Higher Racism: The Case of the University of British Columbia— On the Wrong Side of History but Right Side of Optics

Here’s a summary of the article: UBC faculty, staff, and students commonly question senior managers’ assertions that “diversity is our strength.” If, counter to the cliche, diversity is not our strength, then what is it? This type of assertion may play well for a political audience but with insider knowledge, the reality is quite different. Insider knowledge is an effective antidote to confusions of audience and duplicitous speech. With this in mind, we analyzed UBC managers’ messaging and optics in matters of anti-Black racism. In conclusion, we don’t buy it and provide dozens of examples of where the rhetoric falls short of reality. We suggest that without action and real results, the optics seem insincere. Hence, senior managers are complicit in anti-Black racism at UBC.

Here’s the argument: What Robyn Maynard (2017) infers from history education practices in Canada sums up the case of UBC: “a discernable lack of awareness surrounding the widespread anti-Blackness that continues to hide in plain sight, obscured behind a nominal commitment to liberalism, multiculturalism and equality” (p. 30). Hence, in this case of UBC, we provide various examples of how the institution functions through racial bias and prejudice but argue that leaving the explanation to structural or systemic racism makes it too easy to deny elite individual and everyday racism, especially racist attitudes and decisions of the managers and their means of employment discrimination (i.e., blocking and undermining racial minorities’ access to career advancement and opportunities).

Here’s the conclusion: Anti-Black racism in higher education requires specific attention to history and action, whether affirmative or equitable. We argued that elite racism and everyday racism experienced by African ethnic and diasporic faculty, staff, and students and made visible through demographic data can no longer be dismissed or overlooked. Through the case of UBC, we demonstrated various ways in which the higher racism of managers works to maintain individual and systemic discrimination. Preferences of managers for image and optics over action— surface over substance— is especially shallow in this era of Black Lives Matter. We also raised questions of the logic of popular shortcuts to intersectionality (e.g., IBPOC) and stand with scholars explaining that therein, equity claims of African ethnic and diasporic faculty, staff, and students are readily deprioritized or marginalized. Code-switching has its limits. At UBC is an established record of defending middle and senior managers’ inequitable, and often enough for concern, racist, practices. Cases introduced by racial equity seeking individuals are routinely deferred, dismissed, or misdirected to external agencies, where again senior managers agitate to request dismissal of the complaints. Finally, we articulated concerns that managers are preferring to isolate and shield themselves from critical conversation and critique. Critics of problematic and racist practices risk disciplinary measures as managers grow increasingly intolerant of commentaries on mismanagement and whistleblowing.

#UBC Dean Search shut down and Advisory Committee dissolved

Responding to a Petition and attached Letter (below) questioning the decision to exclude an extremely competitive African Canadian applicant from the shortlist in the search for a new Dean of Education at UBC, President Ono shut down the search and dissolved the Advisory Committee. The UBC President also indicated that Provost and Committee co-Chair Ananya Mukherjee Reed resigned from the Committee, seemingly in support of the conclusions and questions raised by the Petition and its 150 signatories.

On 9 December 2020, the UBC President wrote to faculty, staff, and students:

Yesterday, I received Prof. Ananya Mukherjee Reed’s resignation as co-chair from the President’s Advisory Committee for the Recruitment of a Dean for the Faculty of Education. This is effective immediately. I met with the PAC Committee yesterday and heard from members regarding the viability of the search moving forward, and they felt that the search could not proceed. After careful consideration and consultation with the Committee, I have decided to end the current search for a new Dean at this time.

Of course, it is extremely rare for a Dean search to be cancelled in response to grass roots efforts. It is certainly a step in the right direction of accountability. A next step is answering the various questions raised about this Advisory Committee: Why did they do what they did? In the midst of Black Lives Matter, why did they exclude a competitive African Canadian applicant?

This Letter and attached Petition are in response to the President’s Advisory Committee for the Selection of the next Dean of the Faculty of Education’s decision to exclude Dr. Samson Nashon from its shortlist. I write on behalf of the 150 faculty, students, staff, alumni, emeriti, and community members who signed this Petition to add Dr. Nashon to the shortlist. The Petition identifies flawed procedures underwriting the President’s Advisory Committee’s decision. For example, the Committee excluded African Canadian faculty, staff, and students

The University of British Columbia’s Strategic Plan, Shaping UBC’s Next Century, emphasizes “our intention to be a leader in diversity and equity” (Strategy 1: Great People, p. 41). Leadership in diversity and equity entails fighting against racism at all levels of administration, research, service, and teaching.

The 150 signatories to this Petition expect action to back up the commitments. We hope that you will address our collective concerns, convey them to the President’s Advisory Committee, and consider what can be done to redress the problem and rectify the injustice. This raises a serious procedural question of how a Committee that excluded Dr. Nashon from the shortlist can now fairly include and consider his candidacy?

The Petition with signatories is attached. On behalf of this groundswell of support for Dr. Nashon’s candidacy, thank you very much for addressing our concerns and request.

150 signatories call #UBC search committee for Dean of Education to account

In a show of solidarity today, 150 signatories submitted a petition to University of British Columbia President Ono to account for a decision to disregard Dr. Samson Nashon‘s application for Dean of the Faculty of Education. The petition calls for the UBC President to correct procedural and evaluative oversights of an Advisory Committee (16 members):

As the Black Lives Matter movement called higher education practices into question, President Ono communicated to faculty, staff, and students on June 1st, 2020: “I encourage you to think about the role you can play in fighting racism.” This petition is in the spirit of that fight.

We are concerned with the process of finding a new Dean of the UBC Faculty of Education. The President’s Advisory Committee charged with this task seems not to have taken into account the groundswell of support for Dr. Samson Nashon. Apparently, the Committee ignored the overwhelming evidence in his support from the process of shortlisting. Up through a communication indicating Dr. Nashon’s exclusion from the shortlist on November 20, over five months have passed since the Advisory Committee’s last communication to the faculty, staff, and students (on June 9, 2020). Short of a problematic election for faculty members on the Committee (only 4 Committee members out of 11 were voted in by the faculty members), faculty and staff had little input into the Committee’s composition. Consequently, the President’s Advisory Committee excluded ALL African Canadian faculty, staff, and students.

Colleagues reviewing Professor Nashon’s application for this search for a Dean of the Faculty of Education and faculty, staff, and students recommending him to the Advisory Committee via Boyden Vancouver know full well his competitive qualifications. They meet and exceed those of many Education Deans across Canada, including UBC. Why were these qualifications seemingly overlooked? Dr. Nashon was encouraged to apply by Boyden, but was then excluded from the shortlist. What does the recruitment of an African Canadian applicant mean, if the goal is merely to enrich the pool of applicants for the sake of optics?

For too long and in too many instances, UBC senior managers have created Advisory Committees that excluded and under-valued well qualified African ethnic and diasporic applicants, who are internal to the university, for leadership positions across UBC campuses. These practices account for the lack of diversity in the demographic of senior and middle management ranks in Education and elsewhere on the two campuses.

Given this, we submit this petition requesting Professor Samson Nashon be added to the shortlist for the Dean of the Faculty of Education Search.

Out of Asia: Topologies of Racism in Canada

ABSTRACT: This case study recounts my harrowing experience through a great Canadian equity swindle—involving two internal university equity investigations, BC Human Rights Tribunal, and the BC Supreme Court—to bring to account a deeply flawed and allegedly discriminatory academic hiring process. BCHRT’s decision on 24 January 2012 to hear the Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case (21 December 2010 HRT decision24 January 2012 HRT decision) was moved to the Supreme Court for a judicial review (see The Ubyssey’s [UBC student newspaper] feature article for the backstory to the case). The Supreme Court then ordered the BCHRT to review its initial decision (29 May 2013 BC Supreme Court judgment). The BCHRT turned and dismissed the case on 19 December 2013.

*Note: Exactly what was “recalibrated” through the “Review” is unclear. Comparatively, when advertised in 2005 and 2009, the Name of the Chair was the “David Lam Chair in Multicultural Education.” The April 2016 Ad or CFA still indicates the same. So the Chair title was not recalibrated. In 2005 and 2009, the search sought scholars who contributed to multicultural education and now in 2016 the search seeks scholars who contributed to multicultural education and “social justice studies” so that was not recalibrated. One could readily argue that multicultural justice and social justice are interchangeable. In 2005 and 2009 multicultural education was not defined but in 2016 a definition of multicultural education is given: “commitment to anti-oppression, anti-racism, intersectionality, and decolonization.” But that does not appear to be a recalibration inasmuch as it just gives a definition.

More bucks than brains: James Ramey and the ruination of the University of Louisville

In the late 1990s, Kentucky’s legislature initiated a program to upgrade and reform the state’s postsecondary education system, it was called “Bucks for Brains.” (The state’s promotional tagline at the time was “Open for Business.”)

I was recruited to the University of Louisville in 2001 and spent two-and-a-half years on the faculty there as a department chair and distinguished university scholar, which gave me an up close and personal experience with a university administration that’s, as they say where my family’s from, sigogglin.

John W. Shumaker, a classics scholar, was UofL president when I arrived and he proved to be an incredible fund raiser, increasing the university’s endowment from under $200 million to $550 million.

Of course, the UofL has long been the recipient of corporate largesse, especially from the Louisville’s corporate giants Brown-Forman (one of America’s largest spirits and wine companies); Brown & Williamson (which chemically enhanced the addictiveness of cigarettes, remember whistleblower Jeffrey Wigand? No? Well I’m sure you remember Russell Crowe playing Wigand the blockbuster movie The Insider); Papa John’s Pizza (UofL football Cardinals play in Papa John’s Cardinal Stadium); and Yum! Brands (“feeding the world” crap food via KFC, Pizza Hut, and, of course, Taco Bell, more on the Mexican connection later).

After Shumaker left to head up the University of Tennessee (where he resigned in disgrace after 3 years), he was replaced by James R. Ramsey, who had been Kentucky’s state budget director under Gov. Paul E. Patton (who became wealthy by exploiting Kentucky’s coal miners).

Patton’s major achievement as governor was overhauling postsecondary education in the Kentucky. But Patton’s political career was de-railed by duelling scandals: (1)  an extramarital affair and a sex-for-favors scandal; and (2) pardoning four of his political advisers who were indicted for violating Kentucky’s campaign finance laws and for allegedly abusing his patronage powers.

All of this is just everyday Kentucky politics, so Patton wasn’t distracted enough to forget he had to find a soft-landing for his budget director, thus Ramsey, with no university administration experience, became the 17th president of the University of Louisville.

Since Ramsey has been in office the UofL, in endowment has continued to grow and is now pushing the $1 billion mark, which is really the only logical explanation for why he hasn’t been bounced because Ramsey’s administration has more ethical lapses than Carter has liver pills, pretty much proving that the UofL has more bucks than brains.

Robert Felner: Former Dean, Convicted Felon

Felner arrived in Louisville with some spiffy credentials: PhD in psychology from Yale; former head of the department of psychology at the University of Illinois; a CV packed with pages upon pages listing his publications in top journals and, most importantly for the UofL administration, a staggering number of grants.

Despite several red flags about Felner’s candidacy for dean of UofL’s College of Education and Human Development, Ramsey and his long time provost, Shirley Willihnganz, couldn’t wait to get Felner on campus.

Ramsey was in such as rush to land Felner he and Willihnganz forgot to tell the interim dean (and other finalist for the position) they hired Felner, so he was left to discover the decision when Felner call his secretary and started giving her instructions. So much for that HR seminar!

Things in CEHD soon started to fall apart.

I resigned from my department chair position two weeks after Felner took over as dean and later moved to UBC.

Within a few years, there had been 30 grievances filed by faculty and students against Felner for a wide range of abusive managerial practices and a faculty vote of no-confidence in Felner’s leadership of the CEHD. Reasons given by faculty for the vote of non-confidence included:

Public humiliation of faculty, work place harassment, retaliation for voicing opinions, little or no governance, decisions that hurt College, unacceptable and unfair hiring practice; rude, offensive, unethical behavior by CEHD representatives; denial of support for research to those who differ in opinion; and extreme inequity of pay. Despite the abominable conditions in CEHD, UofL Provost Willihnganz and Ramsey both supported Felner publicly.

One year after the vote of no-confidence, Felner announced he was leaving the UofL to become president of the University of Wisconsin, Parkside.

The Chronicle of Higher Education described Felner as “riding high” a couple of years into his deanship at UofL, well-paid, and having secured a $700,000 grant from the US Department of Education. However, he “pressed his luck” during his last weeks in Louisville.

Even though only $96,000 remained in the account, he implored Louisville officials to approve a $200,000 subcontract with a nonprofit organization in Illinois that had already received $450,000 from the grant. Perhaps, he suggested, the university could draw on a special fund that had been established by the daughter of a former trustee.

The Illinois group, Mr. Felner said, had been surveying students and teachers in Kentucky. That survey would “let us give the feds something that should make them very happy about the efficiency and joint commitment of the university to doing a good job with an earmark, as I know we will want more from this agency,” he wrote in an e-mail message on June 18.

But on June 20, his last day as Dean of CEHD before he headed off to Wisconsin, those big black SUVs with government plates (like the ones you see on Criminal Minds) rolled into the CEHD parking lot. US Secret Service, US Postal Inspectors, and UofL Police questioned Felner and escorted him off campus, along with his computers and records.

There was a simultaneous raid on UW-Parkside to confiscate material Felner had shipped ahead of his arrival there.

In October 2008, a federal grand jury indicted Felner on nine counts of mail fraud, money laundering, and tax evasion. According to the indictment,

the Illinois nonprofit group, known as the National Center on Public Education and Prevention, was simply a shell that funneled money into the personal bank accounts of Mr. Felner and Thomas Schroeder, a former student of his and the group’s “executive director.” Prosecutors say the two men siphoned away not only the $694,000 earmarked grant, but also $1.7-million in payments from three urban school districts, money that ought to have gone to the legitimate public-education center that Mr. Felner had created in Rhode Island.

In January 2010, Felner pleaded guilty to nine Federal charges, including income tax evasion.

In May 2010, Felner was sentenced to 63 months in US Federal Prison for his role in defrauding defrauding the UofL and the University of Rhode Island, where he had been director of the School of Education, of $2.3 million of US Department of Education funds earmarked for No Child Left Behind Act research.

Felner Footnotes: Indians, John Deasy, Non-Disclosure Agreements & Ramsey as the Frito Bandito

(1) When Felner announced his resignation, UofL president Ramsey wroted to Felner and said he was worried about “letting the Indians get back in control of the reservation.” That’s some serious respect for university faculty and the idea of shared governance, eh?

(2) Los Angeles school superintendent, John Deasy, has had his academic credentials called into question. Deasy was given a PhD by the University of Louisville after he was enrolled for four months and received a total of nine credits.

Deasy’s doctoral advisor was, surprise, Robert Felner! Deasy had previously awarded $375,000 in consulting contracts to Felner, while Deasy was Superintendent of Santa Monica schools.

Ramsey appointed a “blue-ribbon” panel to investigate Deasy’s degree. The panel found that getting a PhD in four months at the UofL was not cause for concern, thus plunging the UofL’s academic reputation down into the neighbourhood of fly-by-night for-profit “higher” education.

Deasy is now working in an unaccredited training program sponsored by educational de-formers the Broad Foundation, which teaches school leaders business methods and supports charter schools and closing public schools.

(3) Ramsey has been making double retirement payouts to UofL administrators for their silence.

Records show that the school paid a full year’s salary to outgoing vice presidents Michael Curtin ($252,350) and Larry Owsley ($248,255) and to assistant to the president Vivian Hibbs ($66,391) to induce them not to “disparage, demean or impugn the university or its senior leadership.”

In March 2014, UofL made a $346,000.00 settlement with university counsel Angela Kosawha:

The University of Louisville is paying another large settlement in connection with the retirement of a high-ranking official — this time, $346,844 to its top lawyer. University counsel Angela Koshewa is on a three-month leave of absence before she officially retires June 1. Documents obtained under the Kentucky Open Records Act show the university is paying Koshewa — who has questioned some expenditures and proposals backed by President James Ramsey and Dr. David Dunn, the executive vice president for Health Affairs — twice her final salary.

It costs a lot for Ramsey to cover up details of his administration’s incompetence and shenanigans, but remember there are lots of bucks at UofL.

(4) Provost Shirley Willihnganz stepped down as UofL provost earlier this year. The Louisville Courier-Journal reported that

Under her watch, however, university employees have stole, misspent or mishandled at least $7.6 million in schemes at the health science campus, the law school, the business school and the athletic department’s ticket office.

Willihnganz also was criticized for approving about $1 million in buyouts for former high-ranking employees, some of which included agreements not to disparage the university or its leaders.

She also was forced to apologize to CEHD faculty in 2008 for failing to take any common-sense action against Felner for his intimidation, harassment, humiliation and retaliation against faculty, staff, students and alumni.

Willihnganz said at the time that she tended to dismiss the early complaints against Felner — including a no-confidence vote by faculty — because he was a “high performer” and because the complaints came from professors and staff “entrenched in their ways and resistant to change.”

She later told faculty at a meeting that she was sorry. “Mostly what I think I want to say is people have been hurt and something very bad happened, and as provost I feel like I am ultimately responsible for that,” she said.

No duh! She actually is directly responsible for the Felner disaster (along with Ramsey), that’s probably why she feels that way. And speaking of resistance to change …

(5) This next item has nothing to do with Felner, except that his former boss and advocate, James Ramsey, is also the long time boss of UofL basketball coach Rick Pitino who admitted to having sex with a women in a swanky Italian restaurant in Louisville. Apparently that’s not a problem with Ramsey and the UofL because Pitino said it wasn’t rape.

And, now Pitino is using hookers and strippers to recruit high school basketball players to come to the UofL. See Dave Zirin’s pieces on the latest Ramsey supervised scandal:

(6) And I almost forgot. Remember the Taco Bell/Mexican connection. This week Ramsey had a little halloween party at the UofL. Ramsey goes racist (again). Yes, he dressed up like the Frito Bandito.

U Illinois urged to reinstate prof Salaita, critic of Israeli war in Gaza

Democracy Now!, September 9, 2014– As the fall school term begins, an Illinois college campus is embroiled in one of the nation’s biggest academic freedom controversies in recent memory. The University of Illinois at Urbana-Champaign has sparked an outcry over its withdrawal of a job offer to a professor critical of the Israeli government. Steven Salaita was due to start work at the university as a tenured professor in the American Indian Studies Program. But after posting a series of tweets harshly critical of this summer’s Israeli assault on Gaza, Salaita was told the offer was withdrawn. The school had come under pressure from donors, students, parents and alumni critical of Salaita’s views, with some threatening to withdraw financial support. Thousands of academics have signed petitions calling for Salaita’s reinstatement, and several lecturers have canceled appearances in protest. The American Association of University Professors has called the school’s actions “inimical to academic freedom and due process.” A number of Urbana-Champaign departments have passed votes of no-confidence in the chancellor, Phyllis Wise. And today, Urbana-Champaign students will be holding a campus walkout and day of silence in support of Salaita. We are joined by two guests: Columbia University law professor Katherine Franke, who has canceled a lecture series at Urbana-Champaign in protest of Salaita’s unhiring; and Kristofer Petersen-Overton, a scholar who went through a similar incident in 2011 when Brooklyn College reversed a job offer after complaints about his Middle East views, only to reinstate it following a public outcry.

A news conference is being held, where Salaita is expected to make his first public comments since his unhiring last month.

AMY GOODMAN: In a public statement, Chancellor Phyllis Wise said her decision to unhire Salaita “was not influenced in any way by his positions on the conflict in the Middle East nor his criticism of Israel.” She goes on to write, quote, “What we cannot and will not tolerate at the University of Illinois are personal and disrespectful words or actions that demean and abuse either viewpoints themselves or those who express them,” unquote. The school has now reportedly offered Salaita a financial settlement for his troubles. The school’s Board of Trustees is expected to take up the controversy at a meeting on Thursday.

For more, we’re joined by two guests. Kristofer Petersen-Overton is an adjunct lecturer of political science at Lehman College. In 2011, Brooklyn College initially decided not to hire Petersen-Overton as an adjunct professor for a seminar on Middle East politics. But the school reversed its decision after criticism that the decision was politically motivated. And Katherine Franke joins us. She’s a professor of law at Columbia University and the director of the Center for Gender and Sexuality Law. She recently canceled a lecture series at the University of Illinois at Urbana-Champaign in protest of Steven Salaita’s unhiring.

Professor Franke, let’s begin with you. Talk about the facts of this case and how you got involved.

KATHERINE FRANKE: Well, Professor Salaita was previously a professor at Virginia Tech University, and he had a well-known dossier of books and articles thinking critically about the relationship between indigeneity, meaning native people, and the political environments in which they live—hard questions about dispossession, belonging, state violence and identity. And because of that important scholarly record, the University of Illinois went after him—in a friendly way, unlike what they’re doing now. And he was hired by an overwhelming vote by the American Indian Studies Program there in the normal way that we hire faculty in universities. An offer letter was issued to him. He accepted it. They paid for his moving expenses. He quit his job, a tenured position in Virginia. And he has a small child and a family and a wife, and was ready to move. His course books had been ordered. He had been invited by the university to the faculty welcome luncheon.

And then, on August 1st, he got a letter from the chancellor saying, “We’re sorry, we’re not going to be able to employ you here, because I haven’t taken the last step, which I had not informed you about before, of taking your candidacy to the Board of Trustees.” He had assumed he had an accepted job offer. He had relied on that offer—and at his peril. He now doesn’t have a home, doesn’t have a job and doesn’t have an income.

So what we now have learned, through a FOIA request and the disclosure of emails at the university, is that there was enormous pressure put on the chancellor and the Board of Trustees by large donors of the university, who said, “I’ll take my six-figure donations away if you hire this guy.” And this is as a result of some tweets that Professor Salaita made over the summer during the heat of the Gaza—the Israeli assault on Gaza. He was very upset about it. He himself is Palestinian. He was watching children die and the destruction of Gazan villages that we all watched. And like many of us, he was quite impassioned and used colorful language on Twitter to express his views, and that those tweets somehow made their way to donors at the University of Illinois. And so, the job, as been described even here in the setup, is either withdrawn or somehow not—well, what has happened is he’s just been fired. And so he’s now organizing, along with the rest of us, a response to what is a deliberate campaign by a number of political operatives who put pressure on universities like the University of Illinois to censor critical scholarship, critical comments, critical research about Israeli state policy.

Sahil Chinoy and Adriann Dinolfo, Daily Californian, February 13, 2014–UC President Janet Napolitano has been protested across her tour of the UC system, and her visit to UC Berkeley proved no different as individuals from several campus coalitions coalesced in two separate demonstrations Thursday – one continuing into the night – to express their discontent.

As of 1 a.m., the demonstrations remained ongoing, although a diminished version of earlier iterations, with about 30 to 40 protesters outside the Blum Center for Developing Economies, inside of which nine students have locked themselves.

BAMN, a group that advocates for immigrant rights, began the first round of protests at 10 a.m. with a small group of about 15 people outside Sutardja Dai Hall. Three hours later, about 150 people gathered on Upper Sproul Plaza for another protest led by the Students of Color Solidarity Coalition.

Both groups expressed disapproval of Napolitano’s history of deportation as the former Secretary of Homeland Security and of her nonacademic background.

Jasmene del Aguila, a UC Berkeley freshman watching the Sproul Plaza protest, said she supported the demonstrators because she knows undocumented students attend the university, adding that these individuals should have the same opportunities as other students.

In comparison, Nic Jaber, a UC Berkeley sophomore who also observed the protest, was not convinced the SCSC had the right strategy.

“Whether or not she enforced immigration has nothing to do with her proclivity to be our UC president,” Jaber said. “She’s trying to work with us, and we just keep slapping her in the face.”

The protesters then marched through campus and blocked the entrance of the Blum Center, near where BAMN was still stationed.

Nine SCSC students entered the Blum Center about 2:40 p.m., chaining the door and locking themselves inside, according to SCSC organizer and UC Berkeley alumna Natalie Sanchez. She added that the students are risking arrest, and some are risking deportation.

The protesters have three demands to the administration: that individuals inside the building receive amnesty, that Chancellor Nicholas Dirks call for Napolitano’s resignation and that those in solidarity cancel classes Friday and “build a strike.”

Cindy Oliver, CAUT Bulletin, January 2014– English Language Training (ELT) programs play an increasingly critical role in Canada’s post-secondary institutions as the diversity and complexity of our student population changes, and with it, the need to address those changes with programs that strengthen language proficiency. Although post-secondary education is primarily a provincial responsibility, the federal government plays a crucial role in the funding of ELT programs across the country. And it’s the looming cuts to the federal government’s contribution to those programs that has united British Columbia’s student organizations and the Federation of Post-Secondary Educators to pressure governments to take a different approach.

On Dec. 16, the federation, along with the BC division of the Canadian Federation of Students held a press conference at the Vancouver Community College’s (VCC) downtown Vancouver campus to announce plans to launch a province-wide campaign to pressure the federal and provincial governments to protect the funding arrangement that sees close to $20 million in federal funding flow through BC’s Ministry of Advanced Education to support a range of ELT programs in BC institutions.

It was no coincidence the press conference was held at the Vancouver campus of VCC; it is the largest provider of ELT programs in western Canada. It’s a role that VCC has excelled at for more than 40 years. And it has become something of a professional hub for a growing number of international students who have come to Canada to begin a new life, but need to strengthen their English language skills to ensure they can fully participate in their new country.

On hand for the press conference was Saeideh Ghassarifar, a foreign trained doctor who enrolled at VCC after immigrating to Canada from Iran. During media interviews, Ghassarifar pointed out she has an extensive educational background in her chosen field — she has three degrees, including a PhD in health care education — but she recognizes that her English language skills need to be much stronger. As she said in one interview, “as a doctor I need to understand and be understood when I am dealing with patients.” For her, the VCC English language programs are critical to her ultimate success in this country.

However, the very programs Ghassarifar accesses at VCC are under threat if the federal government moves ahead with its plans to withdraw funding currently in place under a long-standing federal-provincial settlement services agreement. It is through that agreement that BC receives close to $20 million in federal funding that eventually works its way into ELT programs at institutions like VCC. The change to the settlement program in BC, if it goes ahead as announced, would take effect on April 1, 2014.

The federal government’s rationale for cutting the funding makes no sense. Prime Minister Stephen Harper’s austerity rhetoric has permeated every aspect of life in Canada, from oversight of the environment to the muzzling of federal government researchers and scientists. In every case, Harper’s approach has been to diminish the capacity of government to provide information and services that would fulfill the federal government’s part of the social contract with Canadians, a contract that should respect our rights as citizens while ensuring sustainable and balanced growth is shared. During his ten­ure as Prime Minister we have seen no evidence that he intends to keep up his side of the contract.

Just as troubling, however, is that Harper’s reneging on the $20 million in funding for BC programs comes at a time when the pro­vincial government’s commitment to post-secondary education has come under enormous pressure. For most of the past 12 years, core funding of BC’s public institutions, like in many other provinces, has simply not kept pace with the demands of increased enrolment or system-wide cost pressures. Add in the fact that government policy shifts that have allowed tuition fees to skyrocket over that same period — in BC the average undergraduate tuition fee has more than doubled — and the pressures on access and affordability have simply added more barriers to the education that government, business leaders and the broader community all know are critical to our collective success as both a province and a country. Notably, the BC Business Council — hardly a left-wing think tank — has pointed out on numerous occasions that 75 per cent of all new jobs in BC will require some form of post-secondary education (a degree, diploma, certificate or completed apprenticeship). The council notes that currently only two-thirds of BC’s labour force has that education.

The cuts in funding for English language programs are a step backwards. They will hurt students, the very people that BC and Canada need to support and encourage. Our campaign will focus on their stories and highlight the urgent need to keep ELT funding in place. Working together with allies and the broader community we are confident we can make a difference.

In a previous blog on UBC Professor Jennifer Chan’s complaint of racial discrimination in her application to the David Lam Chair in Multicultural Education, I suggested a few things:

  • Given that the term of the current Lam Chair expired, it should itself should be left vacant, without a faculty member holding for two years.
  • With administrative terms winding down, the spring will be time for our new Dean, closing in on his third year, to ‘shuffle the cabinet’ and appoint a new administration to take affirmative action on racial equity in Education.

Questions were raised about why I said “time for reflection” when I should have said time for action on racial equity. Point taken.

In Canada, climbing the Ivory tower has never been harder. More people graduate with PhDs, but full-time tenure track faculty positions are harder to get. Many highly educated Canadians struggle to find adequate-paying work that meets their credentials.

And for those who dream of chalk-boards, lecture halls, and tweed jackets… the best they can get is work as a part-time instructor.

It’s estimated that about half of all teaching in the country is done by contract professors — instead of permanent full time professors.

The case law assembled for this will be indispensable to future complainants on employment equity and protected ground of human rights:

The term of the 2009 awardee of the David Lam Chair expired in December 2013.  Respondents in this case (Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney) finished or are winding down their terms. It is time for the Faculty of Education to phase in a period for reflection on racial equity within the ranks. The Lam Chair should itself should be left vacant, without a faculty member holding for two years. Leaving a Chair vacant is not at all uncommon in Universities. In Education, for example, the David Robitaille Chair in Mathematics, Science, and Technology has been dormant and vacant since 2010. With administrative terms winding down, the spring will be time for our new Dean, closing in on his third year, to ‘shuffle the cabinet’ and appoint a new administration to take affirmative action on racial equity in Education.

Sarah Bigam, The Ubyssey, January 15, 2014– The B.C. Human Rights Tribunal has dismissed the complaint of a UBC education professor who says she was the victim of racial discrimination.

Jennifer Chan argued she was denied appointment to the David Lam Chair in Multicultural Education, which was granted to a white candidate, in part because she is Chinese-Canadian. The tribunal dismissed her complaint after four years of legal proceedings.

On Dec. 19, tribunal member Norman Trerise determined that, based on the evidence before him, the case had no reasonable chance of success at a hearing.

“There is really nothing to support that race, colour, ancestry or place of origin played a role in the outcome of the selection process,” Trerise wrote.

He determined that the decision likely came down to the differences between the hiring committee and Chan’s definitions of multiculturalism, since “breadth of representation of multicultural education” was a criterion for the position.

Chan asserts that five of the six members of the hiring committee were not experts in multiculturalism.

“It’s huge pity because if [Trerise] had moved the case to hearing, then obviously the crucial thing would have been to hear the experts in the field, which the hiring committee never did,” Chan said.

Chan first brought her complaint to UBC’s Equity Office in 2009 after being denied the position. The office ran an investigation and then dismissed the complaint, which led Chan to bring her case to the tribunal in May 2010.

“I was disappointed all along the way. I think one of the most disappointing things … would be the UBC Equity Office’s way of handling the whole thing.”

Chan alleges that the VP equity at the time, Tom Patch, had hired a friend of his to do the Equity Office review which dismissed her case.

UBC made multiple attempts to have the case dismissed, but in January 2012, the tribunal ruled that Chan’s case would go to a full hearing, which was originally scheduled for September 2013.

In March 2012, UBC applied to the B.C. Supreme Court for a judicial review of the complaint on the grounds that the case had already been dealt with by UBC’s investigation through the Equity Office. The Supreme Court ruled that the tribunal had not considered whether UBC has sufficiently dealt with the complaint and their decision not to dismiss the complaint “was based on a misapprehension of the evidence and on irrelevant factors.” The court directed the tribunal to reconsider its decision.

Chan asked for the tribunal to include in its reconsideration evidence that she had obtained after filing her original complaint, and UBC said it should not consider materials submitted after that point. The tribunal sided with UBC.

Chan said that, had the case gone to hearing, the additional information would have helped her case.

Chan has no plans to continue pursuing this case.

“In terms of the legal realm, it’s really over,” she said.

“Dr. Chan is a respected scholar and a valued member of the UBC Faculty of Education,” wrote UBC director of public affairs Lucie McNeill in an emailed statement. “UBC took her complaint very seriously and investigated her allegations thoroughly under the procedures set out in UBC’s policy on discrimination and harassment.

“The tribunal’s findings in December concur with our own, and that is gratifying.”

Although the complaint was dismissed, Trerise did decide that UBC’s Equity Office investigation was not a proceeding in the legal sense.

“There, we won, and it’s extremely important in the sense that even though this case is dismissed, this part … is going to set a legal precedent for future complaints,” Chan said.

Chan hopes that her case has drawn attention to greater structural issues. In August 2012, only eight per cent of 110 education faculty members belonged to a visible minority. Chan said inexperience in the legal realm, high legal fees and mental health issues caused by stress affected her and may impede others from who file similar complaints.

“We’re talking about a huge structural gap in the Canadian equity scene here. There’s no effective and efficient system for any equity complaint, and for me that is very serious. Canada tends to project this image: we’re a multicultural country, we take equity seriously. I walk through this process — no. This, for me, is a mirage.”

IDEALaw: Aboriginal Rights in the Spotlight

Canadian Civil Liberties Association–January 25, 2014–On January 24th-25th 2014 academics, practitioners, community members, and students have been gathering at the Schulich School of Law, Dalhousie University to discuss and examine the state of Aboriginal rights in Canada. The biennial IDEALaw conference has never seen a comparable response in numbers and media interest. The line up of speakers, cultural events, and discussion focus of the conference has created a buzz in Halifax.

Organized by students, the conference attempts to address a number of pressing issues facing Aboriginals. Environmental concerns, poverty and criminal law issues, and police and institutional responses to protest are all on the bill. The conference was develped to encourage discussion and openness to new approaches, different perspectives, and engaging the public in legal and political action in response to community concerns. While the conference is ongoing, all talks thus far have addressed the chilling effects of organised and concerted rights abuses on the civil liberties and human rights of Aboriginals in Canada and abroad.

The conference opened with a fascinating and rousing talk by Sheila Watt-Cloutier on human rights. Her experience as head of the Inuit Circumpolar Conference and own experiences as an advocate for Inuit in Canada and overseas gave a fascinating and “on the ground” perspective on alternative ways to perceive climate change. Her commentary on and analysis of the success attached to the ICC’s Petition to the Inter-American Commission on Human Rights Seeking Relief from Violations Resulting from Global Warming Caused by Acts and Omissions of the United States set the tone for continued discussion into the night. Of particular interest to most was the role of democratic and social rights and their protection in communities facing significant and overwhelming changes due to environmental impact.

How far is too far when it comes to religious accommodation?

Matthew Coutts, Daily Brew, January 9, 2014– Is it appropriate to allow university students decline to participate in a class assignment because it would force him to interact with female students, or should they be expected to set their “firm religious beliefs aside” in their search for higher education? And how should technology play into the decision?

That question is at the centre of a debate ongoing at Toronto’s York University, where a sociology professor and university brass have clashed over whether a student’s religious belief should allow him to skip class assignments that bring him into contact with women.

The debate stems from a decision made by Professor Paul Grayson in September, when a male student in an online sociology course asked to be excused from an in-person assignment that would bring him in contact with female students. The students claimed “firm religious beliefs” as his reason for not wanted to intermingle with female students.

Grayson denied the request on the ground that it marginalized and punished female classmates. York University officials, however, approved the student’s request for religious accommodation and ordered Grayson to allow the student to remain absent from the session.

The student acquiesced and ultimately completed the project. In the meantime, however, the professor and university have locked into a battle that could write the playbook for future arguments around religious accommodation.

“If for religious reasons you exempt a student from interacting with females, there are religious reasons people could advance for not interacting with blacks, Jews, gays, you name it,” Grayson told SunNews Network. “In the bible and in religious practice you can find a basis for that kind of appeal.”

University Provost Rhonda Lenton retorted in a statement that every accommodation request is considered on its own merits. She said the circumstances of this case led the university to conclude the accommodation could be made.

“A deciding factor in this case was that it was an online course where another student had previously been given permission to complete the course requirement off-campus,” Lenton announced. She later told CBC’s Metro Morning that, “Had it not been an online course, it is my view that … the advice that would have been given to the professor and to the student is that this is a course that is being delivered on campus and in person, and part of the assignments are to work with other students in the class.”

Lenton notes that another student was allowed to skip an in-person assignment, suggesting it was an accommodation the professor was willing to make under some circumstances. Grayson said in interviews that a student taking the course from Egypt had previously been shown leniency due to his or her distance from campus.

Indeed, details published in the National Post suggest that the student at the centre of the debate enrolled in the online sociology course out of a belief that it would allow him to finish his degree without intermingling with other students – specifically females.

If that is the case, then it could be seen as an attempt by the student to work within the framework of York – accommodate the university and its inclusive environment, you could say – to balance his religious beliefs with his desire to complete his degree.

It is not clear what religion the student holds, and Grayson has said he consulted several religious leaders before coming to his decision. It should be noted, however, that when the professor denied the accommodation request, the student agreed to participate without further complaint. He even thanked Grayson for the way he handled the situation.

Lenton said that while the student and teacher were able to come to an agreement, “the broader issue of religious accommodations in secular universities remains an important societal concern that warrants further discussion.” The Ontario Human Rights Commission is reviewing the case.

Part of that review should be the role technology has played in all of this. Is it truly reasonable to expect religious accommodation through online courses? Should such a course allow members of society to harbor personal beliefs that will surely come to a head later in life?

Regardless of whether the course is online or not, the student in question will graduate with a degree from York University. Is the school comfortable attaching their reputation to a student who may, upon entering the job market, beg out of meetings because female co-workers and bosses will be in attendance?

York University should have one set of standards across campus. Accommodation is important but reason should still be a factor, whether the student is logged on from home or sitting in a classroom.

BC HRT dismisses Chan v UBC racial discrimination case #ubc # bced #bcpoli #yteubc #idlenomore

On 19 December 2013, the BC Human Right Tribunal dismissed UBC Professor Jennifer Chan’s complaint of racial discrimination in her application to the David Lam Chair in Multicultural Education in December 2009. In The BCHRT’s decision on 24 January 2012 to hear the Chan v UBC and others [Beth Haverkamp, David Farrar, Jon Shapiro, Rob Tierney] case (21 December 2010 HRT decision; 24 January 2012 HRT decision) was moved to the Supreme Court for a judicial review (see the Ubyssey’s [UBC student newspaper] feature article for the backstory to the case). The Supreme Court then ordered the HRT to review its initial decision (29 May 2013 BC Supreme Court judgment).

In this 19 December 2013 decision to dismiss, the HRT concluded that “There is insufficient material put forward by Dr. Chan respecting the circumstances of these various allegations of discrimination against her in other instances. The Tribunal does not investigate and relies upon parties to put forward all of the information that they need to support their positions in a s. 27 application.” Tribunal Judge Norman Trerise continued: even in a context of “deficiencies alleged by Dr. Chan, that the selection was contaminated by discrimination on the basis of race, colour, ancestry or place of origin contrary to s. 13 of the Code. I find that there is no reasonable prospect that the Complaint will succeed.”

The event provides an important opportunity for members of your association – officers, executive members, chief negotiators, equity activists, and other interested members to meet colleagues from other associations, share high level discussion and best practices and build a network of contacts and support so that your association can more effectively fulfill its obligations in relation to the promotion of equity within your institution and the larger society.

The Forum begins on Friday, February 7, 2014, with registration beginning at noon and the opening session at 13:30. The Forum will end at noon on Sunday, February 9. The Forum will be conducted in English; there will be no simultaneous translation.
