deans meetings, therefore no minutes exist to provide to you. UBCV 2016 agendas were included [or reconstructed] in the records released to you.

There were no 2015 records in the disclosure

So, this decision-making body– all the Deans and the Provost, etc.– meets twice per month for 2 hours each and keeps no records. The Committee of Deans met multiple times with President Gupta and prepared or kept no records. Nada. Nothing.

On 28 January 2016, the Faculty Association levelled an extensive critique of senior management and governance of UBC for shoddy record-keeping or lack thereof.

Guaranteed, there is something to hide. Too much, in fact.

Wary of corruption, cronyism, and patronage, on 22 October 2015, the Information and Privacy Commissioner for BC released a scathing report of the practice of withdrawing decision-making to shadow systems.

Similarly in 2004, the Federal Information Commissioner expressed concerns that civil servants, lawyers and managers in public institutions in Canada were managing “to find ingenious ways to wiggle and squirm to avoid the full operation of the law.” Reflecting what we see nowadays at UBC, the Commissioner observed that the

Access to Information Act was supposed to get government documents into the hands of Canadians. Instead, it has created a state in which there are often no documents to get… The attitude has truly become,”‘Why write it when you can speak it? Why speak it when you can nod? Why nod when you can wink?'”

UBC hired a new President and we are wont to look forward. UBC set a new precedent and we are now bound to look backward.

Left with no confidence in the Board of Governors (see chronology) and now no confidence in the Committee of Deans, things are much worse than we thought at UBC.

ABSTRACT: This case study recounts my harrowing experience through a great Canadian equity swindle—involving two internal university equity investigations, BC Human Rights Tribunal, and the BC Supreme Court—to bring to account a deeply flawed and allegedly discriminatory academic hiring process. BCHRT’s decision on 24 January 2012 to hear the Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case (21 December 2010 HRT decision24 January 2012 HRT decision) was moved to the Supreme Court for a judicial review (see The Ubyssey’s [UBC student newspaper] feature article for the backstory to the case). The Supreme Court then ordered the BCHRT to review its initial decision (29 May 2013 BC Supreme Court judgment). The BCHRT turned and dismissed the case on 19 December 2013.

*Note: Exactly what was “recalibrated” through the “Review” is unclear. Comparatively, when advertised in 2005 and 2009, the Name of the Chair was the “David Lam Chair in Multicultural Education.” The April 2016 Ad or CFA still indicates the same. So the Chair title was not recalibrated. In 2005 and 2009, the search sought scholars who contributed to multicultural education and now in 2016 the search seeks scholars who contributed to multicultural education and “social justice studies” so that was not recalibrated. One could readily argue that multicultural justice and social justice are interchangeable. In 2005 and 2009 multicultural education was not defined but in 2016 a definition of multicultural education is given: “commitment to anti-oppression, anti-racism, intersectionality, and decolonization.” But that does not appear to be a recalibration inasmuch as it just gives a definition.

If there is anything learned at the University of British Columbia since the announcement of President Gupta’s resignation on 7 August 2015, it is that patronage is the institution’s greatest threat to reversing its spiraling downfall.

Of course we hear a lot these days about the gated communities in Vancouver and Kelowna where the 1% enjoy their luxuries without annoying distractions and questions from the 99%. Chip Wilson’s gated and walled $64m waterfront home makes the old Casa Mia on Marine Drive look like a quaint tiny house. And if trends have their way at UBC, Chip, valued at $2.2b, will soon run the Board of Governors (i.e., Lululemon U), following Stuart Belkin, valued at a comparatively mere $900m with a modest hobby farm in Southlands.

In the midst of its administrative and legitimacy crises, on 25 November Belkin was appointed Chair of UBC’s BoG. In 1938, Stuart’s father, Morris, led students on a protest against the BoG’s proposal to increase fees by $25. At his first meeting as Chair on 15 February 2016, Stuart presided over the approval of huge tuition increases across the University, no questions asked. Morris, the consummate contributor to student media, saved The Ubyssey by buying the printing house, which eventually became College Printers and core to Belkin’s packaging corporation. Stuart has an aversion to the media.

Following Morris’s death in 1987, the family donated to UBC $1m+ and by 1992 established itself as an art patron with a $1.5m endowment as ground was broken for the Morris and Helen Belkin Art Gallery on campus (opened 17 June 1995). Stuart commands UBC’s BoG in the midst of sieges on privilege and patronage.

Philanthropic patronage is common at UBC but it’s the managerial form that is perhaps much more entrenched and dangerous at this point.

In Moral Mazes: The World of Corporate Managers, Jackall explains that patronage reduces to “alliances that give one ‘clout’”

by the systematic collection of information damaging to others and particularly about deals struck and favors won in order to argue more effectively the propriety and legitimacy of one’s own claims; and, on the part of those in power, by pervasive secrecy, called confidentiality, that attempts to cordon off the knowledge of deals already made lest the demands on the system escalate unduly. (pp. 197-198)

Drawn from frontier tactics of circling the wagons, the practice of protecting managers at all cost for favours and perks, or patronage, has generated a crisis at UBC. Indicative of this crisis of patronage was the deans’ endorsement of the BoG and Central senior managers on 9 February 2016.

Rarely at UBC is administrative patronage, characterized by this process of encircling and turning inward, exposed in such a raw, visible form, as if under siege by faculty, staff, and students.

The deans, along with vice, assistant, and associate appointees, owe their capital, in large, to a system of patronage that keeps gates and walls to protect privilege. Gated management, suppressing and distrusting shared governance, relies extensively on patronage.

Acting as if through Gupta’s resignation ‘to the victors go the spoils’, the deans are gambling that circling the wagons around the BoG and Central, however much it exposes patronage, delivers payoffs come reappointment time and invariable sieges on gates and gatekeepers within their own Faculties.

Patronage delivers payoffs at UBC, as Central looks the other way when accountability is due. For example, Central has been unwilling to find either fact or fault with administrators perennially running up deficits, suppressing academic freedom, mismanaging academic portfolios, playing favouritism, breaching privacy, biasing student votes, bloating admin ranks and offices, etc.

The fact that no one—not a single administrator– has been held accountable, canned, denied reappointment, or moved back to faculty ranks, etc. in the midst of the University’s most serious administrative crisis in fifty years is increasingly suspicious.

Yet this nagging suspicion of the BoG and Central, “perceptions of pervasive mediocrity” (Jackall, p. 197), and faculty members’ current No Confidence vote call the entire system of gated management and patronage at UBC into question.

Faculty members at the University of British Columbia overwhelmingly approved a motion of no confidence in the Board of Governors. This is unprecedented at the University and demonstrates the ineffectiveness of this governing body.

For seven months, the University and its Board have been entirely unaccountable to faulty, staff, and students. On 7 August, the University announced the resignation of President Arvind Gupta and immediately began a process of sweeping evidence under the rug by shielding records in non-disclosure agreements.

On 27 January, through records embedded in a FoI release, UBC disclosed that members of the Board of Governors were colluding in shadow systems of governance.

For faculty members, the unaccountability and disclosure of shadow governance combined to a no confidence vote.

The Faculty Association will now take next steps in acting on the vote.

In an era not too long ago, deans were able to assert their authority on most matters of governance, finance, management, and planning. Now, with credibility and legitimacy eroding, with shadow systems opening to scrutiny, can mere assertion of authority and excellence continue to pass for reality or truth at UBC?

So what part of the “Deans support UBC leadership” Op-Ed is believable or persuasive? Can the Deans support their “strongest” assertion?

We want to make clear in the strongest possible terms that we are absolutely committed to the pursuit of academic excellence and have consistently supported initiatives to promote such excellence.

Let’s test this assertion of commitment “to the pursuit of academic excellence” with a graduate program on campus:

  1. A graduate diploma mill, which in 13.5 years graduated 680 masters students but did not hire a single FT faculty member. Yes, 680 masters students and 0 FT faculty hired in 13.5 years.
  2. Instead is an exploitation Sessional labour—85% of all the courses—to teach at a piecemeal per student wage while their benefits start and stop at the term’s beginning and end. Staff members are hired to teach, who then double-up on their M&P jobs and displace the Sessionals from additional course assignments. The Sessionals are denied office space or worse:
    1. Per the policy and requirements of space usage in [the academic building] for Sessional instructors, the [123] temporary office space, must be cleared of all personal belongings, borrowed library items and additional furniture installed.
    2. If, by Dec 1, 2015, the space is not restored to its original condition, items will be disposed of, and you shall be invoiced for the cost of clearing and removal.
    3. As requested, I attach the photos of the room in its original condition, taken prior to it being temporarily assigned to you in February 2015.”
  3. It took 8 years of agitation across two Faculties to complete a single Self-Study and Program Review. There are 7 administrators overseeing this Program but not a one could initiate a Review. Effectively, when it finally did happen, well, let’s just say that an expectation of arm’s length Reviewers was mocked.
  4. Did I mention that this was a revenue generating program and maybe there is something to shield from scrutiny? When in April 2015 the Associate-Provost reviewed the Office (yes, Office) that runs and manages the Program, he reported:
    1. “Shadow systems are used more than University systems which is concerning because the data in the shadow systems are not verifiable, and because of the opportunity for misuse of funds.”
  5. In the last four years, this program generated about $5.4m in total revenue but we cannot account for expenses or overhead “because the data in the shadow systems are not verifiable.”
  6. Where does the money go then?
  7. Is it just thrown at the deficit that’s run up elsewhere year after year?
  8. But still, where does the money go? Is it just paying for administrative bloat?
  9. Did I mention 680 masters student graduates and 0 FT faculty in 13.5 years?

If this is “academic excellence” we’d hate to see academic mediocrity or compromise…

Moira Warburton, The Ubyssey, February 9, 2016– A rainbow flag, raised on the pole outside the old SUB for the Pride Collective at UBC’s OUTweek this week, was discovered to have been burnt down earlier today in what is presumed to be a violent act of hate.

Pride Collective members noticed that the flag was missing this morning and contacted the UBC Equity and Inclusion Office to ask if they knew anything about the disappearance. Upon investigation, the office found remnants of the scorched flag still attached to the pole.

“It’s been a rough day,” said Rachel Garrett, one of the coordinators of the Pride Collective. “[There’s been] a lot of stress. I don’t think any of us feel safe right now and that’s a really hard feeling to be going through.”

OUTweek is an annual eight-day event, organized by the Pride Collective, which celebrates “queer and trans identities, communities and learning,” according to its Facebook page.

Although OUTweek will not be completely cancelled, the Pride Collective has cancelled a Fuck the Cis-tem March due to take place tomorrow in response to the event because of concerns that it would give public recognition to individuals who could then potentially be targeted by further acts of hate.

With UBC’s crisis of administration and legitimacy growing worse, the Faculty Association has re-issued its call for an external review of the Board of Governors and its operations. Clearly, there are failures of governance and shadow systems of decision-making from the ranks of middle management to the top of the Board. The FAUBC announced today:

As the collective voice of faculty, charged with representing faculty interests and perspectives relevant to unfolding events at UBC, the Faculty Association, through its Executive, feels compelled at this time to raise a number of serious concerns. It has become clear that the University of British Columbia is in the midst of a governance crisis.

The events of the past year or so, as information about them slowly leaks out, demonstrate a failure of governance that threatens the integrity and credibility of the University. This is a singular moment in the 100-year history of UBC, the solution to which requires strong actions on the part of the Board of Governors.

We have called publicly for an external review of the Board and its operations. At this point, we re-issue this call. Such a review is essential to restore public trust in the Board. To accomplish this, the leadership for such a review must have the support of the University community – of faculty, students, staff, and alumni….

Some current members of the Board, including the Chancellor of UBC, have been shown in recent, now public, documents to have been involved in activities around the resignation of Dr. Gupta that appear to contravene standard and expected Board practices. Improper conduct of Board business is a serious matter. The former Chair of the Board, John Montalbano, has resigned. What onus of response falls on these other Board members, given these revelations?

The UBC Alma Mater Society also publicly called for a review. The AMS urges the Board to enact the following changes:

  1. That the incoming Chair of the Board of Governors instigate an external review process into governance practices;
  2. That the Board of Governors delay approving any candidate proposed by the Presidential Search Committee until such time as the suggested external review is complete and incorporated.

We’re fed up with the the backroom politics that are pervasive enough to move a new President out of office with no review, rhyme nor reason.

After a rally in front of the Alumni building, the protest proceeded upstairs to the door of the Board meeting. The disruption was direct and effective, with a subset marching into the meeting. Chants of ‘hey hey, ho ho, the BoG has got to go’ roaring outside the door and the Board’s discomfort inside. Shockingly, the Board allotted time for a colleague to speak out at the mic!

The management and legitimacy crisis at the University of British Columbia is growing worse. Putting out fires from crisis to crisis, the University’s public relations has been a disaster from day one.

Following the release of Freedom of Information records, replete with embedded files– smoking guns– UBC has had little to no comment. The first comment was “UBC will not be commenting.” No comment… from the VP External Relations and University Counsel.

The second comment elaborated on a technicality: “it is necessary to take the additional step of “sanitizing” the [FoI] PDF file to remove the hidden copies of the unredacted attachments.

“UBC deeply regrets the error that led to this privacy breach,” University Counsel continued.

That’s it? That’s the extent of the apology? A technical regret for a failure to sanitize?

Advice to the VP External Relations and University Counsel: 1) Apologize to Dr. Gupta. 2) Publicly apologize to the faculty, staff, and students of UBC.

That would be a start…

Emma Partridge, Ubyssey, November 20, 2015–A much anticipated documentary by the fifth estate has made some startling discoveries that ultimately cast an unflattering spotlight on how UBC handles sexual assault and the university’s lack of an overarching sexual assault policy.

According to CBC, Dmitry Mordvinov, who was working towards his PhD in history, was accused of multiple sexual offences that were committed two years ago. However, Mordvinov was only expelled from the university last week.

UBC spokesperson Susan Danard issued an emailed statement Friday evening responding to the story.

“It is important to understand that BC privacy law prevents us from disclosing information about or responding to specific cases mentioned in the media. What we can say is we continuously strive to improve our collective response to sexual violence through education. We can do better and we will do better,” read part of the statement.

Several women came forward to the fifth estate to tell stories of assaults committed by Mordvinov. One preferred to remain anonymous, but another, Caitlin Cunningham, went on record. She told the CBC that after reporting her attack to the university, UBC encouraged mediation between herself and Mordvinov.

According to the CBC’s reporting, Monica Kay, director of conflict management, perpetuated a sense that the survivors should keep their experiences to themselves. At this time, Kay has not responded to requests for comment.

When The Ubyssey spoke with Clark Lundeen, assistant principal of Green College — the residence in which Mordvinov was staying while studying for his PhD — he said that reports of sexual assaults would be taken very seriously. Based on the findings of an investigation, the survivor would be referred to on-campus resources for support.

“Confirming is a difficult thing. If we receive a complaint from somebody at the college who alleged that they’re a survivor of sexual assault by somebody, then we take it very seriously and make sure that their safety will be made a priority and that includes … not sharing information that might compromise their privacy,” said Lundeen in that interview.

Although Lundeen would not reveal anything that could have potentially comprised the privacy of the survivor and the alleged assault victim, he could confirm that a report of sexual assault had been filed at the college within the last two years. According to Lundeen, the response by Green College “would be very similar to how it would be handled in any other residence managed by Student Housing and Hospitality Services.”

According to Janice Robinson, director of Residence Life and Administration in Student Housing and Hospitality Services (SHHS), should a survivor disclose their experience the response would be that the residence advisor offers peer support and focuses on getting the survivor the resources and help they need.

“At that point, a residence advisor would also share with the Residence Life manager that a resident has disclosed,” said Robinson. “From there, the Residence Life manager would coach [the] residence advisor on how to be the most supportive that they could, and that would include making sure that the student knows about resources on campus and off campus.”

When asked to address the issues raised by the fifth estate documentary, SHHS, Green College and Piper all insist that UBC takes the issue of sexual assault seriously. However, if CBC is correct in their findings, it took the university almost a year to expel the graduate student who they were officially aware to have assaulted a woman in the spring of 2014.

All of this is ultimately complicated by the fact that UBC does not have a single overarching policy on what to do in the event of a sexual assault. When asked about the progress of such a policy in Senate, both Piper and interim Provost Angela Redish said the question ought to be directed to the VP students, Louise Cowin, who was not present.

According to Ashley Bentley of the AMS Sexual Assault Support Centre (SASC), it is problematic that UBC lacks such a policy to deal with assaults and instead relies more on Policy 3 — dealing with harassment and discrimination in general.

“My experiences from talking to clients, to survivors of violence and to members of this community is that the lack of a policy by UBC makes it seem like they aren’t supporting survivors — that they’re not caring,” said Bentley. “It’s not necessarily to say that a policy solves everything, but what I do think it does is it has clear set guidelines and processes in place which at least make survivors feel like they have options.”

Many other universities have an overarching policy on sexual assault, such as Queen’s and University of Toronto to name a few. According to Bentley, UBC is “quite behind, honestly.”

On 27 October, UBC Insiders broke the story of the collusion between the UBC School of Kinesiology, Faculty of Education, and the School’s Undergraduate Society (KUS). In March 2015, the students held a referendum on a $250 fee to help pay for a new building for the School and Faculty. UBC Insiders obtained files through FoI that suggest about 16 months’ worth of influence of the School and Faculty on the students to secure a “YES” majority on the referendum.

UBC Insiders found top down influence (i.e., top of admin down) that adds up to minimally $41,624 and a curious “Make Your Mark” campaign.

Asking for an explanation of why a School or Faculty would go to these lengths to influence a student referendum, E. Wayne Ross called for a Fact-Finding investigation. Short of an investigation, Faculty administrators offered a consultation report this week (see full report below).

It’s probably just as well that there is just consultation with the School and students in lieu of a fact-finding investigation, as when the University contracts out to fact-finding, mysteriously, there are never any facts to find concerning administrators.

In this most recent report, it’s all just written off as administrative pluck, exuberance and “an excess of enthusiasm.”

Funny that, as we say the same of faculty, staff, students and their academic freedom: exuberance with surplus enthusiasm!

By way of a series of consultations, the Faculty of Education reports:

To provide a follow-up report on the Faculty Meeting item regarding, “the alleged conflicts of interest and potential ethical breaches in the School of Kinesiology’s April 2015 student referendum.”

We have consulted with various offices at the University, to determine at the most fundamental level, the evidentiary foundation that would warrant designing and arranging to be carried out, a “fact-finding” investigation. Such an investigation would be very expensive and would need a clear warrant in terms of evidence of basic problems of procedure, relationship management, finance, and/or policy.

The UBC offices we have consulted include:

  1. UBC Office of University Counsel
  2. UBC Faculty Relations
  3. UBC Office of the Vice President, Students
  4. School of Kinesiology

Regarding the School of Kinesiology there are a number of questions that have been raised concerning the “Make your Mark” Referendum of the Kinesiology Undergraduate Society (KUS) campaign (to add to KIN student fees to raise funds towards a new building) and distributed via media outlets.

On the basis of our investigation to-date, it appears that:

  1. Since the KUS took the Referendum off the AMS ratification agenda, the whole issue of the fees linked with the KUS Referendum is moot.
  2. Since neither the UBC nor the AMS/KUS policies regarding “conflict of interest” preclude Faculty/School and Student Society partnerships, there is no apparent ground for continued concern about the narrative of conflict of interest on the part of the School.
  3. The KUS may have erred in the design of “Make Your Mark” vis a vis the AMS policy of “impartial elections” but we – the University/School faculty members — do not work in a supervisory relationship to the student societies, which do not report to us nor are they governed by faculty/Schools.

With respect to “conflict of interest” – UBC’s policy on conflict of interest (Policy 97)  is concerned with personal conflicts of interest – not institutional conflicts of interest.  There has been no suggestion anywhere that the School of Kinesiology nor its executives benefitted from this matter personally (for example by benefitting financially).

There is no policy or rule that we are aware of that would preclude UBC units from partnering with student unions on initiatives they both support.  There have been several examples of undergraduate student societies contributing to buildings (in return for guarantees of student amenities) through student fees and all of these initiatives involved very substantial interactions between the undergraduate student union, the AMS, the faculty and the UBC central administration.  So the fact that the School was working closely with its KUS undergraduate society would not of itself be noteworthy.

Accordingly, we see no problem at-hand nor any substantive basis for carrying out any further fact-finding or other investigation.

There are, definitely, larger issues that lurk in this scenario worthy of a broad and open discussion that pertains to the current context of post-secondary education and the dramatic withdrawal of support from the Province and Federally — increasing fiscal pressures that have caused academic units to be more creative about issues of revenues, whether this is by seeking increases in international tuition or by creating fund raising partnerships with student organizations or with alumni to build infrastructure. These are complex matters. They are not, however, the basis for a narrative of blame or fault lodged with any particular academic unit. If there is any fault at all to be lodged with particular units it could only be, on the face of the evidence, of an excess of enthusiasm to support our engagement in the project of public education.

More bucks than brains: James Ramey and the ruination of the University of Louisville

In the late 1990s, Kentucky’s legislature initiated a program to upgrade and reform the state’s postsecondary education system, it was called “Bucks for Brains.” (The state’s promotional tagline at the time was “Open for Business.”)

I was recruited to the University of Louisville in 2001 and spent two-and-a-half years on the faculty there as a department chair and distinguished university scholar, which gave me an up close and personal experience with a university administration that’s, as they say where my family’s from, sigogglin.

John W. Shumaker, a classics scholar, was UofL president when I arrived and he proved to be an incredible fund raiser, increasing the university’s endowment from under $200 million to $550 million.

Of course, the UofL has long been the recipient of corporate largesse, especially from the Louisville’s corporate giants Brown-Forman (one of America’s largest spirits and wine companies); Brown & Williamson (which chemically enhanced the addictiveness of cigarettes, remember whistleblower Jeffrey Wigand? No? Well I’m sure you remember Russell Crowe playing Wigand the blockbuster movie The Insider); Papa John’s Pizza (UofL football Cardinals play in Papa John’s Cardinal Stadium); and Yum! Brands (“feeding the world” crap food via KFC, Pizza Hut, and, of course, Taco Bell, more on the Mexican connection later).

After Shumaker left to head up the University of Tennessee (where he resigned in disgrace after 3 years), he was replaced by James R. Ramsey, who had been Kentucky’s state budget director under Gov. Paul E. Patton (who became wealthy by exploiting Kentucky’s coal miners).

Patton’s major achievement as governor was overhauling postsecondary education in the Kentucky. But Patton’s political career was de-railed by duelling scandals: (1)  an extramarital affair and a sex-for-favors scandal; and (2) pardoning four of his political advisers who were indicted for violating Kentucky’s campaign finance laws and for allegedly abusing his patronage powers.

All of this is just everyday Kentucky politics, so Patton wasn’t distracted enough to forget he had to find a soft-landing for his budget director, thus Ramsey, with no university administration experience, became the 17th president of the University of Louisville.

Since Ramsey has been in office the UofL, in endowment has continued to grow and is now pushing the $1 billion mark, which is really the only logical explanation for why he hasn’t been bounced because Ramsey’s administration has more ethical lapses than Carter has liver pills, pretty much proving that the UofL has more bucks than brains.

Robert Felner: Former Dean, Convicted Felon

Felner arrived in Louisville with some spiffy credentials: PhD in psychology from Yale; former head of the department of psychology at the University of Illinois; a CV packed with pages upon pages listing his publications in top journals and, most importantly for the UofL administration, a staggering number of grants.

Despite several red flags about Felner’s candidacy for dean of UofL’s College of Education and Human Development, Ramsey and his long time provost, Shirley Willihnganz, couldn’t wait to get Felner on campus.

Ramsey was in such as rush to land Felner he and Willihnganz forgot to tell the interim dean (and other finalist for the position) they hired Felner, so he was left to discover the decision when Felner call his secretary and started giving her instructions. So much for that HR seminar!

Things in CEHD soon started to fall apart.

I resigned from my department chair position two weeks after Felner took over as dean and later moved to UBC.

Within a few years, there had been 30 grievances filed by faculty and students against Felner for a wide range of abusive managerial practices and a faculty vote of no-confidence in Felner’s leadership of the CEHD. Reasons given by faculty for the vote of non-confidence included:

Public humiliation of faculty, work place harassment, retaliation for voicing opinions, little or no governance, decisions that hurt College, unacceptable and unfair hiring practice; rude, offensive, unethical behavior by CEHD representatives; denial of support for research to those who differ in opinion; and extreme inequity of pay. Despite the abominable conditions in CEHD, UofL Provost Willihnganz and Ramsey both supported Felner publicly.

One year after the vote of no-confidence, Felner announced he was leaving the UofL to become president of the University of Wisconsin, Parkside.

The Chronicle of Higher Education described Felner as “riding high” a couple of years into his deanship at UofL, well-paid, and having secured a $700,000 grant from the US Department of Education. However, he “pressed his luck” during his last weeks in Louisville.

Even though only $96,000 remained in the account, he implored Louisville officials to approve a $200,000 subcontract with a nonprofit organization in Illinois that had already received $450,000 from the grant. Perhaps, he suggested, the university could draw on a special fund that had been established by the daughter of a former trustee.

The Illinois group, Mr. Felner said, had been surveying students and teachers in Kentucky. That survey would “let us give the feds something that should make them very happy about the efficiency and joint commitment of the university to doing a good job with an earmark, as I know we will want more from this agency,” he wrote in an e-mail message on June 18.

But on June 20, his last day as Dean of CEHD before he headed off to Wisconsin, those big black SUVs with government plates (like the ones you see on Criminal Minds) rolled into the CEHD parking lot. US Secret Service, US Postal Inspectors, and UofL Police questioned Felner and escorted him off campus, along with his computers and records.

There was a simultaneous raid on UW-Parkside to confiscate material Felner had shipped ahead of his arrival there.

In October 2008, a federal grand jury indicted Felner on nine counts of mail fraud, money laundering, and tax evasion. According to the indictment,

the Illinois nonprofit group, known as the National Center on Public Education and Prevention, was simply a shell that funneled money into the personal bank accounts of Mr. Felner and Thomas Schroeder, a former student of his and the group’s “executive director.” Prosecutors say the two men siphoned away not only the $694,000 earmarked grant, but also $1.7-million in payments from three urban school districts, money that ought to have gone to the legitimate public-education center that Mr. Felner had created in Rhode Island.

In January 2010, Felner pleaded guilty to nine Federal charges, including income tax evasion.

In May 2010, Felner was sentenced to 63 months in US Federal Prison for his role in defrauding defrauding the UofL and the University of Rhode Island, where he had been director of the School of Education, of $2.3 million of US Department of Education funds earmarked for No Child Left Behind Act research.

Felner Footnotes: Indians, John Deasy, Non-Disclosure Agreements & Ramsey as the Frito Bandito

(1) When Felner announced his resignation, UofL president Ramsey wroted to Felner and said he was worried about “letting the Indians get back in control of the reservation.” That’s some serious respect for university faculty and the idea of shared governance, eh?

(2) Los Angeles school superintendent, John Deasy, has had his academic credentials called into question. Deasy was given a PhD by the University of Louisville after he was enrolled for four months and received a total of nine credits.

Deasy’s doctoral advisor was, surprise, Robert Felner! Deasy had previously awarded $375,000 in consulting contracts to Felner, while Deasy was Superintendent of Santa Monica schools.

Ramsey appointed a “blue-ribbon” panel to investigate Deasy’s degree. The panel found that getting a PhD in four months at the UofL was not cause for concern, thus plunging the UofL’s academic reputation down into the neighbourhood of fly-by-night for-profit “higher” education.

Deasy is now working in an unaccredited training program sponsored by educational de-formers the Broad Foundation, which teaches school leaders business methods and supports charter schools and closing public schools.

(3) Ramsey has been making double retirement payouts to UofL administrators for their silence.

Records show that the school paid a full year’s salary to outgoing vice presidents Michael Curtin ($252,350) and Larry Owsley ($248,255) and to assistant to the president Vivian Hibbs ($66,391) to induce them not to “disparage, demean or impugn the university or its senior leadership.”

In March 2014, UofL made a $346,000.00 settlement with university counsel Angela Kosawha:

The University of Louisville is paying another large settlement in connection with the retirement of a high-ranking official — this time, $346,844 to its top lawyer. University counsel Angela Koshewa is on a three-month leave of absence before she officially retires June 1. Documents obtained under the Kentucky Open Records Act show the university is paying Koshewa — who has questioned some expenditures and proposals backed by President James Ramsey and Dr. David Dunn, the executive vice president for Health Affairs — twice her final salary.

It costs a lot for Ramsey to cover up details of his administration’s incompetence and shenanigans, but remember there are lots of bucks at UofL.

(4) Provost Shirley Willihnganz stepped down as UofL provost earlier this year. The Louisville Courier-Journal reported that

Under her watch, however, university employees have stole, misspent or mishandled at least $7.6 million in schemes at the health science campus, the law school, the business school and the athletic department’s ticket office.

Willihnganz also was criticized for approving about $1 million in buyouts for former high-ranking employees, some of which included agreements not to disparage the university or its leaders.

She also was forced to apologize to CEHD faculty in 2008 for failing to take any common-sense action against Felner for his intimidation, harassment, humiliation and retaliation against faculty, staff, students and alumni.

Willihnganz said at the time that she tended to dismiss the early complaints against Felner — including a no-confidence vote by faculty — because he was a “high performer” and because the complaints came from professors and staff “entrenched in their ways and resistant to change.”

She later told faculty at a meeting that she was sorry. “Mostly what I think I want to say is people have been hurt and something very bad happened, and as provost I feel like I am ultimately responsible for that,” she said.

No duh! She actually is directly responsible for the Felner disaster (along with Ramsey), that’s probably why she feels that way. And speaking of resistance to change …

(5) This next item has nothing to do with Felner, except that his former boss and advocate, James Ramsey, is also the long time boss of UofL basketball coach Rick Pitino who admitted to having sex with a women in a swanky Italian restaurant in Louisville. Apparently that’s not a problem with Ramsey and the UofL because Pitino said it wasn’t rape.

(6) And I almost forgot. Remember the Taco Bell/Mexican connection. This week Ramsey had a little halloween party at the UofL. Ramsey goes racist (again). Yes, he dressed up like the Frito Bandito.
