Vancouver Observer: Professors blast UBC’s “failures of governance”

The Vancouver Observer recently published a commentary co-authored by Sandra Mathison, Stephen Petrina and myself (co-directors of the Institute for Critical Education Studies) on the recent failures of governance at the University of British Columbia.

UBC faculty, staff, and students protest Board of Governors meeting #UBCClean [UPDATED]

UBC faculty are not generally a rowdy bunch, but there were a couple of hundred out today protesting the Board of Governors meeting and demanding UBC management and Board accountability.

UBC faculty, staff and students were protesting the UBC Board of Governors Meeting held on campus at the R. H. Lee Alumni Centre, and demanding a clean up of the Board and university administration, in particular that:

  • the Board of Governors stops holding secret, undocumented meetings
  • the Board honours its duty to operate in a transparent and accountable fashion
  • an external review of its past practices takes place immediately.

More bucks than brains: James Ramey and the ruination of the University of Louisville

In the late 1990s, Kentucky’s legislature initiated a program to upgrade and reform the state’s postsecondary education system, it was called “Bucks for Brains.” (The state’s promotional tagline at the time was “Open for Business.”)

I was recruited to the University of Louisville in 2001 and spent two-and-a-half years on the faculty there as a department chair and distinguished university scholar, which gave me an up close and personal experience with a university administration that’s, as they say where my family’s from, sigogglin.

John W. Shumaker, a classics scholar, was UofL president when I arrived and he proved to be an incredible fund raiser, increasing the university’s endowment from under $200 million to $550 million.

Of course, the UofL has long been the recipient of corporate largesse, especially from the Louisville’s corporate giants Brown-Forman (one of America’s largest spirits and wine companies); Brown & Williamson (which chemically enhanced the addictiveness of cigarettes, remember whistleblower Jeffrey Wigand? No? Well I’m sure you remember Russell Crowe playing Wigand the blockbuster movie The Insider); Papa John’s Pizza (UofL football Cardinals play in Papa John’s Cardinal Stadium); and Yum! Brands (“feeding the world” crap food via KFC, Pizza Hut, and, of course, Taco Bell, more on the Mexican connection later).

After Shumaker left to head up the University of Tennessee (where he resigned in disgrace after 3 years), he was replaced by James R. Ramsey, who had been Kentucky’s state budget director under Gov. Paul E. Patton (who became wealthy by exploiting Kentucky’s coal miners).

Patton’s major achievement as governor was overhauling postsecondary education in the Kentucky. But Patton’s political career was de-railed by duelling scandals: (1)  an extramarital affair and a sex-for-favors scandal; and (2) pardoning four of his political advisers who were indicted for violating Kentucky’s campaign finance laws and for allegedly abusing his patronage powers.

All of this is just everyday Kentucky politics, so Patton wasn’t distracted enough to forget he had to find a soft-landing for his budget director, thus Ramsey, with no university administration experience, became the 17th president of the University of Louisville.

Since Ramsey has been in office the UofL, in endowment has continued to grow and is now pushing the $1 billion mark, which is really the only logical explanation for why he hasn’t been bounced because Ramsey’s administration has more ethical lapses than Carter has liver pills, pretty much proving that the UofL has more bucks than brains.

Robert Felner: Former Dean, Convicted Felon

Felner arrived in Louisville with some spiffy credentials: PhD in psychology from Yale; former head of the department of psychology at the University of Illinois; a CV packed with pages upon pages listing his publications in top journals and, most importantly for the UofL administration, a staggering number of grants.

Despite several red flags about Felner’s candidacy for dean of UofL’s College of Education and Human Development, Ramsey and his long time provost, Shirley Willihnganz, couldn’t wait to get Felner on campus.

Ramsey was in such as rush to land Felner he and Willihnganz forgot to tell the interim dean (and other finalist for the position) they hired Felner, so he was left to discover the decision when Felner call his secretary and started giving her instructions. So much for that HR seminar!

Things in CEHD soon started to fall apart.

I resigned from my department chair position two weeks after Felner took over as dean and later moved to UBC.

Within a few years, there had been 30 grievances filed by faculty and students against Felner for a wide range of abusive managerial practices and a faculty vote of no-confidence in Felner’s leadership of the CEHD. Reasons given by faculty for the vote of non-confidence included:

Public humiliation of faculty, work place harassment, retaliation for voicing opinions, little or no governance, decisions that hurt College, unacceptable and unfair hiring practice; rude, offensive, unethical behavior by CEHD representatives; denial of support for research to those who differ in opinion; and extreme inequity of pay. Despite the abominable conditions in CEHD, UofL Provost Willihnganz and Ramsey both supported Felner publicly.

One year after the vote of no-confidence, Felner announced he was leaving the UofL to become president of the University of Wisconsin, Parkside.

The Chronicle of Higher Education described Felner as “riding high” a couple of years into his deanship at UofL, well-paid, and having secured a $700,000 grant from the US Department of Education. However, he “pressed his luck” during his last weeks in Louisville.

Even though only $96,000 remained in the account, he implored Louisville officials to approve a $200,000 subcontract with a nonprofit organization in Illinois that had already received $450,000 from the grant. Perhaps, he suggested, the university could draw on a special fund that had been established by the daughter of a former trustee.

The Illinois group, Mr. Felner said, had been surveying students and teachers in Kentucky. That survey would “let us give the feds something that should make them very happy about the efficiency and joint commitment of the university to doing a good job with an earmark, as I know we will want more from this agency,” he wrote in an e-mail message on June 18.

But on June 20, his last day as Dean of CEHD before he headed off to Wisconsin, those big black SUVs with government plates (like the ones you see on Criminal Minds) rolled into the CEHD parking lot. US Secret Service, US Postal Inspectors, and UofL Police questioned Felner and escorted him off campus, along with his computers and records.

There was a simultaneous raid on UW-Parkside to confiscate material Felner had shipped ahead of his arrival there.

In October 2008, a federal grand jury indicted Felner on nine counts of mail fraud, money laundering, and tax evasion. According to the indictment,

the Illinois nonprofit group, known as the National Center on Public Education and Prevention, was simply a shell that funneled money into the personal bank accounts of Mr. Felner and Thomas Schroeder, a former student of his and the group’s “executive director.” Prosecutors say the two men siphoned away not only the $694,000 earmarked grant, but also $1.7-million in payments from three urban school districts, money that ought to have gone to the legitimate public-education center that Mr. Felner had created in Rhode Island.

In January 2010, Felner pleaded guilty to nine Federal charges, including income tax evasion.

In May 2010, Felner was sentenced to 63 months in US Federal Prison for his role in defrauding defrauding the UofL and the University of Rhode Island, where he had been director of the School of Education, of $2.3 million of US Department of Education funds earmarked for No Child Left Behind Act research.

Felner Footnotes: Indians, John Deasy, Non-Disclosure Agreements & Ramsey as the Frito Bandito

(1) When Felner announced his resignation, UofL president Ramsey wroted to Felner and said he was worried about “letting the Indians get back in control of the reservation.” That’s some serious respect for university faculty and the idea of shared governance, eh?

(2) Los Angeles school superintendent, John Deasy, has had his academic credentials called into question. Deasy was given a PhD by the University of Louisville after he was enrolled for four months and received a total of nine credits.

Deasy’s doctoral advisor was, surprise, Robert Felner! Deasy had previously awarded $375,000 in consulting contracts to Felner, while Deasy was Superintendent of Santa Monica schools.

Ramsey appointed a “blue-ribbon” panel to investigate Deasy’s degree. The panel found that getting a PhD in four months at the UofL was not cause for concern, thus plunging the UofL’s academic reputation down into the neighbourhood of fly-by-night for-profit “higher” education.

Deasy is now working in an unaccredited training program sponsored by educational de-formers the Broad Foundation, which teaches school leaders business methods and supports charter schools and closing public schools.

(3) Ramsey has been making double retirement payouts to UofL administrators for their silence.

Records show that the school paid a full year’s salary to outgoing vice presidents Michael Curtin ($252,350) and Larry Owsley ($248,255) and to assistant to the president Vivian Hibbs ($66,391) to induce them not to “disparage, demean or impugn the university or its senior leadership.”

In March 2014, UofL made a $346,000.00 settlement with university counsel Angela Kosawha:

The University of Louisville is paying another large settlement in connection with the retirement of a high-ranking official — this time, $346,844 to its top lawyer. University counsel Angela Koshewa is on a three-month leave of absence before she officially retires June 1. Documents obtained under the Kentucky Open Records Act show the university is paying Koshewa — who has questioned some expenditures and proposals backed by President James Ramsey and Dr. David Dunn, the executive vice president for Health Affairs — twice her final salary.

It costs a lot for Ramsey to cover up details of his administration’s incompetence and shenanigans, but remember there are lots of bucks at UofL.

(4) Provost Shirley Willihnganz stepped down as UofL provost earlier this year. The Louisville Courier-Journal reported that

Under her watch, however, university employees have stole, misspent or mishandled at least $7.6 million in schemes at the health science campus, the law school, the business school and the athletic department’s ticket office.

Willihnganz also was criticized for approving about $1 million in buyouts for former high-ranking employees, some of which included agreements not to disparage the university or its leaders.

She also was forced to apologize to CEHD faculty in 2008 for failing to take any common-sense action against Felner for his intimidation, harassment, humiliation and retaliation against faculty, staff, students and alumni.

Willihnganz said at the time that she tended to dismiss the early complaints against Felner — including a no-confidence vote by faculty — because he was a “high performer” and because the complaints came from professors and staff “entrenched in their ways and resistant to change.”

She later told faculty at a meeting that she was sorry. “Mostly what I think I want to say is people have been hurt and something very bad happened, and as provost I feel like I am ultimately responsible for that,” she said.

No duh! She actually is directly responsible for the Felner disaster (along with Ramsey), that’s probably why she feels that way. And speaking of resistance to change …

(5) This next item has nothing to do with Felner, except that his former boss and advocate, James Ramsey, is also the long time boss of UofL basketball coach Rick Pitino who admitted to having sex with a woman in a swanky Italian restaurant in Louisville. Apparently that’s not a problem with Ramsey and the UofL because Pitino said it wasn’t rape.

(6) And I almost forgot. Remember the Taco Bell/Mexican connection. This week Ramsey had a little halloween party at the UofL. Ramsey goes racist (again). Yes, he dressed up like the Frito Bandito.

Arvind Gupta: Known knowns, known unknowns, unknown unknowns …

“There are known knowns. These are things we know that we know. There are known unknowns. That is to say, there are things that we know we don’t know. But there are also unknown unknowns. There are things we don’t know we don’t know.” Donald Rumsfeld

This past Friday the University of British Columbia Board of Governors announced that Arvind Gupta had resigned as president of the university. The announcement was shocking because Gupta had just completed the first year of his five-year term.

There very few knowns, a lot of unknowns, and perhaps even more speculations about Gupta’s “resignation.”

The announcement raises many questions as it came after an unscheduled Board of Governors meeting and Gupta was not quoted in the news release nor has he commented on his resignation. The past year has seen a wholesale shakeup of top administrators at UBC and now former UBC president Martha Piper has named as interim president (starting in September).

That giant sucking sound you heard the past few days is of speculation rushing in to fill to fill the vacuum in the UBC president’s office.

Is Gupta’s exit connected to the shake up of  high level executives in the university?

Charlie Smith speculates it might have something to do with the departure of Pierre Ouillet who was UBC’s Vice President Finance.

Smith has also offered that Gupta’s departure might be related to his inability to squeeze more money out of the provincial government or because transit referendum or because Christy Clark or because fundraising in general.

Jennifer Berdahl‘s suggestion that Gupta is out because he lost the “masculinity contest” among UBC’s administration seems to have a lot of popular support based on attention it’s getting in the twittersphere.

Berdahl is the Montalbano Professor of Leadership Studies: Gender and Diversity in the Sauder School of Business at UBC. She wrote on her blog:

I believe that part of this outcome is that Arvind Gupta lost the masculinity contest among the leadership at UBC, as most women and minorities do at institutions dominated by white men. President Gupta was the first brown man to be UBC president. He isn’t tall or physically imposing. He advocates for women and visible minorities in leadership – a stance that has been empirically demonstrated to hurt men at work.

Berhdahl describes her positive working experiences with Gupta, but doesn’t offer evidence to support a claim that the masculinity contest theory applies to him in this circumstance.

There’s no denying that higher education is rife with workplace harassment, bullying, and mobbing. (The journal Workplace: A Journal of Academic Labor recently devoted an entire issue to this topic.)

When work is a “masculinity contest,” says Berdahl, “leadership does not earnestly seek expert input, express self-doubt, or empower low-status voices.” I’ve got no argument with her on this point. Indeed, in my dozen years on the faculty at UBC, I’d say that there has been no leadership at the faculty or university level that has earnestly sought input from anyone (much less experts), expressed self-doubt, or empowered low-status voices.

The standard operating procedure at UBC is akin to that of the British Empire of old. The king or queen makes a decision and then the shit then flows downhill. There might be an occasional “walk about” to see how the courtiers, knights, or peasants might react to this or that, but UBC is a top-down organization, run like an empire, or at least a corporation.

As Justin McElroy points out, whatever it is it’s no ordinary resignation.

McElroy’s exchange with Neal Yonson, who is editor of UBC Insiders, raises some interesting questions and offers up some possible explanations, that while speculative, aren’t tabloid fodder, and focus on the relationship between the BoG of the president’s office.

They make some good, if self-evident, points:

  • Gupta and the BoG didn’t see eye to eye;
  • After an 18 month transition from Steven Toope to Gupta, UBC is now facing another leadership transition after just one year and that will have deleterious effects on a multiple fronts, both internally and externally;
  • Numerous current upper administration jobs are filled with people who are new or in interim roles;
  • BoG’s move to bring in known quantity Piper might steady the ship administratively, but Piper is not student-friendly, especially on the tuition front;
  • UBC capital projects are in a holding pattern.

McElroy and Yonson say that despite the lack of external dissent, there were internal  “hints” that Gupta’s honeymoon was over, but university presidents always have their detractors and I don’t think the lack of “charm offensive” on Gupta’s part was key to his failure as president.

What they might not know is that this spring and summer there were rumours on campus that Gupta was in serious trouble with the BoG. I’m not enough of an insider have any substantive knowledge of those rumours, but I heard a university administrator opine that the BoG certainly wanted David Farrar, who left the position of Provost and Vice President Academic in June, to stay close at hand. Farrar was the third Vice President to vacate office under Gupta.

There are still lots of unknowns and UBC would be greatly served if the BoG and the university administration acted in more open and transparent ways. (Don’t hold your breath because as Yonson points out this is a board that wants to keep the public ignorant by operating in secret.)

If blame must be laid, there’s no getting around the fact that the UBC Board of Governors made a mistake in hiring Gupta.

If Gupta resigned of his own accord, then the BoG erred in hiring someone with no traditional higher ed administrative experience and for whatever reason (barring extremely personal reasons) could not handle the job.

If the BoG forced Gupta out, then they erred by making a non-traditional hire and then not giving Gupta a sufficient amount of time or the support to bring his vision to fruition.

Alfie on Assessments, Goals, and Big Tests: What is its basic conception of assessment? To get a sense of how well things are going and where help is needed, we ought to focus on the actual learning that students do over a period of time—ideally, deep learning that consists of more than practicing skills and memorizing facts. If you agree, then you’d be very skeptical about a program that relies on discrete, contrived, testlike assessments. You’d object to any procedure that seems mechanical, in which standardized protocols like rubrics supplant teachers’ professional judgments based on personal interaction with their students. And the only thing worse than “benchmark” tests (tests in between the tests) would be computerized monitoring tools, which the reading expert Richard Allington has succinctly characterized as “idiotic.”

The Bottomless Pit of Evidence vs High-Stakes Tests (does evidence matter?): Children perform best in exams when teachers are not overly concerned about their test results, according to research published today. Pupils show greater motivation, are better behaved and are more likely to be independent and strategic thinkers when teachers are not obsessed by grades, the study by the Institute of Education found.

Krashen on VAT: Value-added evaluations of teachers assume that higher test scores are always the result of teaching. Not so. Test scores are influenced by other factors. We can generate higher scores by teaching “test preparation” strategies for getting higher scores without students learning anything. We can generate higher scores by testing selectively, making sure that low scorers are not in school the day of the test. And of course we can generate higher scores by direct cheating, sharing information about specific test questions with students. Teachers who prepare students for higher scores on tests of specific procedures and facts are not teaching; they are simply drilling students with information that is often soon forgotten. Moreover, research shows that value-added evaluations are not stable year to year for individual teachers, and that different reading tests will give you different value-added scores for the same teacher. If The Times is serious about helping children, don’t bash teachers, address poverty. American children from high-income families do very well on international tests, but our children of poverty do much worse.

The One-Sided Truth About Value Added Teaching: From the LA Times owner’s perspective, they tell the truth on behalf of important sections of the ruling class, and occasionally those sections fight it out both on the editorial pages and in the rest of the paper too. Within that context of what is really their truth, the value added research “works,” in that it sees school workers (who have always been workers and have been professionals almost only when bosses want educators to make sacrifices) as people whose minds must be stripped; their minds and creativity replaced with the minds of managers as in the common (bourgeoisie) core standards, in other regulated curricula, in high-stakes exams (production quotas), and who must be won to this alienation as a necessity for, on one hand, the chance to keep a job, and on the other hand, for the good of the nation’s kids (future workers and warriors)…

The Lines of Influence in Education Reform (check the link to the draft/chart): Another example is the AFT, the American Federation of Teachers, where Bill Gates gave AFT $3.4M for “teacher quality initiatives” and $217, 200 for AFT conference expenses. See: Did Bill Gates Buy His Podium at the AFT Convention? Sometimes a breakdown of the numbers provides a more clear picture of the power and influence of money. Then there is money “with stipulations” that the Gates Foundation provided to NPR. The purpose of that money is “to support coverage of education issues on NPR programs, including the Morning Edition and All Things Considered”. The amount provided was $750,000. I don’t feel comfortable with that on many levels.

UC Boss Lives Like Czar (Flees Lease): Mr. Yudof, 65, moved with his wife into a 10,000-square-foot, four-story house with 16 rooms, 8 bathrooms and panoramic views. He said he needed the house, which rented for $13,365 a month by the end of the lease and was paid for by U.C., to fulfill his obligation to host functions for staff members, donors and visiting dignitaries.

Mr. Yudof held 23 such functions over a two-year period, according to the university. He also ordered a list of improvements and repairs — including air conditioning and 12 phones — that drove up costs and, according to staff members, tied up university officials in meetings and lengthy negotiations on issues ranging from water bills to gopher eradication.

After the Yudofs vacated the property at the end of June, Brennan Mulligan, the landlord, informed university officials that he intended to keep the U.C.’s $32,100 security deposit. Mr. Mulligan requested an additional $45,000 to cover the repairs for hundreds of holes left from hanging art, a scratched marble bathtub, a broken $2,000 Sivoia window shade and other claims.

WSU’s Tragic Detroit Trajectory–Falls to 4th Tier, then This: Wayne State University is failing its African-American students, graduating fewer than one in 10 while success for their white counterparts is four times higher, according to a report issued this month. The graduation gap between white and black students at WSU is the worst in the nation among public universities, according to a report by the Washington, D.C.-based Education Trust.

After Painting School Doors Blue (closing 40, laying off hundreds of teachers) Detroit PS sends 62 page Homework Packages to Students 2 Weeks Before School Opens but 2000 teachers and Dozens of Principals Have No Assignments: Detroit elementary and middle-school students don’t resume classes for two weeks, but they already have homework. Detroit Public Schools announced Monday it will mail 62-page packets of homework this week to 28,650 students in grades three through eight. The packets, which must be finished and turned in the first day of classes, focus on areas in which DPS students have tested poorly.
The initiative is the first time DPS students have been given homework before the start of school, said DPS spokeswoman Kisha Verdusco.

Detroit Foundations Release List of Worst Schools in Detroit (August 25): The first-ever ranking of the city’s public, charter and private schools is being released today in an effort to help parents choose good schools and pressure failing schools to shut down…
listing of schools in the city is produced by Excellent Schools Detroit, a broad coalition that includes Detroit Public Schools, charter school leaders and several foundations. The list is divided in three categories — elementary, middle and high schools — and the schools are ranked based on test scores and other data averaged over a three-year period.

What if There Was a Parade for Schools and Only Fools and Crooks Came? (Cosby pops up waiving his bogus doctorate): Waving from the final float were Mayor Dave Bing, activist Rev. Jesse Jackson, comedian and activist Bill Cosby, and Robert Bobb, the district’s emergency financial manager under whose watch the parade was launched last year…The crowd was fairly thin.

California–No School Funds for September: California will delay paying $2.9 billion of subsidies to schools and counties in September, a month earlier than projected, to save cash amid an impasse that has left the state without a budget for 54 days.

Obamagogue’s Errand Boy, Duncan, Wants More Data For Merit Pay and Firings: U.S. Education Secretary Arne Duncan will call for all states and school districts to make public whether their instructors are doing enough to raise students’ test scores and to share other school-level information with parents, according to a text of a speech he is scheduled to make Wednesday.

SoCal Bans Literature With Help of Teachers and Profs: “The Old Man and the Sea,” “The House on Mango Street,” and “The Great Gatsby” are so last century when it comes to high school English classes in Chula Vista and National City. Once literature-based, English classes throughout the Sweetwater Union High School District — and elsewhere in California — have been revamped in an attempt to better prepare students for college and the real world.

That means reading lists once dominated by the classics now consist of newspaper editorials, historic documents, advertisements and some nonfiction. Assignments no longer dwell on the symbolism in a poem or focus on an entire novel. Instead, they emphasize expository, analytical and argumentative writing.

Developed by professors from the California State University system with help from high school teachers, the new “rhetorical approach” to English was designed to curb the growing number of high school graduates who need remedial instruction in college…the district saw a jump in scores on statewide English tests.
