How America’s Great University System Is Getting Destroyed

On hiring faculty off the tenure track

That’s part of the business model. It’s the same as hiring temps in industry or what they call “associates” at Wal-Mart, employees that aren’t owed benefits. It’s a part of a corporate business model designed to reduce labor costs and to increase labor servility. When universities become corporatized, as has been happening quite systematically over the last generation as part of the general neoliberal assault on the population, their business model means that what matters is the bottom line. The effective owners are the trustees (or the legislature, in the case of state universities), and they want to keep costs down and make sure that labor is docile and obedient. The way to do that is, essentially, temps. Just as the hiring of temps has gone way up in the neoliberal period, you’re getting the same phenomenon in the universities. The idea is to divide society into two groups. One group is sometimes called the “plutonomy” (a term used by Citibank when they were advising their investors on where to invest their funds), the top sector of wealth, globally but concentrated mostly in places like the United States. The other group, the rest of the population, is a “precariat,” living a precarious existence.

This idea is sometimes made quite overt. So when Alan Greenspan was testifying before Congress in 1997 on the marvels of the economy he was running, he said straight out that one of the bases for its economic success was imposing what he called “greater worker insecurity.” If workers are more insecure, that’s very “healthy” for the society, because if workers are insecure they won’t ask for wages, they won’t go on strike, they won’t call for benefits; they’ll serve the masters gladly and passively. And that’s optimal for corporations’ economic health. At the time, everyone regarded Greenspan’s comment as very reasonable, judging by the lack of reaction and the great acclaim he enjoyed. Well, transfer that to the universities: how do you ensure “greater worker insecurity”? Crucially, by not guaranteeing employment, by keeping people hanging on a limb than can be sawed off at any time, so that they’d better shut up, take tiny salaries, and do their work; and if they get the gift of being allowed to serve under miserable conditions for another year, they should welcome it and not ask for any more. That’s the way you keep societies efficient and healthy from the point of view of the corporations. And as universities move towards a corporate business model, precarity is exactly what is being imposed. And we’ll see more and more of it.

That’s one aspect, but there are other aspects which are also quite familiar from private industry, namely a large increase in layers of administration and bureaucracy. If you have to control people, you have to have an administrative force that does it. So in US industry even more than elsewhere, there’s layer after layer of management-a kind of economic waste, but useful for control and domination. And the same is true in universities. In the past 30 or 40 years, there’s been a very sharp increase in the proportion of administrators to faculty and students; faculty and students levels have stayed fairly level relative to one another, but the proportion of administrators have gone way up. There’s a very good book on it by a well-known sociologist, Benjamin Ginsberg, called The Fall of the Faculty: The Rise of the All-Administrative University and Why It Matters (Oxford University Press, 2011), which describes in detail the business style of massive administration and levels of administration-and of course, very highly-paid administrators. This includes professional administrators like deans, for example, who used to be faculty members who took off for a couple of years to serve in an administrative capacity and then go back to the faculty; now they’re mostly professionals, who then have to hire sub-deans, and secretaries, and so on and so forth, a whole proliferation of structure that goes along with administrators. All of that is another aspect of the business model.

But using cheap labor-and vulnerable labor-is a business practice that goes as far back as you can trace private enterprise, and unions emerged in response. In the universities, cheap, vulnerable labor means adjuncts and graduate students. Graduate students are even more vulnerable, for obvious reasons. The idea is to transfer instruction to precarious workers, which improves discipline and control but also enables the transfer of funds to other purposes apart from education. The costs, of course, are borne by the students and by the people who are being drawn into these vulnerable occupations. But it’s a standard feature of a business-run society to transfer costs to the people. In fact, economists tacitly cooperate in this. So, for example, suppose you find a mistake in your checking account and you call the bank to try to fix it. Well, you know what happens. You call them up, and you get a recorded message saying “We love you, here’s a menu.” Maybe the menu has what you’re looking for, maybe it doesn’t. If you happen to find the right option, you listen to some music, and every once and a while a voice comes in and says “Please stand by, we really appreciate your business,” and so on. Finally, after some period of time, you may get a human being, who you can ask a short question to. That’s what economists call “efficiency.” By economic measures, that system reduces labor costs to the bank; of course it imposes costs on you, and those costs are multiplied by the number of users, which can be enormous-but that’s not counted as a cost in economic calculation. And if you look over the way the society works, you find this everywhere. So the university imposes costs on students and on faculty who are not only untenured but are maintained on a path that guarantees that they will have no security. All of this is perfectly natural within corporate business models. It’s harmful to education, but education is not their goal.

In fact, if you look back farther, it goes even deeper than that. If you go back to the early 1970s when a lot of this began, there was a lot of concern pretty much across the political spectrum over the activism of the 1960s; it’s commonly called “the time of troubles.” It was a “time of troubles” because the country was getting civilized, and that’s dangerous. People were becoming politically engaged and were trying to gain rights for groups that are called “special interests,” like women, working people, farmers, the young, the old, and so on. That led to a serious backlash, which was pretty overt. At the liberal end of the spectrum, there’s a book called The Crisis of Democracy: Report on the Governability of Democracies to the Trilateral Commission, Michel Crozier, Samuel P. Huntington, Joji Watanuki (New York University Press, 1975), produced by the Trilateral Commission, an organization of liberal internationalists. The Carter administration was drawn almost entirely from their ranks. They were concerned with what they called “the crisis of democracy,” namely that there’s too much democracy. In the 1960s there were pressures from the population, these “special interests,” to try to gain rights within the political arena, and that put too much pressure on the state-you can’t do that. There was one special interest that they left out, namely the corporate sector, because its interests are the “national interest”; the corporate sector is supposed to control the state, so we don’t talk about them. But the “special interests” were causing problems and they said “we have to have more moderation in democracy,” the public has to go back to being passive and apathetic. And they were particularly concerned with schools and universities, which they said were not properly doing their job of “indoctrinating the young.” You can see from student activism (the civil rights movement, the anti-war movement, the feminist movement, the environmental movements) that the young are just not being indoctrinated properly.

Well how do you indoctrinate the young? There are a number of ways. One way is to burden them with hopelessly heavy tuition debt. Debt is a trap, especially student debt, which is enormous, far larger than credit card debt. It’s a trap for the rest of your life because the laws are designed so that you can’t get out of it. If a business, say, gets in too much debt it can declare bankruptcy, but individuals can almost never be relieved of student debt through bankruptcy. They can even garnish social security if you default. That’s a disciplinary technique. I don’t say that it was consciously introduced for the purpose, but it certainly has that effect. And it’s hard to argue that there’s any economic basis for it. Just take a look around the world: higher education is mostly free. In the countries with the highest education standards, let’s say Finland, which is at the top all the time, higher education is free. And in a rich, successful capitalist country like Germany, it’s free. In Mexico, a poor country, which has pretty decent education standards, considering the economic difficulties they face, it’s free. In fact, look at the United States: if you go back to the 1940s and 50s, higher education was pretty close to free. The GI Bill gave free education to vast numbers of people who would never have been able to go to college. It was very good for them and it was very good for the economy and the society; it was part of the reason for the high economic growth rate. Even in private colleges, education was pretty close to free. Take me: I went to college in 1945 at an Ivy League university, University of Pennsylvania, and tuition was $100. That would be maybe $800 in today’s dollars. And it was very easy to get a scholarship, so you could live at home, work, and go to school and it didn’t cost you anything. Now it’s outrageous. I have grandchildren in college, who have to pay for their tuition and work and it’s almost impossible. For the students that is a disciplinary technique.

And another technique of indoctrination is to cut back faculty-student contact: large classes, temporary teachers who are overburdened, who can barely survive on an adjunct salary. And since you don’t have any job security you can’t build up a career, you can’t move on and get more. These are all techniques of discipline, indoctrination, and control. And it’s very similar to what you’d expect in a factory, where factory workers have to be disciplined, to be obedient; they’re not supposed to play a role in, say, organizing production or determining how the workplace functions-that’s the job of management. This is now carried over to the universities. And I think it shouldn’t surprise anyone who has any experience in private enterprise, in industry; that’s the way they work.

On how higher education ought to be

First of all, we should put aside any idea that there was once a “golden age.” Things were different and in some ways better in the past, but far from perfect. The traditional universities were, for example, extremely hierarchical, with very little democratic participation in decision-making. One part of the activism of the 1960s was to try to democratize the universities, to bring in, say, student representatives to faculty committees, to bring in staff to participate. These efforts were carried forward under student initiatives, with some degree of success. Most universities now have some degree of student participation in faculty decisions. And I think those are the kinds of things we should be moving towards: a democratic institution, in which the people involved in the institution, whoever they may be (faculty, students, staff), participate in determining the nature of the institution and how it runs; and the same should go for a factory.

These are not radical ideas, I should say. They come straight out of classical liberalism. So if you read, for example, John Stuart Mill, a major figure in the classical liberal tradition, he took it for granted that workplaces ought to be managed and controlled by the people who work in them-that’s freedom and democracy (see, e.g., John Stuart Mill, Principles of Political Economy, book 4, ch. 7). We see the same ideas in the United States. Let’s say you go back to the Knights of Labor; one of their stated aims was “To establish co-operative institutions such as will tend to supersede the wage-system, by the introduction of a co-operative industrial system” (“Founding Ceremony” for newly-organized Local Associations). Or take someone like, John Dewey, a mainstream 20th-century social philosopher, who called not only for education directed at creative independence in schools, but also worker control in industry, what he called “industrial democracy.” He says that as long as the crucial institutions of the society (like production, commerce, transportation, media) are not under democratic control, then “politics [will be] the shadow cast on society by big business” (John Dewey, “The Need for a New Party”[1931]). This idea is almost elementary, it has deep roots in American history and in classical liberalism, it should be second nature to working people, and it should apply the same way to universities. There are some decisions in a university where you don’t want to have [democratic transparency because] you have to preserve student privacy, say, and there are various kinds of sensitive issues, but on much of the normal activity of the university, there is no reason why direct participation can’t be not only legitimate but helpful. In my department, for example, for 40 years we’ve had student representatives helpfully participating in department meetings.

On “shared governance” and worker control

The university is probably the social institution in our society that comes closest to democratic worker control. Within a department, for example, it’s pretty normal for at least the tenured faculty to be able to determine a substantial amount of what their work is like: what they’re going to teach, when they’re going to teach, what the curriculum will be. And most of the decisions about the actual work that the faculty is doing are pretty much under tenured faculty control. Now of course there is a higher level of administrators that you can’t overrule or control. The faculty can recommend somebody for tenure, let’s say, and be turned down by the deans, or the president, or even the trustees or legislators. It doesn’t happen all that often, but it can happen and it does. And that’s always a part of the background structure, which, although it always existed, was much less of a problem in the days when the administration was drawn from the faculty and in principle recallable. Under representative systems, you have to have someone doing administrative work but they should be recallable at some point under the authority of the people they administer. That’s less and less true. There are more and more professional administrators, layer after layer of them, with more and more positions being taken remote from the faculty controls. I mentioned before The Fall of the Faculty by Benjamin Ginsberg, which goes into a lot of detail as to how this works in the several universities he looks at closely: Johns Hopkins, Cornell, and a couple of others.

Meanwhile, the faculty are increasingly reduced to a category of temporary workers who are assured a precarious existence with no path to the tenure track. I have personal acquaintances who are effectively permanent lecturers; they’re not given real faculty status; they have to apply every year so that they can get appointed again. These things shouldn’t be allowed to happen. And in the case of adjuncts, it’s been institutionalized: they’re not permitted to be a part of the decision-making apparatus, and they’re excluded from job security, which merely amplifies the problem. I think staff ought to also be integrated into decision-making, since they’re also a part of the university. So there’s plenty to do, but I think we can easily understand why these tendencies are developing. They are all part of imposing a business model on just about every aspect of life. That’s the neoliberal ideology that most of the world has been living under for 40 years. It’s very harmful to people, and there has been resistance to it. And it’s worth noticing that two parts of the world, at least, have pretty much escaped from it, namely East Asia, where they never really accepted it, and South America in the past 15 years.

On the alleged need for “flexibility”

“Flexibility” is a term that’s very familiar to workers in industry. Part of what’s called “labor reform” is to make labor more “flexible,” make it easier to hire and fire people. That’s, again, a way to ensure maximization of profit and control. “Flexibility” is supposed to be a good thing, like “greater worker insecurity.” Putting aside industry where the same is true, in universities there’s no justification. So take a case where there’s under-enrollment somewhere. That’s not a big problem. One of my daughters teaches at a university; she just called me the other night and told me that her teaching load is being shifted because one of the courses that was being offered was under-enrolled. Okay, the world didn’t to an end, they just shifted around the teaching arrangements-you teach a different course, or an extra section, or something like that. People don’t have to be thrown out or be insecure because of the variation in the number of students enrolling in courses. There are all sorts of ways of adjusting for that variation. The idea that labor should meet the conditions of “flexibility” is just another standard technique of control and domination. Why not say that administrators should be thrown out if there’s nothing for them to do that semester, or trustees-what do they have to be there for? The situation is the same with top management in industry: if labor has to be flexible, how about management? Most of them are pretty useless or even harmful anyway, so let’s get rid of them. And you can go on like this. Just to take the news from the last couple of days, take, say, Jamie Dimon, the CEO of JP Morgan Chase bank: he just got a pretty substantial raise, almost double his salary, out of gratitude because he had saved the bank from criminal charges that would have sent the management to jail; he got away with only $20 billion in fines for criminal activities. Well I can imagine that getting rid of somebody like that might be helpful to the economy. But that’s not what people are talking about when they talk about “labor reform.” It’s the working people who have to suffer, and they have to suffer by insecurity, by not knowing where tomorrow’s piece of bread is going to come from, and therefore be disciplined and obedient and not raise questions or ask for their rights. That’s the way that tyrannical systems operate. And the business world is a tyrannical system. When it’s imposed on the universities, you find it reflects the same ideas. This shouldn’t be any secret.

On the purpose of education

These are debates that go back to the Enlightenment, when issues of higher education and mass education were really being raised, not just education for the clergy and aristocracy. And there were basically two models discussed in the 18th and 19th centuries. They were discussed with pretty evocative imagery. One image of education was that it should be like a vessel that is filled with, say, water. That’s what we call these days “teaching to test”: you pour water into the vessel and then the vessel returns the water. But it’s a pretty leaky vessel, as all of us who went through school experienced, since you could memorize something for an exam that you had no interest in to pass an exam and a week later you forgot what the course was about. The vessel model these days is called “no child left behind,” “teaching to test,” “race to top,” whatever the name may be, and similar things in universities. Enlightenment thinkers opposed that model.

The other model was described as laying out a string along which the student progresses in his or her own way under his or her own initiative, maybe moving the string, maybe deciding to go somewhere else, maybe raising questions. Laying out the string means imposing some degree of structure. So an educational program, whatever it may be, a course on physics or something, isn’t going to be just anything goes; it has a certain structure. But the goal of it is for the student to acquire the capacity to inquire, to create, to innovate, to challenge-that’s education. One world-famous physicist, in his freshman courses if he was asked “what are we going to cover this semester?”, his answer was “it doesn’t matter what we cover, it matters what you discover.” You have gain the capacity and the self-confidence for that matter to challenge and create and innovate, and that way you learn; that way you’ve internalized the material and you can go on. It’s not a matter of accumulating some fixed array of facts which then you can write down on a test and forget about tomorrow.

These are two quite distinct models of education. The Enlightenment ideal was the second one, and I think that’s the one that we ought to be striving towards. That’s what real education is, from kindergarten to graduate school. In fact there are programs of that kind for kindergarten, pretty good ones.

On the love of teaching

We certainly want people, both faculty and students, to be engaged in activity that’s satisfying, enjoyable, challenging, exciting-and I don’t really think that’s hard. Even young children are creative, inquisitive, they want to know things, they want to understand things, and unless that’s beaten out of your head it stays with you the rest of your life. If you have opportunities to pursue those commitments and concerns, it’s one of the most satisfying things in life. That’s true if you’re a research physicist, it’s true if you’re a carpenter; you’re trying to create something of value and deal with a difficult problem and solve it. I think that’s what makes work the kind of thing you want to do; you do it even if you don’t have to do it. In a reasonably functioning university, you find people working all the time because they love it; that’s what they want to do; they’re given the opportunity, they have the resources, they’re encouraged to be free and independent and creative-what’s better? That’s what they love to do. And that, again, can be done at any level.

Robert Clift, CUFA BC, February 18, 2014– The 2014/15 provincial budget continues to shortchange students and their families according to the organization representing professors, librarians and other academic staff at BC’s public research universities.

“In a time when we should be increasing investment in the people and research necessary to diversify our economy and support local communities, this budget cuts funding to post-secondary institutions and does nothing to help us keep BC’s best and brightest at home,” said Richard Kool, President of the Confederation of University Faculty Associations of BC (CUFA BC).

“By 2016, per student operating grants to universities, colleges and institutes will have dropped 20% in real terms since the Liberals formed government,” Kool added. “Students have already lost support services and learning opportunities due to inadequate funding and these new cuts will shortchange students even further.”

“Moreover, we are losing some of the best and brightest BC students to other provinces because we don’t have a provincial graduate fellowship program to support tomorrow’s innovators,” Kool said.

The creation of the BC Training and Education Savings Grant will do little to help students and their families, say the professors.

“The BC Training and Education Savings Grant is completely inadequate”, Kool said. “The value of the government’s contribution will not even cover the projected increase in tuition fees for one year by the time a child born today reaches age 18. We should be able to do better.”

“Using the government’s numbers, the value of the government’s contribution will fall $473 short of the projected tuition fee increases. Using more realistic calculations, the gap is $754,” Kool added. “This is on top of tuition fees that have already doubled under the Liberals.”

“Our society and economy demands educated citizens,” Kool said. “Simply training people for resource-dependent jobs, as proposed by this budget, ignores the need to prepare people for the social, economic and environmental changes in front of us. The provincial government’s narrow focus limits our possibilities and ill-prepares us for an ever changing world.”

The Confederation of University Faculty Associations of BC represents 4,600 professors, librarians, instructors, lecturers and other academic staff at BC’s five public research universities – UBC (Vancouver and Kelowna), SFU (Burnaby, Surrey, Vancouver), UVic (Victoria), UNBC (Prince George, Quesnel, Terrace, Fort St. John) and Royal Roads (Victoria).

The Faculty Association of UBC (FAUBC) recently surveyed its members about preferences for the University’s management of its members’ Career Advancement Plan (CAP). Most of the 3,300 faculty members and librarians do not realize UBC manages their CAP, and perhaps most would conclude that their CAP is mismanaged.

In short, the CAP is performance pay—$2m in discretionary salary funds for Management to allocate to a select few FAUBC members each year (i.e., merit pay, performance salary adjustment). A large majority of members do not share in the spoils and the FAUBC’s part-time faculty or Sessional members (approx. 1,000) are excluded by status.

Exclusion, whether systematically or by status, from a CAP is mismanagement by definition: if your career is not advancing according to plan, you may have the employer that manages the plan, UBC, to blame.

Moreover, UBC’s Management does not fairly allocate this exceptionally large amount of potential salary increases. Alternatively, this $2m could be included in an across the board or general salary increase for the Sessionals, adding at least $2,000 per year to each part-time members’ meagre year-end wages. Instead of a divided FAUBC by status, this would mean the Association stands further united.

Just say no way to Performance Pay. Faculty associations, please pay attention.

In a previous blog on UBC Professor Jennifer Chan’s complaint of racial discrimination in her application to the David Lam Chair in Multicultural Education, I suggested a few things:

  • Given that the term of the current Lam Chair expired, it should itself should be left vacant, without a faculty member holding for two years.
  • With administrative terms winding down, the spring will be time for our new Dean, closing in on his third year, to ‘shuffle the cabinet’ and appoint a new administration to take affirmative action on racial equity in Education.

Questions were raised about why I said “time for reflection” when I should have said time for action on racial equity. Point taken.

Reasonable hostility: Academic freedom & speech under threat #highered #edstudies #criticaled #bced #bcpoli #ubc #yteubc

No disrespect, but… Politic for politic, as faculty and student activism over the last decade was generated in response to administrative measures taken to devalue academic budget lines and increase debt loads, administrators formed policies that shored up their powers to police campus speech and launch investigations. Following an introduction of a Respectful Environment policy in 2008, in anticipation of an upcoming political protest on campus in March 2009, the President of UBC circulated a “Respectful Debate” memo warning students and faculty to “pay special attention to the rules that govern our conduct” for speech. Legislation of respect entangles or snares the left and right in the same finely meshed dragnet attenuating civil liberties. This also recalibrates a network of surveillance media and technologies, challenging nearly all protections in the workplace. Some self-identified centrists or voices of reason welcome the new measures, adopting roles of third persons while reporting to administrators that loose lips sink scholar-ships.

In Canada and the US, these new respectful workplace policies, which anticipate or respond to workplace legislation and court decisions, mean that academic freedom and charter or constitutional rights noticeably contract at the campus gates. Watching postsecondary institution by institution adopt similar respectful workplace policies, the Executive Director of the Canadian Association of University Teachers (CAUT), issued a memorandum in late March 2009 advising vigilance: “the test of ‘disrespect’ identified in these policies is for the most part experiential and subjective – notions like ‘feelings of shame’ or ‘embarrassment’ crop up repeatedly.” He subsequently asserted, “a major problem in Canadian universities is not that too many people are asserting their academic freedom, but that too few are.”

Similar policies in the US are compounded by the Supreme Court’s 2006 Garcetti v. Ceballos opinion that “when public employees make statements pursuant to their official duties, the employees are not speaking as citizens for First Amendment purposes, and the Constitution does not insulate their communications from employer discipline,” reinforcing managerial discretion and prerogative. Although academic freedom remains a special concern of free speech rights and was deferred by the Court in Garcetti, legal analysts such as Harvey Gilmore concur that “Garcetti has now become the definitive statement on a public employer’s discretion in managing office operations, and that discretion includes controlling an employee’s speech made in the scope of the employee’s professional capacity.”

Following legislation in four other provinces, on 1 July 2012 new legislation in BC came into effect through an amendment of the mental disorder section of the Workers Compensation Act. The new amendment in Section 5.1 provides for potential compensation if the disorder

(i) is a reaction to one or more traumatic events arising out of and in the course of the worker’s employment, or
(ii) is predominantly caused by a significant work-related stressor, including bullying or harassment, or a cumulative series of significant work-related stressors, arising out of and in the course of the worker’s employment.

For legal preparation for this legislation now common across Canada, universities such as UBC folded a large scope of potential infractions into their respectful workplace policies. What stands as protection for disability or “mental disorder” and against “bullying or harassment” under the law is extended in higher education policy to common modes of academic speech—commentary and criticism—that might be articulated in the wrong tone.

Offices of Human Resources introducing or monitoring respectful workplace policies oversimplify speech by stressing, “it is not what you say but how you say it that counts.” Repeated in HR across higher education and curiously by some administrators, this folksy maxim come respectful workplace policy draws on centuries of etiquette texts. “Rather than seeing public talk occasions as needing politeness or civility, a better norm” Karen Tracy proposes, “is reasonable hostility.” She effectively hashes out parameters for democratic communicative practice and flips this “aphorism on its head, it is not merely how something is said, but what a person says that matters.”

Only certain types of face-attack are legitimate and desirable in local governance situations. ‘Reasonable hostility’ is the name for acts that are. Reasonable hostility involves person-directed attack; it is remarks that imply disrespectful, undesirable things about others. Targets of reasonable hostility will judge speakers uttering those remarks to be rude, disrespectful, unfair, and so on…. A speaker might be cognizant that his or her remarks may have this effect, but their purpose is to express outrage about a wrong.  The speaker sees self’s central aim as witnessing a truth or expressing righteous indignation.

Faculty and students are bookended by a reformalization of academic speech on one side and a normalization of administrative equivocation, deception included, on the other. UI Urbana faculty line up on sides to unionize #highered #criticaled #edstudies

Christine Des Garennes, The News-Gazette, February 2, 2014– On one side you have an award-winning, internationally-known scholar. On the other side you have an equally respected researcher and professor with just as many publications and grants to his or her name.

One believes establishing a faculty union would protect and strengthen the university. The other insists a bargaining unit for faculty would weaken the institution.

Can anyone win this debate?

Efforts to form a faculty union on the University of Illinois’ Urbana-Champaign campus in recent years have for the most part entailed discussions in offices and meeting rooms. But as union organizers ramp up their activities — asking people to sign a statement of support (an announcement disclosing numbers is expected soon) and distributing promotional literature — the discourse, if you will, has intensified.

Not long after the Campus Faculty Association, the group behind the unionization effort, delivered to every faculty member a brochure unveiling some of its more prominent supporters, an opposing group ratcheted up its campaign. That group released its own list of notable professors and their reasons for coming out against a faculty union.

Meantime, university officials, including Chancellor Phyllis Wise, have said publicly they don’t see a need for a faculty union and that having one would only make dealings between the faculty and administration more confrontational. And about 140 miles north on the UI’s Chicago campus, the nascent UIC United Faculty is in its 17th month of negotiating with administration for its first contract after organizing back in 2011.

Whatever happens in Urbana, it’s likely the debate will continue for some time.

One union, two contracts

In the U.S., more than 350,000 college and university faculty are represented by collective bargaining units, according to the National Center for the Study of Collective Bargaining in Higher Education and the Professions at Hunter College City University of New York.

Because of a Supreme Court ruling in 1980, which stated that faculty at Yeshiva University acted as managers or supervisors rather than employees, few unionized faculty are found at private institutions, said William Herbert, executive director of the center and former deputy chairman of the New York State Public Employment Relations Board.

The majority of unionized faculty are at public institutions, and about 43 percent are at four-year institutions. In Illinois, there are about 20,062 unionized faculty. Unions are found at state universities like Southern Illinois and community colleges such as Parkland College.

“It’s safe to say that when there is an effort to organize on a campus, it’s democracy in action, and democracy in action takes many different variations,” Herbert said.

Illinois has a public sector collective bargaining statute, which allows employees to unionize. And the process can entail a gathering of what Herbert called “a showing of interest to establish support for unionization.”

“That can lead to voluntary recognition by the employer or, if employer refuses to recognize, then a petition can be filed” with the Illinois Educational Relations Labor Board.

To prove a union has support, organizers can hold an election or a card check in which faculty would sign (or not) cards stating that they favor union representation. If at least 50 percent plus one of all eligible faculty sign authorization cards in favor of forming a union, eventually the union would be able to negotiate a contract.

The Campus Faculty Association has indicated it could go the route of the card check.

“I think it’s going to go much more smoothly here,” compared with the Chicago campus campaign, said CFA President Harriet Murav, UI Professor of Slavic languages and literatures. “This is a campus that has a reputation for excellence. This is the flagship campus … and I don’t think administration would want to impede what we have going on here, in terms of research, teaching and public service excellence. I think the whole country will be watching closely.”

The tenure-track college professor with a stable salary, firmly grounded in the middle or upper-middle class, is becoming rare. Taking her place is the contingent faculty: nontenure-track teachers, such as part-time adjuncts or graduate instructors, with no job security from one semester to the next, working at a piece rate with few or no benefits across multiple workplaces, and far too often struggling to make ends meet. In 1970, adjuncts made up 20 percent of all higher education faculty. Today, they represent half.

Oftentimes, the academic job market for full-time (FT) faculty is inversely related to economic recessions. Not anymore. In this prolonged Great Recession, turned Great Depression II in parts of North America and across the world, youth have been particularly hard hit, more pronounced by race. The most common description for this current economy for youth is “a precipitous decline in employment and a corresponding increase in unemployment.” In Canada and the US, unemployment rates for the 16-19 year olds exceeds 25%. At the same time, one of the most common descriptions for postsecondary enrollment and participation in Canada and the US is “tremendous growth at the undergraduate level… the number of graduate students has grown significantly faster than the number of undergraduate students over the last 30 years.” With “school-to-work” and “youth employment” oxymoronic, corporate academia and the education industry are capitalizing on masses of students returning to desperately secure advanced credentials in hard times, but no longer does this matter to the professoriate.

If higher education enrollment has been significant, increases in online or e-learning enrollment have been phenomenal. Postsecondary institutions in North America commonly realized 100% increases in online course enrollment from the early 2000s to the present with the percentage of total registrations increasing to 25% for some universities. In Canada, this translates to about 250,000 postsecondary students currently taking online courses but has not translated into FT faculty appointments. More pointedly, it has eroded the FT faculty job market and fueled the part-time (PT) job economy of higher education. About 50% of all faculty in North America are PT but this seems to jump to about 85%-90% for those teaching online courses. For example, in the University of British Columbia’s (UBC) Master of Educational Technology (MET), where there are nearly 1,000 registrations per year, 85% of all sections are taught by PT faculty. In its decade of existence, not a single FT faculty member has been hired for this revenue generating program. Mirroring trends across North America, support staff doubling as adjunct or sessional teach about 45% of MET courses in addition to their 8:30-4:30 job functions in the service units. These indicators are of a larger scope of trends in the automation of intellectual work.

Given these practices across Canada, in the field of Education for example, there has been a precipitous decline in employment of FT faculty, which corresponds with the precipitous decline in employment of youth (Figure 1). Education is fairly reflective of the overall academic job market for doctorates in Canada. Except for short-term trends in certain disciplines, the market for PhDs is bleak. Trends and an expansion of the Great Recession predict that the market will worsen for graduates looking for FT academic jobs in all disciplines. A postdoctoral appointment market is very unlikely to materialize at any scale to offset trends. For instance, Education at UBC currently employs just a handful (i.e., 4-5) of postdocs.

To put it in mild, simple terms: Universities changed their priorities and values by devaluing academic budget lines. Now in inverse relationship to the increases in revenue realized by universities through the 2000s, academic budgets were progressively reduced from 40% or more to just around 20% for many of these institutions. One indicator of this trend is the expansion of adjunct labor or PT academics. In some colleges or faculties, such as Education at UBC, the number of PT faculty, which approached twice that of FT in 2008, teach from 33% to 85% of all sections, depending on the program.

Another indicator is the displacement of tenure track research faculty by non-tenure track, teaching-intensive positions. For example, in Education at UBC, about 18 of the last 25 FT faculty hires were for non-tenure track teaching-intensive positions (i.e., 10 courses per year for Instructor, Lecturer, etc.). This was partially to offset a trend of PT faculty hires pushing Education well over its faculty salary budget (e.g., 240 PT appointments in 2008). Measures in North America have been so draconian that the American Association of University Professors (AAUP) was compelled to report in 2010 that “the tenure system has all but collapsed…. the proportion of teaching-intensive to research-intensive appointments has risen sharply. However, the majority of teaching-intensive positions have been shunted outside of the tenure system.” What is faculty governance, other than an oligarchy, with a handful of faculty governing or to govern?

Beautiful Mind, 1932-2014

Rykesha Hudson & Elizabeth Pears, The Voice, February 10, 2014–  JAMAICAN CULTURAL theorist Stuart Hall has died aged 82, according to reports.

Hall, who grew up in Kingston, Jamaica, studied at Oxford and emerged as one of the Britain’s leading sociologists.

Last autumn, Hall was brought to the big screen, in The Stuart Hall Project, a documentary and labour of love from acclaimed director John Akomfrah, for whom the academic is a personal hero.

Akomfrah said: “Stuart Hall was one of the few people of colour we saw on television who wasn’t crooning, dancing, or running…he was a kind of rock star for us [black teenage bookworms], a pop icon with brains whose very iconic presence on this most public of platforms – television – suggested all manner of ‘impossible possibilities’.”

Hall retired from public life in recent years due to health problems including kidney failure.

One of the first to pay tribute to the “intellectual giant” was Professor Gus John. He told The Voice: “I have been hugely influenced by his work.

“In the last half a century or so, he was an intellectual giant. His work on the state and its relationship with people has been very influential in our struggles.

“His work on culture and imperialism was powerful and influential. He is a huge loss to Britain and the world.”

Also paying tribute to his life and work, Martin Bean, vice-chancellor of The Open University said: “His loss will be felt right across the world of academia and sociology as a whole.

“Stuart was one of the intellectual founders of cultural studies, publishing many influential books and shaping the conversations of the time.

“It was a privilege to have Stuart at the heart of The Open University – touching and influencing so many lives through his courses and tutoring.

“He was a committed and influential public intellectual of the new left, who embodied the spirit of what the OU has always stood for; openness, accessibility, a champion for social justice and of the power of education to bring positive change in peoples’ lives.”

PRAISED: Members of the academic world have hailed Hall’s contribution

Dubbed the godfather of multiculturalism, Hall was born on February 3, 1932, in Kingston, Jamaica, to a light-skinned, middle class family.

From an early age, Hall identified himself as an outsider. In his own home, he was quite literally the black sheep being “at least three shades darker” than the rest of his family – “the first social fact I knew about myself”, he admitted.

Educated at the all-male Jamaica College, one of the island’s elite establishments whose alumni includes the late Jamaican Premier Norman Manley and late PM Michael Manley, Hall was different from the majority of young men of his age.

And unlike his fellow West Indians who formed the Windrush Generation, Hall arrived in Britain in 1951 not looking for menial work but as a Rhodes scholar – a recipient of funding from the Jamaican Government – to read English Literature at Merton College, University of Oxford.

In Canada, climbing the Ivory tower has never been harder. More people graduate with PhDs, but full-time tenure track faculty positions are harder to get. Many highly educated Canadians struggle to find adequate-paying work that meets their credentials.

And for those who dream of chalk-boards, lecture halls, and tweed jackets… the best they can get is work as a part-time instructor.

It’s estimated that about half of all teaching in the country is done by contract professors — instead of permanent full time professors.

Henry Giroux | Reclaiming the Radical Imagination: Challenging Casino Capitalism’s Punishing Factories # criticaleducation #occupywallstreet #occupyeducation #idlenomore

Henry Giroux, Thruthout, January 13, 2014– The Gilded Age is back, with huge profits for the ultrarich, hedge fund managers and the major players in the financial service industries. In the new landscapes of wealth, exclusion and fraud, the commanding institutions of a savage and fanatical capitalism promote a winner-take-all ethos and aggressively undermine the welfare state and wage a counter revolution against the principles of social citizenship and democracy. The geographies of moral and political decadence have become the organizing standard of the dreamworlds of consumption, privatization, surveillance and deregulation. For instance, banks such as JP Morgan Chase, Bank of America and other investment companies including Barclays, Citigroup, Deutsche Bank, Goldman Sachs, and UBS prosper from subterfuge and corruption. They also have been transformed into punishing factories that erode the welfare state while pushing millions into hardship and misery and relegating an entire generation of young people into a state of massive unemployment, debt, and repression.  The profits seem endless and the lack of moral responsibility unchecked as the rich go on buying sprees soaking up luxury goods in record numbers. The New York Times reports that dealers of high-end luxury cars cannot keep up with the demand. Indulging in luxury items is no longer a dirty word for the ultrarich in spite of living in a society wracked by massive unemployment, inequality and poverty. One example provided by the Times, without either irony or criticism, points to “Matt Hlavin, an entrepreneur in Cleveland who owns seven businesses, mostly in manufacturing, bought three Mercedes last year: a $237,000 SLS AMG and a $165,000 S63 AMG for himself, and a $97,000 GL550 sport utility vehicle for his wife.”[1]  This example of shameless consumption reads like a scene out of Martin Scorsese’s film The Wolf of Wall Street, which portrays the financial elite as infantilized frat boys out of control in their unquenchable craving for greed, sex, power, and every other debauchery imaginable.[2] At a time when the United States has descended into forms of political and moral amnesia, massive inequity and high levels of poverty, coupled with narratives of excess and over-the-top material indulgence, have become normalized and barely receive any critical commentary in the mainstream media.

It gets worse. As the zombies of casino capitalism rake in unprecedented amounts of wealth, they appear to take delight in mocking and humiliating the poor and disadvantaged as if they are not only responsible for their suffering but deserve such hardships in spite of the fact they are not accountable for the difficulties in which they find themselves. Those with little power or wealth are now seen not only as morally degenerates but as disposable, subject to the whims of the market and outside any consideration of compassion or justice. Yet there is more at work here than a moral deficit or the kind of pathological daring and willingness to remove oneself from any sense of compassion for others. There is also a culture of cruelty willfully reproduced by a rabid form of casino capitalism that measures human worth in cost-benefit analysis and accrues and consolidates power in the interests of the top one percent of the population.

The new extremists balk at extending unemployment benefits or providing food stamps for young children. Yet, they have no trouble offering millions in subsidies to corporate interests or lowering taxes for the ultrarich corporations. Obscene wealth couples with the arrogance of power as billionaires such as the Koch brothers make 3 million dollars an hour from their investments while simultaneously calling for the abolishment of the minimum wage.[3] CEO salaries reach into the financial stratosphere, while the middle and working classes increasingly face impoverishment and misery.  In 2012, the “top 10 percent took in half of the country’s total income” while the top 1 percent took more than one-fifth (22.5 percent) of the income earned by Americans. [4] In the midst of the upward redistribution of wealth, misery proliferates, and the commanding institutions of society are increasingly more divorced from maters of ethics, social responsibility and social costs. This is evident as the ranks of homeless children grow exponentially, while corporate fat cats fund various groups to lobby against health care policies and social provisions for the poor. It is also evident in the growing ranks of people on food stamps, an increase in the homeless population, especially among children. Moreover, 46.2 percent of the American population lives in poverty. [5]

Republicans claim they are now concerned about addressing poverty, especially since the general public rightly views them as heartless, cruel and indifferent to the hardships experienced by people who are unemployed and lack food, shelter, health care and any sense of hope. Yet, the hypocrisy of the apostles of casino capitalism is on full display in a commentary by The New York Times which states: “But at the same time that the party is shifting its focus to poverty, many Republicans are pushing for deep cuts to food assistance programs and unemployment insurance, while 11 million Americans are jobless and poverty rates remain elevated in the wake of the recession.” [6] For the right-wing extremists dominating government, the courts and cultural life, talk about choice and agency is divorced from social responsibility and the emphasis on individual responsibility is nothing more than a cheap trick to divert the public’s attention away from larger structural and systemic problems facing the United States.

We now live under a form of casino capitalism that revels in deception, kills the radical imagination, depoliticizes the American public and promulgates what might be called disimagination factories and punishing machines. Idealism has been replaced by a repressive punishing machine and a surveillance state that turns every space into a war zone, criminalizes social problems and legitimates state violence as the most important practice for addressing important social issues. Racism now fuels a mass incarceration system that expands the reach of the punishing state to those viewed as excess and excluded from American society. The carceral state and the surveillance state now work together to trump security over freedom and justice while solidifying the rule of the financial elite and the reigning financial services such as banks, investment houses and hedge funds, all of which profit from the expanding reach of the punishing state. The drug war has become a war on racial minorities just as the war on poverty has become a war on the poor.

Chris Hedges is right when he argues that “any state that has the capacity to monitor all its citizenry, any state that has the ability to snuff out factual public debate through [the] control of information, any state that has the tools to instantly shut down all dissent is totalitarian.” [7]  While Hedges is aware that this disciplinary culture of fear and repression is rooted in a political economy that treats people as objects and makes the accumulation of capital the subjects of history, he underestimates one important element of the new authoritarianism produced by casino capitalism. That is, what is novel about existing registers of discipline and control is that they operate in a new historical conjuncture in which the relationship among political power, cultural institutions and everyday life has become more powerful and intense in the ability to undermine the radical imagination and the power and capacities of individuals to resist repression and make the crucial decisions necessary to take control over the forces that shape their lives. The machineries of public pedagogy and consent have taken on an Orwellian presence in the age of digital technologies, and when challenges to authoritarian rule emerges, the state resorts to the overt and unapologetic repression of critical thought and dissent.

The anonymity of the corporate state becomes invisible as historical and public memory are erased and the American public is increasingly infantilized. Stupidity is normalized through a consumer/celebrity culture, and where that does not work, the machinery of state repression, with its endless culture of fear, punishes those willing to question authority. Authorities try to blind people to the courage exhibited by whistleblowers such as Chelsea Manning, Jeremy Hammond and Edward Snowden, painting them instead as traitors. Courage is now under attack by the sterile and dangerous call for unchecked security. Fear becomes the only value left in the arsenal of the machinery of surveillance, control and social death. David Graeber is right in arguing that the call for public dialogue, dissent and critical exchange in order to hold power accountable no longer provokes informed judgement and outrage among the public or thoughtful responses from politicians and popular pundits. On the contrary, he writes:

Objections to such arrangements are to be met with truncheons, lasers, and police dogs. It’s no coincidence that marketization has been accompanied by a new ethos where challenge is met with an instant appeal to violence. In the end, despite endless protests to the contrary, our rulers understand that the market is not a natural social arrangement. It has always had to be imposed at the point of a gun . . . The question to ask now is not, how do we bring it back. That’s impossible and quite undesirable. The question is what new forms of genuinely democratic self-organization might rise from its ashes? To even begin to ask this question we must first of all get rid of the police. [8]

American politics and culture have been handed over to the rich, lobbyists for the corporate elite, and now function largely to produce a state that offers the ultrawealthy and powerful all of the benefits they need to accumulate even more capital, regardless of the massive inequality in wealth, income and suffering such policies produce. In spite of being discredited by the economic recession of 2008, unfettered casino capitalism remains a dominant force and continues to produce runaway environmental devastation, egregious amounts of human suffering and the reinforcement of what Charles Ferguson has called “finance as a criminalized, rogue industry. [9] And, yet, while resistance to such measures is growing, it is far too weak to offer a significant challenge to the new authoritarianism.

All over the world, the forces of casino capitalism are invoking austerity measures that produce a kind of social and civil death as they dismantle the historically guaranteed social provisions provided by the welfare state, defining profit-making as the essence of democracy, expanding the role of corporate money in politics, waging an assault on unions, augmenting the military-security state, overseeing widening social inequality, promoting the erosion of civil liberties, and undercutting public faith in the defining institutions of democracy. The script is not new, but the intensity of the assault on democratic values, civic engagement and public service has taken a dangerous turn and provides the ideological, political and cultural foundation for a society that seems unaware it is in the midst of an authoritarian stranglehold on all of its most cherished institutions, ranging from schools and health care to the very foundation of democracy. Austerity has become the weapon of choice, an economic poison designed to punish the middle and working classes while making clear that casino capitalism will administer the most severe penalties to those who challenge its authority. The police have become the new private armies of the rich, designed to keep the public in check hoping to make them fearful of being exposed to police brutality, state violence or the expanding mechanisms of the multiple surveillance apparatuses that now collect every piece of information that circulates electronically. Conformity has become the order of the day and fear the new norm, reinforced by a disimagination machine and the punishing state now mutually informing each other.

Within the last 30 years, the United States has been transformed from a society that included a market economy subject to the rule of the state to a society and government that are now dominated almost exclusively by market values and corporate power. We now live in what Robert Jay Lifton once described as a “death-saturated age.” [10] Political authority and power have been transformed into a sovereignty of corporate governance and rule. The United States has moved from a market economy to a market society in which all vestiges of the social contract are under attack, and politics is ruled by the irrational notion that casino capitalism should govern not simply the economy but the entirety of social life.  With the return of the new Gilded Age, not only are democratic values and social protections at risk, but the civic and formative cultures that make such values and protections central to democratic life are in danger of disappearing altogether.

Public and higher education, however deficient, were once viewed as the bedrock for educating young people to be critical and engaged citizens. Schooling was valued as a public good, not a private right. Many educators in the ’70s and ’80s took seriously Paulo Freire’s notion of problematizing education, in which he called for students to be taught modes of critical literacy in which they could not only read the word but also read the world critically. [11] According to Freire, young people should be taught to read and write from a position of agency.  This meant learning how to engage in a culture of questioning, restaging power in productive ways, and connecting knowledge to the exercise of self-determination and self-development. Freire’s notion of critical pedagogy and education for freedom denounced banking education because it viewed students as passive containers into which knowledge was endlessly deposited. Rather than allow students to develop their own meanings, banking education assigned meanings for them, largely to memorize and spit out on intellectually bankrupt forms of testing. [12] Banking education is back with a vengeance and ironically parades under the name of educational reform, common standards and race to the top.   Public education has become a site of pedagogical repression, robbing students of the ability to think critically as a result of the two political business parties’ emphasis on education as mainly a project of mindless testing, standardization and the de-skilling of teachers. In addition, school reform has become a euphemism for turning public schools over to private investors who are more concerned about making money than they are about educating young people.  On the other hand, low-income and poor minority students increasingly find themselves in schools in which the line between prison culture and school culture is blurred.

Higher education, especially in the post-World War II period through the ’60s and ’70s, was, however ideally, considered a place where young people were taught how to think, engage in critical dialogue, and take on the responsibilities of informed and critical citizens. Now such students are subject to a technically trained docility, defined largely as consumers and told that the only value education has is to prepare them to be workers and consumers ready and eager to serve the ideological and financial interests of the global economy.  Critical thought and the radical imagination have become a liability under casino capitalism and for a growing number of institutions the enemy of public and higher education because they hold the potential to be at odds with the reproduction of a criminogenc culture in which greed, unchecked power, political illiteracy and unbridled self-interest work to benefit the wealthy and corporate elite. Under such circumstances, education becomes simply a business, developing an obsession with accountability schemes, measurable utility, authoritarian governing structures, and a crude empiricism for defining what counts as research.

How else to explain the following comment made by the president of Macomb Community College in Michigan: “Macomb is working with the federal government and other community colleges to better prepare students for the world that exists, not the world they want to live in.” [13] Or for that matter the blatant anti-intellectual bias imposed on colleges in Florida where Governor Rick Scott wants to push students toward business-friendly degrees by lowering tuition for academic fields and subjects that “steer students toward majors that are in demand in the job market.” [14] Of course, those areas such as philosophy, sociology, music, the arts, and other mainstays of the liberal arts would be more costly and their demise would intensify. Graeber argues that this assault on higher education has now become an object of intense state violence. He writes:

Make no mistake: to threaten someone with a stick is the ultimate anti-intellectual gesture. And if one thing has become clear in recent months, this is the first – really the only – impulse of the current government when faced with challenges to their vision for higher education. Police infiltration, surveillance, elected student leaders banned from political activities on campus, the arrest of students for simple acts of expression like chalking slogans on sidewalks, send a clear and constant message. There can be no reasoned discussion on these issues. There is no longer anything to talk about. Certainly, democracy has absolutely nothing to do with it. The pursuit of knowledge and understanding have been declared nothing but a consumer product, or else a form of technical training to increase overall economic productivity; these are the only way these matters can be discussed; if anyone wishes to gather to object to this, to gather in places of learning to insist that knowledge and understanding are not mere economic goods but something precious and valuable in their own right, they can only do so by permission of those who are telling them otherwise; otherwise, they can expect to be physically attacked. [15]

Similarly, higher education has become a dead zone for killing the imagination, a place where ideas that don’t have practical results go to die and where faculty and students are punished through the threat of force or harsh disciplinary measures for speaking out, engaging in dissent and holding power accountable. Faculty in most universities have been reduced to part-time jobs and function as indentured servants with no benefits, shockingly low salaries and no power to shape the conditions under which they work. With over 70 percent of faculty now holding the status of contingent labor, they are increasingly becoming one of the largest groups of professionals that qualify for food stamps to survive. These contingent and debt-ridden faculty live in a culture in which time is a burden rather than a luxury and have few opportunities to research, write and engage important social issues. At the same time, they live under both a survivalist mode and a culture of fear knowing that they can be dismissed arbitrarily at any time for the slightest infraction. Even tenured faculty are feeling the heat of a business-oriented de-democratizing university. For example, the Kansas Board of regents recently drastically curtailed tenure and academic freedom by claiming that both tenured and non-tenured faculty who used social media in ways that were not in the interest of the university, decided exclusively by the CEO of the university, were subject to dismissal. Speech that now impairs or reduces the university’s “efficiency” overrides the right of faculty to exercise free speech or address issues they deem socially and politically important.  For all intent and purposes, this signifies not only the end of tenure but academic freedom. Moreover, as William Black points out, “in both substance and dishonesty of presentation, the Regents’ policy is literally Orwellian.” [16]

How far is too far when it comes to religious accommodation?

Matthew Coutts, Daily Brew, January 9, 2014– Is it appropriate to allow university students decline to participate in a class assignment because it would force him to interact with female students, or should they be expected to set their “firm religious beliefs aside” in their search for higher education? And how should technology play into the decision?

That question is at the centre of a debate ongoing at Toronto’s York University, where a sociology professor and university brass have clashed over whether a student’s religious belief should allow him to skip class assignments that bring him into contact with women.

The debate stems from a decision made by Professor Paul Grayson in September, when a male student in an online sociology course asked to be excused from an in-person assignment that would bring him in contact with female students. The students claimed “firm religious beliefs” as his reason for not wanted to intermingle with female students.

Grayson denied the request on the ground that it marginalized and punished female classmates. York University officials, however, approved the student’s request for religious accommodation and ordered Grayson to allow the student to remain absent from the session.

The student acquiesced and ultimately completed the project. In the meantime, however, the professor and university have locked into a battle that could write the playbook for future arguments around religious accommodation.

“If for religious reasons you exempt a student from interacting with females, there are religious reasons people could advance for not interacting with blacks, Jews, gays, you name it,” Grayson told SunNews Network. “In the bible and in religious practice you can find a basis for that kind of appeal.”

University Provost Rhonda Lenton retorted in a statement that every accommodation request is considered on its own merits. She said the circumstances of this case led the university to conclude the accommodation could be made.

“A deciding factor in this case was that it was an online course where another student had previously been given permission to complete the course requirement off-campus,” Lenton announced. She later told CBC’s Metro Morning that, “Had it not been an online course, it is my view that … the advice that would have been given to the professor and to the student is that this is a course that is being delivered on campus and in person, and part of the assignments are to work with other students in the class.”

Lenton notes that another student was allowed to skip an in-person assignment, suggesting it was an accommodation the professor was willing to make under some circumstances. Grayson said in interviews that a student taking the course from Egypt had previously been shown leniency due to his or her distance from campus.

Indeed, details published in the National Post suggest that the student at the centre of the debate enrolled in the online sociology course out of a belief that it would allow him to finish his degree without intermingling with other students – specifically females.

If that is the case, then it could be seen as an attempt by the student to work within the framework of York – accommodate the university and its inclusive environment, you could say – to balance his religious beliefs with his desire to complete his degree.

It is not clear what religion the student holds, and Grayson has said he consulted several religious leaders before coming to his decision. It should be noted, however, that when the professor denied the accommodation request, the student agreed to participate without further complaint. He even thanked Grayson for the way he handled the situation.

Lenton said that while the student and teacher were able to come to an agreement, “the broader issue of religious accommodations in secular universities remains an important societal concern that warrants further discussion.” The Ontario Human Rights Commission is reviewing the case.

Part of that review should be the role technology has played in all of this. Is it truly reasonable to expect religious accommodation through online courses? Should such a course allow members of society to harbor personal beliefs that will surely come to a head later in life?

Regardless of whether the course is online or not, the student in question will graduate with a degree from York University. Is the school comfortable attaching their reputation to a student who may, upon entering the job market, beg out of meetings because female co-workers and bosses will be in attendance?

York University should have one set of standards across campus. Accommodation is important but reason should still be a factor, whether the student is logged on from home or sitting in a classroom.

CAUT, November 20, 2013– Open for Business: On What Terms examines twelve research and program collaboration agreements between universities, corporations, donors and governments to determine if universities have protected their academic integrity.

An agreement between UBC and Pfizer provides a good example of just how much the universities are willing to surrender.

The pharmaceutical industry’s investment in British Columbia is substantial. Pfizer alone has invested approximately $25 million in research and development in the province since 2007. Other drug companies, such as Takeda Pharmaceuticals and AstraZeneca,5 have donated funding to the Vancouver Prostate Centre (VPC) specifically. UBC and Vancouver General Hospital operate the VPC as a National Centre of Excellence and a Centre of Excellence for

Commercialization and Research, with numerous other partners, including Genome Canada, the Canadian Cancer Society, and the government of Canada, contributing in various ways. The collaboration with Pfizer is only one small part of the VPC’s work.

The agreement is not a public document. It was obtained for review through an access to information request, and significant portions of the initial research plan were redacted.

The agreement is silent on academic freedom. It may be presumed from this silence that, for UBC academic staff involved in the project, the academic freedom language of the UBC Faculty Association (UBCFA) collective agreement applies.9 However, as the VPC is a separate legal entity from UBC, there is significant ambiguity on this question. Can UBC faculty members whose research falls under the aegis of the VPC expect academic freedom in their work? We believe they can, and as such, the terms of the agreement threaten academic freedom.

The dissemination of research results is tightly controlled by the terms of the agreement.13 While the agreement recognizes “the traditional freedom of all scientists to publish and present promptly the results of their research,”14 it requires that any proposed publications be presented to Pfizer for review at least 45 days before submission to a third party. This period may be extended by an additional 30 days. If Pfizer finds any material in the publication objectionable, the parties “agree to work together to revise the proposed disclosure or remove or alter the Objectionable Material in a manner acceptable to the relevant Parties,”15 although in all cases the objectionable material must be removed.16 If either UBC or BCCA wish to publish research results that contain material that Pfizer finds objectionable, it must wait six months to do so.

CAUT, November 20, 2013– In their drive to attract new revenues by collaborating with corporations, donors, and governments, Canadian universities are entering into agreements that place unacceptable limits on academic freedom and sacrifice fundamental academic principles, according to a report released today by the Canadian Association of University Teachers (CAUT).

Open for Business: On What Terms examines twelve research and program collaboration agreements between universities, corporations, donors and governments to determine if universities have protected their academic integrity.

“Our findings should raise alarm bells on campuses across the country,” said CAUT executive director James Turk. “In the majority of the agreements we reviewed, universities have agreed to terms that violate basic academic values.”

According to Turk, seven of the twelve agreements provide no specific protection for academic freedom, and only one requires the disclosure of conflicts of interest. Only five of the agreements give academic staff the unrestricted right to publish their research findings and just half provide that the university maintains control over academic matters affecting staff and students.

“Universities have allowed private donor and corporate partners to take on roles that should be played by academic staff,” stated Turk. “They have signed agreements that side-step traditional university decision-making processes and undermine academic freedom.”

The report concludes by recommending a set of guiding principles for university collaborations to better protect academic integrity and the public interest.

“Collaborations can be beneficial to faculty, students, institutions, and the public, but only if they are set up properly,” Turk added.  “Universities owe it to the academic community and to the public to do more to safeguard the independence and integrity of teaching and research.”

Ubyssey Staff, The Ubyssey, November 6, 2013– Sauder School of Business dean Robert Helsley said at a press conference on Monday that he was still hopeful his students would fund the remaining $200,000 of the $250,000 commitment he coerced from the CUS leadership and told the the media about on Sept. 18 — before anyone had a chance to vote on whether to put the quarter of a million dollars toward unclear goals.

Since students just voted down the funding by a margin of three to one, this seems unlikely. And it’s understandable why they rejected the referendum: it’s a vague commitment to a vague and unnecessary position that was conceived only to placate the local and national media who pounced on Sauder after The Ubyssey broke the CUS FROSH rape cheer story.

This crude public relations stunt has failed. Stop trying to make fetch happen, Robert.

Anything Sauder does in response to the chant and the cultural problems it points to should be a well thought out and meaningful contribution to changing the atmosphere around sexual violence on campus and in the business school. The proposed curriculum changes Helsley has announced will require followup, but they seem like a good start.

Sauder also said they will bridge the gap in funding between what the CUS can pledge over their objection of their members — $50,000 this year, $100,000 over the next two years if they choose — and how much it would cost to hire a new counsellor, or whatever the money was planned to go toward. We’ll see.

“We’re looking for some leadership,” Helsley told the media.

Us too. Perhaps it’s time to look in the mirror, Bob.

A month and a rushed fact-finding report later, the administration at UBC remains entrenched solely in damage control. Curiously, the words “administration” and “administrator” do not appear in the fact-finding report [“student/s” appears 46 times].

Protect the brand! Especially now. Especially for commerce. No resignations, no accountability.

However, amidst the smoking guns and smoking pipes of politics back east, UBC’s rape chant is still making headlines.

On Oct. 31, the CUS rejected a referendum to approve a $200,000 allocation for student counselling and education on sexual abuse and violence.

Still talking but not walking, Helsley issued yet another statement that he was predictably “deeply disappointed.” Why? Maybe because it is time for Helsley to walk and for Toope to walk the talk.

From all optics, it is the students who are taking care of business — resigning, reflecting, self-governing, voting and regrouping. Students have realized that lines were crossed and are dealing with it. Given the rejection of the referendum, are the students simply saying they are dealing with their own behaviour?

Administrators, figure out what your role is for oversight of students in the 21st century. Enough of remaining “deeply disappointed” that students are not assuming your accountability.

There is an apparent culture of entitlement within Commerce. That may be why neither the president’s office nor the Sauder dean’s office have tendered resignations, cut salaries or revoked budget lines. We dare not conclude that atrocious chants originate or thrive within these cultures, yet one may draw conclusions that a culture of entitlement hurts accountability at the top in times like these.

This entitlement is apparent when faculty contracts are negotiated, with Sauder’s breakaway faculty association independently bargaining for bigger pieces of the pie for themselves; when the Sauder chief is appointed to oversee the University’s budget; and when its bloated administrative lines are sacred.

Yet to this moment in the throes of the rape chant controversy, not a single Commerce administrator has resigned, and the President has pulled not a single line.

What Contingent Faculty Can Learn From Fast-Food Workers #bced #yteubc

Brian Haman, Counterpunch, August 30, 2013 — It has become a truism in American higher education: seventy-five percent of undergraduate courses at U.S. colleges and universities are taught by contingent faculty1, most of whom lack health insurance,2carry onerous student debt,3 receive poverty-level compensation, and often rely on public assistance such as food stamps in order to make ends meet.4 This percentage translates into more than 1.3 million highly-educated, qualified, and competent, but poorly-paid, undervalued, and underappreciated American workers. Conversely, administrative costs at colleges have soared in recent years. The academic managerial class (provosts, vice and associate vice provosts, deans, presidents, vice presidents, etc.) routinely earn six-figure salaries, often with generous perks including vacation homes.5

According to U.S. Education Department data, “U.S. universities employed more than 230,000 administrators in 2009, up 60 percent from 1993, or 10 times the rate of growth of the tenured faculty, those with permanent positions and job security”.6 Most new hires on American campuses never even set foot in the classroom simply because they are not teachers but administrators.7 Furthermore, the cost of a college degree in the U.S. has increased by 1,120 percent since 1978.8 The overwhelming majority of the academic labor force (to say nothing of students, who voluntarily submit to indentured servitude in the form of student debt) suffers disproportionately due to enormous concentrations of wealth in the hands of a small and privileged elite.

We find a similar dynamic in other segments of the American labor force, especially in the fast-food industry. Fast-food workers endure low wages (and indeed wage stagnation), few if any benefits, and a scarcity of full-time contracts.9 The marginalized and contingent workforce at places such as McDonald’s, Wendy’s, and KFC share similar concerns and face similar challenges such as starvation wages, reliance on government assistance, and job insecurity that academic workers endure at some of our nation’s leading universities, including Harvard, Yale, and Michigan.10 However, unlike the academy, the difference between CEO compensation and fast-food workers’ pay is truly breathtaking. David C. Novak, CEO of Yum Brands, which includes chains such as KFC and Pizza Hut, received a total annual compensation of $29.67 million in 2012.11

According to the Wall Street Journal, “Last year, McDonald’s gave [Dan] Thompson a compensation package worth $13.8 million, or more than 558 times what McDonald’s expects employees to make — from two jobs”.12 The national minimum wage in the U.S. is $7.25 per hour and the top five largest employers (McDonald’s is among them) pay its workers at or near the minimum wage. We may reiterate the conclusion of the previous paragraph with one minor revision: The overwhelming majority of the fast-food labor force suffers disproportionately due to enormous concentrations of wealth in the hands of a small and privileged elite.

When faced with such systemic and structural inequalities, how have fast-food workers responded? The answer is quite instructive. They have staged local protests and walkouts in cities across the country and are planning a national walkout in order to fight for a higher minimum wage. As Professor Anne Kalleberg has noted, however, the protests are not union-sponsored but socially organized.13 Fast-food workers, just like their academic counterparts, often struggle to unionize due, at times, to explicit efforts by their employers to prevent them from doing so. Nevertheless, despite such grim circumstances, fast-food workers have pushed their plight quite successfully into the national consciousness just as Occupy movements have done.

Their campaign, entitled “Fast Food Forward”, articulates their purpose with self-assured clarity: “Fast Food Forward joins the momentum of the Black Friday strikes and other low-wage worker struggles to build community engagement, hold corporations and their CEOs accountable, and to raise wages so that all Americans can prosper”.14 Despite its origins in New York City, the movement is gaining momentum; many are now calling for a nationwide strike to take place on 29 August and even President Obama has addressed the issue.

How is all of this relevant for the contingent academic workforce? Well, for one thing, there is strength in numbers. Collective action is an especially effective instrument both to challenge and redress structural inequalities. If, as the aforementioned statistics indicate, seventy-five percent of undergraduate courses at U.S. colleges and universities are taught by adjuncts, then a walkout would bring the academy to a grinding halt. If fast-food workers with fewer career opportunities, less educational attainment, more grueling working conditions (e.g. fast-paced environments, high-temperature workplaces, etc.), and far more to lose can risk their only source of income for themselves and their families for the sake of the collective good, then what is preventing adjuncts from doing the same? The short answer is simple: nothing.

Alas, many adjuncts enable and perpetuate the “system” through their deferential subservience simply by participating in it (recent unionization efforts at Georgetown and elsewhere duly noted). As universities and departments downsize and the numbers of Ph.D. graduates outpace available jobs, many adjuncts accept grossly underpaid positions with long working hours and virtually no benefits with the expectation that a foot in the door will somehow lead to the promised land of a tenure-track position. Supply and demand dictates otherwise and the vast battalions of well-paid academic administrators are more than happy to continue to exploit such naïve and misguided expectations in the name of efficiency.

Surely, too, graduate programs inculcate (and indeed indoctrinate) students in the ways of the academy: publish or perish and do not rock the proverbial boat. On the one hand, academics are expected to challenge scholarly orthodoxies in their respective fields through creative, innovative, interdisciplinary scholarship. And yet in other aspects of their lives, namely those that deal with the contractual conditions under which they labor, they must conform and remain obedient in order to secure employment. It becomes an insidious and corrosive form of selection in which independent thought is filtered out of a system that was designed to protect it. Contradictions become self-evident: the imposition of an authorial canon in the humanities is anathema, whereas wage slavery becomes institutionalized.

Chan v UBC discrimination case sent back to BC Human Rights Tribunal

The University of British Columbia’s petition to dismiss Dr. Jennifer Chan’s complaint of racial discrimination must go back to the BC Human Rights Tribunal says a 29 May 2013 BC Supreme Court’s judgment. The BCHRT’s decision on 24 January 2012 to hear the Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case was moved to the Supreme Court for a judicial review. In addition to the BCHRT decision and Supreme Court judgment, the Ubyssey’s (UBC student newspaper) feature article provides a background to the case.

In the Supreme Court judgment, Madam Justice Loo argues that the BCHRT must assess whether “the complaint has been appropriately dealt with in another proceeding.” A decision within the BCHRT to hear the case must address UBC’s argument that “internal university processes [used to hear Chan’s appeals] qualified under the Code as ‘proceedings’ that had appropriately addressed the substance of” Chan’s complaint. Chan “asserts that she has exhausted the internal complaint mechanism of UBC and that it was flawed.”

If there’s any doubt about the value of these programs, there won’t be after you see some of the phenomenal work that’s been created by current and former students. Not only is this a blow to technology and innovation, it also limits the ability of students in other departments to collaborate with someone in the industry. The instructors in this department are both brilliant and motivated to help their students achieve success in the field of computer science from programming to web design and basic computing. They should be praised for their dedication in spite of all these funding cuts… If these Cuts are allowed to take place Students will be Robbed of an Important Educational aspect, which leads to the question:

Academia’s Indentured Servants

Sarah Kendzior, Aljazeera, April 11, 2013– On April 8, 2013, the New York Times reported that 76 percent of American university faculty are adjunct professors – an all-time high. Unlike tenured faculty, whose annual salaries can top $160,000, adjunct professors make an average of $2,700 per course and receive no health care or other benefits.

Most adjuncts teach at multiple universities while still not making enough to stay above the poverty line. Some are on welfare or homeless. Others depend on charity drives held by their peers. Adjuncts are generally not allowed to have offices or participate in faculty meetings. When they ask for a living wage or benefits, they can be fired. Their contingent status allows them no recourse.

No one forces a scholar to work as an adjunct. So why do some of America’s brightest PhDs – many of whom are authors of books and articles on labour, power, or injustice – accept such terrible conditions?

“Path dependence and sunk costs must be powerful forces,” speculates political scientist Steve Saidemen in a post titled “The Adjunct Mystery“. In other words, job candidates have invested so much time and money into their professional training that they cannot fathom abandoning their goal – even if this means living, as Saidemen says, like “second-class citizens”. (He later downgraded this to “third-class citizens”.)

With roughly 40 percent of academic positions eliminated since the 2008 crash, most adjuncts will not find a tenure-track job. Their path dependence and sunk costs will likely lead to greater path dependence and sunk costs – and the costs of the academic job market are prohibitive. Many job candidates must shell out thousands of dollars for a chance to interview at their discipline’s annual meeting, usually held in one of the most expensive cities in the world. In some fields, candidates must pay to even see the job listings.

Given the need for personal wealth as a means to entry, one would assume that adjuncts would be even more outraged about their plight. After all, their paltry salaries and lack of departmental funding make their job hunt a far greater sacrifice than for those with means. But this is not the case. While efforts at labour organisation are emerging, the adjunct rate continues to soar – from 68 percent in 2008, the year of the economic crash, to 76 percent just five years later.

Contingency has become permanent, a rite of passage to nowhere….

Is academia a cult? That is debatable, but it is certainly a caste system. Outspoken academics like Pannapacker are rare: most tenured faculty have stayed silent about the adjunct crisis. “It is difficult to get a man to understand something when his job depends on not understanding it,” wrote Upton Sinclair, the American author famous for his essays on labour exploitation. Somewhere in America, a tenured professor may be teaching his work, as a nearby adjunct holds office hours out of her car. On Twitter, I wondered why so many professors who study injustice ignore the plight of their peers. “They don’t consider us their peers,” the adjuncts wrote back. Academia likes to think of itself as a meritocracy – which it is not – and those who have tenured jobs like to think they deserved them. They probably do – but with hundreds of applications per available position, an awful lot of deserving candidates have defaulted to the adjunct track.
